If the Utility is constructing its facility while the State's contract is in effect, the Uti..ity shall direct its construction so as not to hinder the State's contractor in his operations. (b) . The work of laying pipe and testing shall follow the -)ening of trenches as closely as possible, and len1ths of not more than two hundred (700') feet of trench shall be open at one time. (c) . When the Utility places its facility across a roadbed ttnt is being constructed, the trench shall be backfilled in horizontal layers not to exceed six (6) inches in loose thicl-ness, except that the layers of the top two (_) feet from profile grade shall not exceed four (4) inches in loose thickness. t'ach laver of the entire embankment shall be cots?acted to 95 per cent of the maximum density as ,letermined by com- paction control tests. The motsture content of the embankment material at the time of compaction shall be as specified by the State's Project Engineer. (d) . All manholes , valve covers, and like appurtenances a.hall be constructed at such an elevation to conform to the shoulder slope of minus one-half (112) inch per foot from the edge of pavement. (f) . The franchise holder shall furnish two (2) copies of a revised franchise plan of the final location or relocation of its facilities. This in- formation shall be furnished immediately upon completion of the work r given to the Highway District Engineer's office. (g). Prior to the date of hearing, a surety bond in the amount of $1,000.00, written by a surety company authorized to do business in the State of 1 Washingtcn, shall be furnished the State by the City of Renton toinsure proper compliance with any and all of the terms and conditions of this franchise, and said bond shall remain in force for a period ending not more than one (1) year after date of completion of construction. (h) . The alignment of the sewer line shall be as shown in the City of Renton Engineering Department's plan entitled "North Renton Interchange Sanitary Sewers", sheet 1 of 1. (t) . This franchise is subject to Chapter 47 .44. RCW and amendments thereto. Thi ., franchise is also subject to all applicable provisions oY Resolution No. 1432 passed by the Commission on April 15, 1964, except that any provision herein not consistent with said resolution shall be controlling. 2. Whenever necessary for the construction, repair, improvement, alteration or relocation of all or any portion of said highway es determined by the Commission, or in the event that the lands upon which said highway is presently located shall become a new highway or part of a limited access highway, or if the Commission sha11 determine that the removal of any nr all facilities from the said lands is necessary, incidental, or convenient to the construction, repair , improvement, alteration c relocation of any public road or street, this franchise may be cancelled (in whole or in part) upon notice by the Commission, and any or all of such facilities shall be relocated, or removed from said highway as may be required by the ^ommiission. 3. Upon failure, neglect or refusal of the Holder to immediately do and perform any change, removal, relaying, or relocating of any facilities, or any repairs or reconatruction of said highway herein required of the Holder, the State way undrrtrke and perform such requirement and the cost and expense thereof shall be immediately repaid to the State by the Holder. t t 4. The granting of this franchise shall place no obligation upon the Commission or the State of Washington to warrant or defend any rights hereby granted. The Holder shall save and keep the State of Washington harmless from any and all damages, claims or injuries that may occur by reason of the con- struction, maintenance and operation of any facilities of the Holier. 5. Any breach of any of the conditions and requirements herein made, or failure on the part of the Holder of this franchise to iroceed with dtie diligence and in good faith after its acceptance, with constri n work hereunder, shall subject this franchise to cancellation after a hearing before the Comedssiol, of which said hearing the Holder shall be given at least ten days written notice, if at that time the Holder is s resident and doing business in the State of Washington; otherwise, by publishing a notice of said hearing once a week for 1 two consecutive reeks in a newspaper of general circulation in Thurston County, i Washington, the last publication to be at least ten days before the date fixed for said hearing. b. Whenever it is deemed necessary for the benefit and safety of the travel- ing public, the Commission hereby reserves the right to attach and maintain upon any facility by the holder under this franchise any required traffic control devices, such as traffic signals, luminaires and overhead suspended signs, when l the use of such devices or atrachments does not interfere with the use for which the facility was constructed. The State shall bear the cost of attachment -3- a. and maintenance of such traffic control devices, including the reasonable cost i C of any extra construction beyond normal: such extra cost to be determined jointly by the Commission and the Holder of this franchise. It is not to be construed that the 5 is to share in the normal cost of installation, operation or maintenance of any of the facilities installed under this franchise. 7. No assignment or transfer of this franchise in any mminer whatsoever shall be valid nor vest any rights hereby granted until the Commission consents thereto and the assignee accepts ali certas of thie franchise. Attempting to assign this tranchise without Commission consent shall be cause for cancellation as herein provided. 8. The Holder shall, within twenty (20) days from receipt of a copy of this order, file wit' the Conmmission at Olympia its bond and written acceptance of the terms and conditions of this franchise. 9. It appears that your plan for Franchise No. 3812, which indicates six manholes within the immediate area of the ramp system at two controlled access highways, is not aaeyuately designed. Further, it appears chat at a later date it is I intended to extend the sewer system to the east along, the freeway shoulder. It is no' known how long this extension will be, but we understand that it will reach at least to 112th Avenue S.E.. Before this design may be given consideration,from the standpoint of maintaining a facility within the limited access highway area, our Headquarters personnel advise us it will be necessary to consid-r any available alternatives. Also, please advise how far the sewer system w11 be extended easterly along the freeway shoulder. we will appreciate an early reply as we are holding up prccessing of the above-noted franchise, pending receipt of your reply.
