Mr. Uhlman advised that case law previously discussed will be transmitted to the Examiner
by April 16. 1982. Since there were no further comments, the hearing regarding File Mo.
ECF-114-81 was closed by the FAMlner at 10:35 a.m.
FINDINGS, CONC. SIGNS 6 DECISION: Moving reviewed the record in this matter, the Examiner

FINDINGS:
Tht appellant, Wilgeo Company, filed an opplicati on for a building permit to construct
a shopping center complex. The application was accompanied by the required
environmental 0ecklist. The checkiist review the various Impacts which a proposal
may have on the e..vironment. The Environmental Ilevlew Committe* (ERC), after review
of the checklist, issued a d*0 aration of non-significance for the subject proposal
subject to certain conditions. 1"hose conditions were challenged by the appellant and
that challenge resulted In the instant appeal.
2. The subject property is located west of the Intersection of Garden Avenue N. and
Bronson Way N.
J. The ERC imposed the following conditions or. Its DNS: "1) Bonding ,for improvement. -
Bonding for signal and other Improvements It Gorden Avenue and Bronson Way art-to be
held for no longer than one year fro, date of full occupancy. Evaluation of
conditions are the sole responsibility of Director of Public Works; 2) Sanitary
sewer - Replacemei.t of sanitary sower line unning along the alley w,st of the subject
budding between tronson Way North and North 2nd Street."
4, The appellants indicated willingness to participate In the cost of providing a non.
sanitary sewer in the alley west of Garden, but object to bearing the full cost of
replacing • %e existing sewer.
S The current sewer was Installed In Its cur-ent alley augment approximately 50 yews
ago. The six Inch line was Installed in 1310. The joints were sealed with a hemp/ter
compound. The joints arm failing, resulting in both leakage and Infiltration by store
water. The leakage has resulted from differential settlement of the ground. Gravel
has also Infiltrated the line and settled In the 24-Inch trunk 11".
6. The stWf.s proposed for the complex will not be hoe" Nears of water or the Bawer
system. While the appellant has no plans to Install a restaurant at the current
juncture, nothing would provent such Installation In the future Res:auranrs do
wake heavy demand on sewer systema.
7. A number of %sparer* owneirships share the block on which the subject site is located.
The Fort* Rentals shop and associated properties are located west of the a.lsy. Other
commercial uses are located further north along the west side of the alley I.ciuding
a orofesslonal clinic which houses a lintel office Three single family �—, % are

Broosoi Way/Garden Avenue Intersection, a altos] would be warranted If traffic on
the Bronson Ip were 900 or more mod traffic on the Gordon Ip were 100 or more.
The existing volume on Bronson Is 920 durin0 the critical hour with a volume of
968 expected with t: subject proposal. The Gorden traffflc Is currently 72, with
the subject proposal expected to generate an additional 22 trips during the critical
I hour. The critical hours are determined In ucending order with the minimum 8th
highest hour being the bese hour.
It. The subject proposal will generate approvlamtely 3,S00 vehicle trips per dal and
will contribute additional traffic to the Carden/Bronson intersection. Some traffic
i will be making right turns onto Bronson Avenue after exiting either of the subject site's
driveways on Bronson or Garden. Others exiting the subject site will be making the
left turn elthe, from Garden Avenw onto Bronson or directly from the Bronson driveway.
The left turn across Bronson Way Is herder to accomplish and the level of service
(LOS) for the turn from Garden to Bronson is now L05 E/F.
12. If no rectification of the ra"dway occurs, that is no traffic signal or channelizatio.
prohibiting left turns is installed, the left turn maneuvers will become more
difficult as traffic increa-,es.
The roil owing information refers only to the PM peak hour traffic. The project will
generate an additional 20 left turns from Garden to Bronson or an increase of about
26%. approximately ten left turns will occur from the subject site's Bronson drive,
an increase of over 300% over the current three left turi.s from that drive.
13. There are otner users of the intersection, w!th traffic f-� both Boeing and PACCAR
adding significant traffic to the system at this Intersection. These are other
background users.
CONCLUSIONS:
1. The person or entity challenging administrative actions or decisions has the burden
of demonstrating that the action complained of were Improper. The decision of the
governmental agency acting as the responsible official Is entitled to "substantial
weight" (RCM 43.21C.090) Therefore, the decision of the Envlronmantal Review
Committee, the city's responsible offici O. is entitled to suh,tantial weight.
The meaning of substantial woloht has been further defined by the Washingtnn Ceurr,.
One appealing a derision of the responslble official must show that the decision is
arbitrary and capricious (Short v Claliam Cowry, .: Win. Asp. 825 82q, 1g79).
That is, whether it is "wi llfut and unreasoning actic.i in dlaregaro of facts and
circum.tences" (Stempel v Department of Water Resources, 82 Wn.2d 109, 1)6, 1973).

This project I•s of considerable concern because the Water/Sewer
Utility is Paying S15.000 or about 3/4 of the project cost.
