EASEMENT

by and between LOUIS SHEFFELS and ROBERT C. SHEFFELS
hereinafter called "Grantors," and he CITY OF RENTON, a Municipal Corporation of
King County, Washington, hereinafter call "Grantee."
WITNESSETH:
C) That said Grantors, for and in consideration of the sum of $1.00 paid
t by Grantee, and other valuable consideration, do by these presents, grant,
Q bargain, sell , convey, and warrant unto the said Grantee, its successors and
q assigns, an easement for sewer with necessary appurtenances over, through, across
Cep and upon the following described property in King County, Washington, more
�O particularly described a. follows:

Description for sanitary sewer easement across Lots 3, 5 and 6, Block 4,
Tiffany Park, Division 2 (Vol . 72 of Plats, pages 7, 8 and 9, Records of
King County, Washington) described as follows:
All that portion of land lying 5 feet on each side of the following
described centerline: Beginning at the westerly con.ier of Lot 3 of
said Tiffany Park, Division 2; thence on a 820 foot radius curve right
through a central angle of 1005' 16" a distance of 15.57 feet along
the northeasterly right-of-way line of Kirkland Avenue S.E. to the
true point of beginning; thence N 47°00'22" E a distance of 253.86 feet
to the southwesterly right-of-way line of S.E. 18th Street; said point
lying 1.41 feet on a 275 foot radius curve left through a central angle
of 0017'38" from the easterly corner of said Lot 5. The side lines of
the described strip to be lengthened or shortened to terminate in the
side lines of said Lots 3, 5 and 6. (See Attached Sketch)
Said heretofore mentioned Grantee, its successors or assigns, shall
have the right, without prior notice or proceeding at law, at such times as may
be necessary to enter upon said above described property for the purpose of
constructing, maintaining, repairing, altering or reconstructing said sewer or
making connections therewith, without incurring any legal obligations or
liability therefore, provided, that such construction, maintaining, repairing,
altering or reconstruction of said sewer shall be accomplished in such a manner
that the private improvements existing in the rights)-of-way shall not be
disturbed or damaged, the) will be replaced in as qood a condition as they were
immediately before the property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the aforedescribed premises,
including the right to retain the right to use the surface of said right-of-
way if such use does not interfere with installation and maintenance of the
} sewer. However, the Grantor shall not erect buildings or structures over,
under or across the right-of-way during the existence of such sewer.
This eastaent shall be a covenant running with the land and shall
be binding on the Grantor, his successors, heirs and assigns. Grantors covenant
that they are the lawful owners of the above properties and that they have a
► good and lawful right to execute this agreement.

SEWER DISTRICT
I have reviewed the letter from Ethel Hanis , General
Manage: of the Cascade Sewer District . She is
concerned about a house foundation that was recently
constructed over their 24-inch sewer line which extends t
through a portion of Tiffany Park and joins the Metro
trunk line . Their line is within an easement; and
as she has pointed out , their position is that the'
foundation must be moved off of the main and easement .
The Building Division has contacted the builder and
instructed him to remove that portion of the
foundation extending over the sewer line . The builder
should have been aware of the easement , as it was
shown on the plat and appropriately staked out in
the field.

On u;me 29, 1976, H & B Cement Finishing, City of Renton and myself inspected
the existing curb at Tiffany Park South for purposes of identifying those
portions which would have to be removed and replaced due to past failures.
These have been marked and recorded. It will be your r .ponsibility to protect
any other curb and sidewalK remaining when you are purchasing lots and
building. Any other curb or sidewalk to be removed for driveways or failures
will be done at your own expense.
I also would liketo remind you that it is important not to do any damage to
the road subgrade or sidewalk. Heavy equipment must be kept off this area to
allow us to complete the work on a timely basis and to reduce damage to that
we may receive final inspecti n from the City of Penton.

Enclosed please find a revised print of sanitary sewer plans and profiles
for block 4 Tiffany Park No. 2 for your review and comment.
As the plans show we have decided to abandon the existing 8" line and
manhole (No. 10 per print) and run a new 8" 1 , from manhole No. 11 to
the existing manhole in Kirkland Avenue S.E. With this new plan we will
