WHEREAS by Resolution No. 1_ 35 adopted April 22, 1968, the City Council of the City of Renton declared its intention to construct and install certain sanitary sewer lines, together with appurtenances thereto, within certain territory in the Honey Croak Park area at hereinafter more -articularly described, and fixed the 20th day of May, 1968 in the City Council Chambers in the City }tall, Renton, Washington, as the time and place for hearing all matters relating to said proposed improvements and all objections thereto and for determining the method of payment for said improvements, and WHEREAS Jack Wilson, City Engineer, has caused an estimate to be made of the cost and expense of the proposed improvement and has certified said estimate to the City Council, together with all papers, data, end information in his possession relating; to the proposed improvement, description of the boundaries of the District, a statement of what portion of the cost and expense should be borne by the properties within the proposed District, a statement in detail of th^_ Local Improvement assessment outstanding or unpaid against the property in the proposed District, and a statement of the aggregate actual valuation of the real estate, including 25`I; of the actual valuation of the improvements in the proposed District, according to the valuation last placed upon it for the purpose of general taxation; and WHEREAS said estimate. is accompanied by a diagram of the proposed improvement showing thereon the lots, tracts, parcels of land, and other property which will be specially benefited by the proposed improvement , and the estimated amount of the cost and expense thereof to be borne by each lot, trait and parcel of lard or other property within said District; and WHEREAS due notice of the hearing upon said Resolution No. 1555 was given in the manner provided by law, and said hearing was duly held by the City Council at its regular meeting on May 20, 1968, at the hour of 8:00 p.m, and all protests having been duly considered of said meeting and some not exceeding e.e2%of the total cost bearing owners within said District, and WHEREAS at said hearing the City Council has given due consideration to the special benefits to be received from such proposed improvement by all of the properties to be included within the rroposed local improvement district; and WHEREAS the Ci' Council deems it in the best it rests of the City and of the owners of the property within the proposed Local Improvement District that said improve- ment as hereinafter described be carried out, and that a Local Improvement District be created in connection therewith; NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, AS FOLLOWS: SECTION 1 : The following sanitary sewer lines, includnig trunk lines, shall be constructed and installed in the Honey Creek Park Area of the City of Renton, as follows: Approx. Honey Creek Dr. 8 Concrete Honey Creek Dr. ' M" Street 14th North 8' Concrete 14th North Honey Creek Dr. Easterly 750' 8" Concrete Easement Blk. 1 Honey Creek Park between Lot 9 & 10 8' Concrete Easement Between Lot 7-8 Blk. 2 Honey Creek Park 8' Concrete Easement Over Tots 8-9, 10 & 11 Blk. 1 and there shall be included in the foregoing the acquisition and installation of all necessary pipe, manholes, valves, fittings, couplings, connection equipment and appur- tenances, together with the acquisition of any easements, rights of way and land that may be required; and there shall be included the performance of such work as may be incidental and necessary to the foregoing construction, and installation. The City Council may modify the details of the foregoing described improvement where, in its judgment, it appears advisable, provided such modifications do not substen- tially alter the plan of said improvement. All of the foregoing shall be in accordance with the plans and specifications therefor to be prepared by the City Engineer. SECTION I1 : There is hereby established end created a Local Improvement District to be called "Local Improvement District No. 259 of the City of Renton., Washington" , the boundaries of such Local Improveme • District bein; described as follows: All those portions of Honey Creek Park, recorded in Vo 1. 59 of plats, page 57, records of King County, Washington and of the Southwest One-Quarter of the Southeast One-Quarter of Section 4, Township 23 North, Range 5 East, W.M. , described as follows: All Honey Creek Park according to the Plat recorded in Vol. 59 of Plats, Page 57, records of King County,Wasitington; less the proposed Park Site; LESS those portions of Lots 5 & 6, Block 1, lying easterly of the following described line; beginning at a point on the northerly line of said Lot 5, 14.48 feet westerly of the northeast corner thereof; thence southerly to a point on the southerly line of said Lot 6, 19.83 feet easterly of the most westerly corner thereof; TOGETHER with the east 444.32 feet of the West 662.32 feet of the Southwest One-Quarter of the Southeast On,--Quarter of Section 4, Township 23 North, Range 5 East, W.M. ; lying northerly of Sunset Boulevard (SR 900) LESS the West 34.32 feet thereof; lying southerly of the northerly 167.11 feet. SECTION III : The estimated cost and expense of said improvement is hereby declared to be approximately $28,231.88. The entire cost and expense of said improve- ment, including the cost and expense of all engineering, legal, inspection, advertising, -2- publication of notices and oth<r expenses incidental thereto, shall be borne by and assessed against the property specially benefited by such improveme.:.c included in the Local Improvement District established, embracing, as rtoar as may be, all property specially benefited by such improvement. SECTION IV: The nature of the improvement provided for herein is such that the special bone. its conferred upon the property are fairly reflected by the use of the statutory termini and zone method of assessment, and it is hereby provided and ord- ered that the assessment shall be made against the property of the District in accordance with said method. +l'l property included within the limits of the Loci Improvement District above created shall be considered to be the property specially ucnefited by such Local Improvement and shall be the property to be assessed to pay the cost and expense thereof as hereinabove specified. SECTION V: Local Improvement District warrants shall be issued in payment of the cost and expense of the improvement herein ordered. Such warrants shall be payable out of said "Local Improvement Fund, District No. 259" to bear interest from the date thereof at a rate to be fi-ed hereafter but not to exceed 6% per annum and to be reieemed in cash, and/or by Local Improvement District bonds herein authorized to be issued, said interest-bearing warrants to be hereafter referred to as "revenue warrants". Such bonds shall bear interest at a rate to be hereafter fixed but not exceeding 67. per annum; shall be payable on or before twelve years frcrn the date of issuance, the life of the improvement ordered being not lees than twelve years, and shall be issued in exchange for and in redemption of any and all revenue warrants issued hereunder and not redeemed in cash within a period not to exceed sixty days after the first publication by the City Treasurer of notice that the assessment roll for `,ocal Improvement District No. 259 is in his hands for collection. The bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said District, payable in ten equal annual installments, with interest at a rate to be fixed hereafter, but not exceeding 6% per annum, under the mode of "payment by bends" or by "notes in lieu thereof", as defined by law and the ordinances of the City of Renton, in case of default in the payment of any assessment, when the same shall become due, there shall he added interest at a rate to be hereafter fixed but not to exceed 6% per annum, and n penalty of � % which shall alto be collected. The exact form, amount, date, interest rate and denomination of said warrants and bonds shall be hereafter fixed by Ordinance of the City Council ; however, the City Council may, in lieu of the issuance of such bonds issue installment notes payable out of the Local Improvement District Fund as provided by law, special reference being made to RCP 35.45.150. Said warrants and bonds, or notes in lieu of said bonds, shall be sold in such manner as the City Council shall hereafter determine. 3 - SECTION VI: All th w rk necessary to be done in connection with the making of said improvements shall be lore by and made by contract upon competitive bids and the City shall have and reserves the right to reject any and all bids. The call for bids for work authorized pursuant to this Ordinance shall include a statement that payment for said work will be made in gash warrants drawn upon the "Local Improvement Fund,District No.259". S CZION VII: There is hereby created and established in the office of the City Treasurer of the City of Renton, for Local Improvement District No. 259, a special fund Y to be known and designated as "Local Improvement Fund, District No. 259" into which fund shall be deposited the proceeds from the sale of revenue t,arrants drawn against said fund which may be issued end sold by the City and collections pertaining to assessment., and against which fund shall be issued cash war-ants for the contractor or contractors in payment for the work to be done by them in connection with said improvement, and against w '^b fund cash warrants shall be issued in payment of all other items of expense in connection said improvement, SECTION VI:II: The City Engineer is hereby authorized and directed to call for bids, in the manner provided by law, for the construction and installation of the improvements authorized herein. SECTION IX: The City reserves the right_ to issue, in lieu of bonds and warrants in payment of the cost and expense of the aforasaid Local Improvement District installment recce or notes payable out of the Local Improvement District Fund whenever such note or notes are sold exclusively to another fund of the City as an investment thereof, and further provided by law. N25,9 Dear Mr. ':lnossi The motors on the Honey Cr^e': Park Liftstation pumps failed on .rune 24, 197) and subsequent c:iecking by our maintenance fore:tan and contact with Jim I:cifetn at Pacific Pumping dictated the motors had to be removed and taken to Greenwood Electrical Motor Co. (Mr. Bob Palmor) for repair. No spare motors of this type are available for maintaining operation on the pump station so the City arranged with Luther's Septic Tanis rumoing Co. for pumping out the wetwell until the motors are again operable. I.eiv Erikson, of our Water Utility, Matt Kohl of our water Utility and Wog crews, assistant Building Director, have re- viewed and discussed the prablems relative to the failure. Mr. McBeth, of Pacific Pumping Co, has reviewed and is working an the correction of the problem. we will tabulate the costs relating to the septic tank pumping outfit and anv othar costs involved in correcting the problem ar.d expect cost reimbursement for the repairs necessitated duo to t::o failure. According to the Electrical Firm who is repairing the electric motors, the problem is in the wiring connections operating the motors and is not a probier of the motors. Moved by Pringle, seconded by Alexander, to approve the Minutes of the previous meeting of April 26th and the Special meeting of May 13. Carried. COMMUNICATIONS: Loomis & Kennedy, Inc. Investment Counsellors, summary was read covering, per Agreement with the State Public Pension .'� --nission, analysis of the Pension Fund Account for the City of Renton. The review included suggestions for possi'le changes in investment portfolio and invited questions regarding future investments. Such reports will be received on a semi-annual basis. City Treasurer Gossett has reviewed the report and will take same under aavisement. / Letter from City Engineer reported council authorization of L.I.D. 259, Sanitary Sewers in the Honey Creek Park area at estimated cost of $28,231.88 snd inquired (J whether the Firemen's Pension Fund would be interested in funding of the bonds for this project and if so, at what interest rate. Fireman Pringle asked for discussion regarding King County Medical payments for ,Tames Ashurst, who is now on inactive status, and has transferred his coverage to individual rather than group status, inquiring as to whether reimbursement is in order for April, May and June payments @ $8.86 each. This matter is to be checked regarding payment of the medical premiums by the Pension Fund. Also, billings in sum of $381.80, which includes $45.00 payment made by Mr. Ashurst, were submitted,due Rentcn Hospital in connection with surgery of May 9th and subsequent care through May 14, 1968.
