I feel if you have a contractor you know is not working to the apace, they should be told to comply, or discontinue working until they can do no. If you had a contractor digging a trench and back filling it without thu pipe and this was brought to your atton:ion, would you permit him to continue until you could get around to investigating the problem? One of the problems the city has is a lock of inspectors. Evan after you have boon tcld there is a problem with tho inspection, the contractor i is permitted to be out of compliance with the npocs. Considering CCLCO promoted the useago of CR250 in the first place as the L only good grout, they should be the last not to meet the CR250 specs, I do not sin why all other contractors need to be put on hold for the 1908 work while GCLCO is continuing to gat away with this. Without even thinking j about it, we used the 3rout which we thought you would want. As a practical matter, it is most difficult for an obser- ver to discover the difference between the CR-250 grout and the acrylamide grout. Within the mixing and pumping system on board the grouting truck, there is no way to observe the grout itself. The systems are completely closed. Of course the end product is down inside of a small diameter sewer pipe so even there it can not be seen. With this in mind it is easy to appreciate that even your own field inspectors did not detect the idifference and bring it to our attention. Again, from a practical standpoint, this error on Celco's part fortunately resulted in no detriment to the City of Renton. I feel convinced that you have received no less of a product, and arguably you have received a better product. I would 'like to address the question of cost directly. The acrylamide grout does cost less, liowever, the acrylamide grouts penetrate deeper into the joints and surrounding soils, so, therefore, we use more of it on a per joint basis because it penetrates deeper. The net result is that although the unit price of this grout is somewhat less than the specified grout, since •a more grout was used, the costs "wash" to even. In, in your mind, it is necessary to get affidavits from technical people substantiating that the City of Renton got the proper value for its dollar I would be happy to so oblige. At the least, the City of Renton got precisely what the contract intended - the sewer joints j were regrouted. The only difference remains is who made 1I the grout. 1 With our credentials and history in this business and industry we feel that you can rely on our expertise as we represent to you that the acrylamide grout which you inadvertently received is indeed better for the City than the specified CR-250. Notwithstanding the above, we also realize that there is no excuse for inadvertently not following contract procedures. i I have checked with our counsel, and our counsel informs i us that the first and foremost question to be asked is whether or not the City of Renton got what it paid for, -i and also got what it bargained for. As a practical matter, it is most ditficult for an obser- ver to discover the difference betweea the CR-250 grout and the acrylamide grout. Within the mixing and pumping system on board the grouting truck, there iR no way to observe the grout itself. The systems are completely closed. Of course the end product is down inside of a small diameter sewer pipe so even there it can not be seen. With this in mind it is easy to appreciate that even your own field inspectors did not detect the difference and bring it to our attention. Again, from a practical standpoint, this error on Ccico's part fortunately resulted in no detriment to the City of Renton. I feel convinced that you have received no less of a product, and arguably you have received a better product. I would like to address the question of cost directly. The acrylamide grout does cost less. However, the acrylamide grouts penetrate deeper into the joints and surrounding soils, so, therefore, we use more of it on a per joint basis because it penetrates deeper. The net result is that although the unit price of this grout is somewhat less than the specified grout, since more grout was used, the costs 'wash' to even. In, in your mind, it is necessary to get affidavits from technical people substantiating that the City of Renton got the proper value for its dollar, I would be happy to to oblige. At the least, the City of Renton got precisely what the contract intended - the sewer joints were regrouted. The only difference remains is who made the grout. With our credentials and history in this business and industry we feel that you can rely on our expertise as we represent to you that the acrylamide grout which you inadvertently received is indeed better for the City than the specified CR-250. Notwithstanding the above, we also realize that there is no excuse for inadvertently not following contract procedures. I have checked with our counsel, and our counsel informs us that the first and foremost question to be asked is whether or not the City of Renton got what it paid for, and also got what it bargained for. I have no way of measuring whether or not that figure is a reasonable figure. For i example, what is the difference in the bid prices for using the non-approved grout and approved grout? You have told me that the i approved grout was more expensive and difficult to use than the non-approved grout. Also, is it more likely that we will have to replace the work done with the non-approved grout earlier than we would if the approved grout had been used? You will also find enclosed a copy of a letter from J.C. Enterprises, Inc. together with spreadsheets that they have prepared attempting to show to the Mayor that there has been a serious cost overrun in the 1987 contract. The spreadsheets would ostensibly show that the city obtained less than the work - originally bid for an amount substantially in excess of the amount bid. Somehow I feel that these figures are incorrect, but I would like your department to review them and respond to me. For example, I note that there was no work done on Schedule C according to these spreadsheets, but if those figures were included in the total amount of the contract, there would be a substantially reduced discrepancy. Quantities are under estimated In Schedule A for number of joints - Item a3 and aa. The quantity estimated In my Spec,$ for 03 and as are a3 - 2,000 each Sanitary Sewer Joint Test and 04 - 400 each Sanitary Serer Joint Seal. I The 2,000 Joints should be increased to about 5,000 each, because most of the I pipe In the old Earlington is old clay or concrete pipe with 3_1/2' long lengths. 17,600 divioed by 3.5 . 5,000 joints, not 7,000 as described by Shoreline Construction, The number of Joints that will require grouting and sealing is more of a {� guess. In Glenco we grouted only about 2% Of the Joints. Jerry Curry ran a sewer TV thru one of the pipe runs prior to the bid and his estimate for this f Pipe run is 80% failure rate. At Ills rate estimated, the number of Joints to be sealed would be 5,000 • .8 . A,000. -- Issue A. Conclusion . There is a aide range of estimates of the amount of work to be done on sanitary sewer repair. Because of this, 1 have used In all our bids, consistent with 9ther agencies (North Bend, South Benl, Issaquah, Metro, Seattle), unit prices for these items of work. IF both Geleo's and Shoreline's bid prices are extended out using the larger quantities, Gelco is still the lowest bidder. Dick Houghton may 1, 1987 Page 2 Issue B. I do recall the phone conversation with Jerry Curry when he asked how I would take in account t' •s larger quantities estimated. Jerry feels that the quantities being unJer estimated would allow S7neone to "off load" their bids and later receive a windfall of profits. j I have attached an alternate bid tabulation using Jerry Curry's estimates. Delco Is still the law bidder and Shoreline Is •2. i Jerry Curry, In the same conversation, asked how would the City handle Increases in the nuebot of Joints, footage, etc., with a low bidder. I said the unit prices were used for Just that purpose se the contractor would be fairly compensated for their work. This was the specific reason why we didn't use a IumP sum type contract. The Standard Specification text on the estimate quantity Is attached, (Section Jerry Curry asked how the quantity would perhaps change and if prices would change. I said the Standard Specification provide for any change In quantities over 25% of the estimate, trigger the process whereby the City and the contractor may re-negotiate the Cost of the work.
