SUBJECT: Claim for Damages CL 52-88, Lola 4utchinson
This claim dates back to 1987 and is the same matter as the Mary Patricia Ryan
claim (CL 26 87 see attached) . Under the second phase of the Shattuck Ave.
Sewer project, I had the contractor replace the piece of sidewalk that was
cracked in front of the house, but still serviceable. No other work has been
done since Utelcon left on the first phase. Why the bark etc. was not settled
with a'l the other Utelcon claims, I do not know, unless a claim was not filed
at the tluiu.

Dear Ms. Cross:
The Beeson Company has indicated that yout Company is handling
the claim of Mary Patricia Ryan. Utelcon, Inc. has apparently
quit doing business and does not respond to mail or telephone
contacts. One of the items outstanding from their contract is
the Mary Patricia Ryan claim. The claim is causing the City of.
Renton considerable concern for fear that it is not being handled
in an expeditious fashion. Could you please provide me with an
up to date report on this claim. I would particularly like to
knuw why the claim has not been settled as it is now nearly six
months old.

RE: Utelcon - Mary Ryan Claim
Dear Dick:
I recently received a telephone ca21 from Mr . Rob Novask! of
Campbell- Husted regarding the Mary Ryan claim against Utelcon.
The City also had a claim against Utelcon for certain emergency
work that it did to limit Mary Ryan' s damages. Apparently the
City has been paid the amount that was owed to it and Ted Bennett
has signed a release on behalf of the City. Mary Ryan has also
been oaid and signed a release. Therefore, this is cne item in
the Utelcon file that we no .longer have to worry about.
By the way , the insurance carrier paid the entire amount of the
claim despite the fact that Utelcon had a deductible amount in
its coverage. Now that Utelcon has declared bankruptcy , the
insurer is just out that extra money. It looks like they have
completely discharged their responsibility under the insurance
contract.
I have not heard anything from the bonding company for Utelcon
following my recent letter to them. If you hear anything, please
let me know.

2. Clean concrete from new manhole rungs.
3. Complete installation of yellow and white traffic buttons at 4th

It states that at Boring B-1, the ground water level is approximately
9 feet below the ground surface. To verify this I have made two
test hcles at the site, 12-� feet below existing street elevations
( the new pipe invert is 82 feet below ) .
I have determined that there is insufficient water seepage to
merit a complete dewatering system and therefore request that the
City waive the last paragraph - Section 7-17.3 (1 ) A of the Special
Provisions.
If this is granted, I am confident all remaining specifications
can be adhered to within our bid price and request that the Contract
be awarded to us.

In response to your letter of March 8, 1988 requesting we waive the last
paragraph of Section 7-17.3(1)A, we cannot waive any provisions of the
contract and this section must stand. However, the recommendation of the
soils report suggest that the water table be lowered to two feet below the
proposed grade, and from the test holes dug -n March 7, 1988, it appears that
this requirement is met. As long as the water table remains at this level
there is no need to install any further dewatering equipment. If this
condition changes along the route of the project, then the requirements for
dewatering will remain.

Mr. Charles Jones was here yesterday asking for help in sorting
out some problems at the above address. It is his mother-in-
law's residence - she is 73 years old.
Apart from landscaping erosion caused by a atermain break during
Utelcon's construction activity, he clA �:
ims that the sidewalk in
front of the property has been cracked because of the
contractor's activities, resulting in a danr;srous condition for
pedestrians - especially older persons. (Curbing was also
damaged but that is not the responsibility of the abutting
property owner. )
The landscaping problen (bark, grass, etc. ) was the subject of an
insurance claim against the contractor's insurance. Nothing has
happened ref. the claim.
The sidewalk damage is something we should review immediately.
If we don't have "construction" photographs, we need to take some
now. If the condition is not too dangerous, it presumably could
be added to the Phase 2 contract, but only if there is a
reasonable certainty ref, the schedule for the repair work being
soon.
Mr. Jones made reference to a half-hearted attempt to fix a
"grass strip" aret (in the sidewalk?) consisting )f someone
scattering some grass seed which never did germinate.
Please check this situation and t me know what conditions
really exist ref. the sidewalk, cu___ng and landscaping. I would
like to give Mr. Jones a response as sc-, : as possible.

MEMORANDUM

SUBJECT: 632 Shattuck Avenue S.
Today I looked at the sidewalk in front of the above residence, and while
there are several cracks, there has been no subsidence of more than 1/4"
and that is an expansion joint. The parking strip is nicely graded and a
>idewalk section at the hoise entrance between the curb and sidewalk, is
brand new. Elmer Shaver assures me that the parking strip wa- raked,
seeded, and watered before Utelcon left. With the extremely dry fall , if
the property owner did not water it, there was little chance for the grass
to survive.
Our records show that Utelcon' s insurance adjuster was on the site, within
five days of the watermain break (4-9-87), talking with the affected
residents, myself and Inspectcr Abdoul Gafour. The largest damage was to
Mary Ryan Realty, who subsequently filed a damage claim with the City
Clerk in July, and correspondence from Lar—y Warren indicates the claim
was settled in December. I have no other claims from other residents cr
knuwledge of whether or not they received any compensation from Utelcon.
I question the need for any remedial action to the sidewalk and parking
strip, but if any is decided upon, there is no public safety reason that
cannot wait until Phase TI begins in April .
We have photos and video tapes of the 632 property before and during the
flood, and will have "now" photos developed by 2-19-88.

which Utelcon, Inc. is the insured. The City of Renton is the
certificate holder . The description of operations includes a
contract with Shattuck Avenue S. sewer main, Schedule A, PVC
alternate only . Utelcon, Inc. , durinq the performance of its
tasks caused damage to the property of onr, Mary Patricia Rvan,
located at 645 Shattuck Avenue S. , Renton. This has resulted in
a claim for damages being filed against the City in the amount
of $4, 940.06 for damage done April 9, 1987.

Alexander Howden Insurance Services, Inc. , servi ing agent for Lloyes of
London. Ms. Ryan advised our office on July 8, 1987 that she had been con-
tacted but an insurance adjuster on behalf of Utelcon but that she "wanted
to get some action". For a current status on this matter I would suggest

The Beeson Company has indicated that your Company is handling
the claim of Mary Patricia Ryan. Utelcon, Inc. has apparently
quit doing business and does not respond to mail or telephone
contacts. One of the items outstanding from their contract is
the Mary Patricia Rvan claim. The claim is causing the City of
Renton considerable concern for fear that it is not being handled
in an expeditious fashion. Could you please provide me with an
up to date report on this claim. I would particular'.y like to
know why the claim has not been settled as it is now nearly six
months old.

I recently received a telephone call from Mr . Rob Ncvasky of
Campbell- Husted regarding the Mary Ryan claim against Utelcon.
The City also had a claim against Utelcon Eor certain emergency
work that it did to lip„' � Mary Ryan' s damages. Apparently the
City has been paid the amount that was owed to it and Te8 Sennett
has sigred a release on behalf of the City. Mery Ryan has also
beer. paid and signed a release. Therefore, this is one item in
the Utelcon file that we no .longer have to worry about.
By the way , the insurance carrier paid the entire amount of the
-iim despite the fact that Utelcon had a deductible amount in
s coverage. Now that Utelcon has declared bankruptcy , the
insurer is just out that extra money. It looks like they have
completely discharged their responsibility under the insurance
contract.
I have not heard anythirg from the bonding company for Utelcon
following my recent letter to them. If you hear anything, please
let me know.

Sealed bids will be received until 2:30 p.m. , Wed. March 2, 1988 at the City
Clerk's office and will be opened and publicly read at 2:30 p.m. ,in the 4th
floor cinference room, Renton Municipal Building, 200 Mill Ave. South.
The work to be performed within 40 working days fro,.; the date of
commencement under this contract sh-aTT include, but not be limited to:
Excavation, backfill and compaction, and installation and testing of an 18"
sanitar;, sewer in Shattuck Avenue South from Houser Way South to South 4th
Street.
The City reserves the right to reject any and/or all bids and to waive any
and/or all informalities.
Approved plans and specifications and form of contract documents may be
obtained at the Public Works Department - ce at the Renton Municipal Building
for a deposit of $25.00 each srt plus $ 5.00 to cover postage, if mailed.

SCOPE OF WORK
The work involved under the terms of th?s contract document shall be full and
ccmplete installation of the utilities as shown on the Plans and in the
Specifications; to include, but not be limited to; excavation, backfill and
compaction, installation and testing of approximately 700 lineal feet of 18-
inch diameter sewer main in Shattuck Avenue South between South 4th Street
and Houser Way South. The work shall include al' mani�oles, tees, side
sewers, connection to existing sewers, the removal and salvage of the
existing manholes, and the complete restoration of all surfaces and existing
underground utilities.
All contractors participating in the work on this project shall comply with

major construction within the Shattuck Avenue right-of-way in
front of our building . The extent of that construction is
unknown to me. However, it is my understanding that it may
involve substantial excavation and dewatering .
I am concerned about the effects dewatering may have upon

substantial construction will have on our landscaping facing
