Warren, City Attorney RE: Sambo's Utility Easement Dear Del: The documents forwarded to me included a utility easement and a temporary construction easement. The temporary construction easement as tendered was not signed but I will presume that a signed original exists. That document is approved as to legal form. With respect to the utility easement agreement itself, I have some problems with the next to last paragraph. The next to last line starts out "or, if Grantor : lessee, upon the expiration of the subject lease, . . ." language is stating a condition upon which the easement shall terminate. I do not i think it appropriate for us to have that language in the agreement. The City needs a permanent easement and if Sambo's Restaurant, Inc. is only a leasing party, then qe should get a permanent easement from the owner of the property. _ Lawrence J. Upon the installation of said sanitary sewer line the Grantor herein, its successors and assigns, will retain the right to use he surface of said easement in all areas thereuC. Said surface rights shall include, but not be limited to, landscaping, paving, ' parking, driveways, recreation areas and other uses and improvements, but shall not include the establishment of permanent buildings. Grantee shall, upon giving reasonable notice to Grantor, have the right to reasonable enter upon said easement for inspection, maintenance and repair, but shall be fully responsible to Grantor, its successors and assigns, to fully and promptly restore, at Grantee's sole expense, the land and all improvements and landscaping + therein ,end thereon to their condition immediately prior to each respective entrance. The temporary construction easement as tendered was not signed but I will presume that a signed original exists. That document is approved as to legal form. With respect to the utility easement agreement itself, I have some problems with the next to last paragraph. The next to last line starts out "or, if Grantor is a lessee, upon the expiration of the subject lease, . . ." The language is stating a condition upon which the easement shall terminate. I do not think it appropriate for us to have that language in the agreement. The City needs a permanent easement and if Sambo's Restaurant, Inc. is only a Leming party, then we should get a permanent easement from the owner of the property. Lawrence J.
