Today i looked at the sidewalk in front of the above residence, and while there are several cracks, there has been no subsidence of more than 1;4" and that is an expansion joint. The parking strip is nicely graded and a sidewalk section at the house entrance between the curb and sidewalk, is brand new. Elsner Shaver assures r,: toat the parking strip was raked, seeded, and watered before Utelcon left. With the extreinely dry fall, it tine property owner did not water it, there was little chance for the grass 'o survive. Our records show that Utelcon's insurance adjuster was on the site, within five days of the watermain break (4-9-87), talking with the affected residents, myself and Inspe-tor Abdoul 0afour. The largest damage was to Mary Ryan Realty, who subsequently filed a damage claim with the City Clerk in July, and correspnndence fl om Larry Warren indicates the claih .ia5 settled in December. I have no oti,er claims from other residents or knowledge of whether or not they received any compensation from Otelcon. I question the need for any remedial action to the sidewalk and parking strip, but if any is decided upon, there is no public safety reason that cannot wait until Phase lI begins in April. The City also had a claim against Utelcon for certain emergency work that it did to limit Mary Ryan's damages. Apparently the City has been paid the amount that was owed to it and Tel Rennatt has iyned a release on behalf rf the City- Mrry Ryan has also been said and signed a release. Therefore, this is one item in the Utelcon file that we no longer hare to w-rry about. By the wsv, the insurance carrier paid the entire amount of the claim despite the fact that Utelcon had a deductible amount i, its coverage. Now that Utelcon has declared 'bankruptcy, insurer is ;uat out that extra mch:y- It looks like they li � completely discharged their resnonsibility, under the insuran-,: contract. Consolidated supplied materials to Utelcon for its use in supplying materials incident to two construction contracts it entered into, one with the Woodinville Water District ("WWD•') in Xing County, Washington., and one with the City of Edmonds ("E.dmondG") in Snohomish County, Washington. B. A dispute has arisen between the parties hereto, Edr.,onds, and the consulting Pngin,.,rs to Edmonds relating to certain composite pila supplied for the Edmonds project. A lawsuit involv•ng that dispute is currently underway in Snohomish County Superior Court under cause number 86-2-05084-0. There is no dispute regarding any of the materials Supplied to Utelcon on the WDD project, for which Consolidated is owed the principal amount Of $41,127.19. Credit General has issued pub.'.ic works payment and performance bonds with Utelcon as principal on both the subject projects. Its bond on the Edmond_ project is number SU 0010911. Its bond on the WDD project is SU 0011149. I. Thr parties hereto wish limit the irsues and the scope of the conflict and to achieve the closing of the WDD project and the dismissal of the lawsuit on that project. F. The WDD is holding the amount of $18,214.61 as retainage on the base contract. In addition., it is holdir. . approximately $9,000.00 for payment for change order work which has r.ot been completed. There is some minor punchlist work to be performed on the project before the WDD will close out the contract. WDD has already given notice to Utelcon to complete the work or it will default Utelcon under said contract and take ocher steps to complete the work under the cortract. G. Credit General is holding funds somewhat in excess Of $29,000.00 which it nas obtained primariky from the Edmonds project and from Utelcon directly. N. Subject to approval of the Bankruptcy court, Utelcon and Credit General will promptly cause the amount of money Credit General is holding to be paid to Consolidated. Credit General will contemporaneously pay to Consolidated the additional amount necessary to tring ti,e total paid to Consolidated to $41,127.19.
