HomeMy WebLinkAboutCAG-98-115CAG-98-115 MEMORANDUM OF UNDERSTANDING The following represents the terms of an agreement in principal reached between the City of Renton and Boeing to facilitate Boeing's constru ;tion of a storm sewer interceptor along the City's Cedar River Trail in Renton, Washington. It is the intent of both parties that the attorneys for both parties utilize this Memorandum of Understanding to prepare the necessary agreement for approval, and to prepare the required Amendment to the Potable Water and Electrical Use Agreement dated September 6, 1996. RE(:iTALS A. Boeing has requested permission from Renton to utilize a portion of the City's Cedar River Trail property to construct and maintain an underground storm sewer interceptor. B. The City of Renton has requested Boeing to install underground water and electrical service lines from its "4-41 Building" to the Renton Boathouse. C. Renton has independently appraised the value of the easements requested by Boeing to complete the sewer, and Boeing has estimated the cost to install water and electrical service to the Boathouse as requested by the City. The estimated value of both projects is nearly equal, and the parties therefore agree in principal to the following: TERMS OF AGREEMENT 1. The City of Renton agrees to convey, at no cost to Boeing, a permanent easement together with a temporary (six month) construction easement fc.- the purpose of construction, use and maintenance of an interceptor storm sewer. The location of the sewer and easement is generally depicted on the attached "outfail interceptor' diagram. 2. Boeing agrees to prepare the required easement documents for approval by Renton. 3. Boeing agrees to engineer, install and maintain, at no cost to Renton, water and electrical service from Boeing's 4-41 Building to the Renton Boathouse. Water service will include both domestic and fire flow systems. Construction will be underground or under the waterwalk, and conform to all applicable codes. The electrical service will terminate at the main panel near the center bridge on the 98-107DF.DOC MEMORANDUM OF UNDERSTANDING south side of the boathouse. The potable water supply line and fire flow system, if needed, will terminate near the bridge on the south side of the boathouse. Renton will provide Boeing with specific requirements of these utility lines and connections. 4. Both parties understand and agree that the utility extensions will be the property of Boeing, and not subject to connection fees. Distribution of these utility lines within the Boathouse is the obligation of Renton, at its sole cost. 5. Both parties agree to amend the existing "Potable Water and Electrical Use Agreement" to include the provision of water for fire flows. All other terms of the agreement remain in full force and effect. 6. It is the desire of both parties to meet each other's project completion schedules. Renton agrees to execute the easement documents within 30 days of receipt by the City. Boeing agrees to complete installation of the required utility lines within nine (9) months of execution of the easement documents. 7. Related Agreements: a. Potable Water and Electrical Use Agreement, dated September 5, 1996. b. Fire Hydrant and Fire Water Use Agreement, dated September 16, 1993.
