The claim was for nearly $30,000.00 plug attorney's fees. This reeao is a res It or a phone conversation between Mr. Suzuki and Rave. Since Mr. Suzuki failed to provide a formal written claim outlining the damages incurred together with the facts associated with the claim and his Justification for said claim, no determination of justification could be mode. You have experienced the ambiquity of Mr. Suzuki's claims at our first hearing and, therefore, know why it is essential that a claim be provided in writing. Even though we may no_ be successful , we should try to get it across that just because Mr. Suzuki whines about something that gives him c problem, that is not grounds for a claim in arbitration unless formally submitted and rejected per the contract ranuirements. The items probably would not have been allowed had he been represented by an attorney and now that he is, they should be thrown out. If that does not work, it may not hurt the overall cause to hammer on the substantial errors in his claim as well as his administration errors in filing the claim. Sewer Claim for Extra Compensation for Dewatering As discussed on 3/11/86. an offer of $2500 was made to Mr. Suzuki of Shoreline Construction, to settle his claim for extra compensation as a result of ground water encountered on the project. On 3/17/86 he advised that this offer was unacceptable; but felt $7000 was a more reasonable figure which would be acceptable to him to settle all claims. If that number was not acceptable to us or we felt we could not come to terms, he would like to proceed with the arbitration process. Mr. Suzuki was advised that we would probably counter-claim for the cost of the damage to the Pump Station electrical system (approxi- mately $3100), if we went to arbitration. If it is your recommendation that we proceed with arbitration, Mr. Suzuki has indicated that he would be receptive to having a single arbiter hear the dispute rather than the normal three arbiters. SEWER EXTENTION CAG-077-85 Narrative of cvents leading to damage on December 23, 1985: 1. Initial location for project by One Call" locatinq service was preformed on or about November 7, 1985. In telephone conversation with Ted Seaborn, Locating Inc., Puget Power's subcontractor for utilities locations, on January 28, 1986, I received the foilowinq informrtion: The location company lnq for the initial locate on November 1, 1985, states a secondary d"p was located, but was noted (??ours??). Mr, Seaborn also said this servir was marked again for the City when ioinq water service transfer but could not find that record at the time of our conversation. 2. On the day o° the incident, the contractor forman, Juan Bergrud, asked the City's inspector, Abdoul Gafour, about the location of the electrical service as shown on the project plan at centerline Station 21f90f, but he could find no markina on the ground at this time. Apparently the original markings done by Mr. Seaborn had been obliterated by weather or the construction operations in the intervening six weeks, and the contractor had made no effort to preserve or record them. The City's inspector informed the contractor excavator operator that the crossinq was as shown on the plans directl, across from the power pole with the service transformer which was located across Duvall Avenue N.E. from the excavations and that he would call "One Call" and ask for an immediate relocate. Mr. Seaborn informed me that he did not receive the request that morning but that he drove by and saw the telephone company locator, who had radio communicatior, locatinq and that he then stopped and spoke with the fomnan, Mr. Bergrud, and informed him that the service was private and he could not locate it aqain but that it was directly across from the pole. The City's locator, Rick Kokko, arrived and attempted to locate the service working back from the meter head but lost the signal 50 feet from the meter and before the cross',.,.
