This detail included 3" Class "B" A.C. fur patching. As this item is not in our proposal, Ring Construction Co. is requesting a Change Order to provide compensation for this extra work. N.A. Suyale Inc. installed 17 tons of Class B Patch as directed. Their billing for this extra work amounts to $935.00. Also, Cascaded Sawing and Drilling saw cut 384' as directed. Their billing amounts to $297.50. For this extra work King Construction Co. is requesting payment in the amount of $1,417.38, which includes our mark-up. I have reviewed the claim by Patricia A. Houlbjerg, for damages, I have, also, studied the project site within the immroia' ! vicinity of Ms. Houitjery's residence. Her home is located on the north side of N.E. 7th Street. As you will recall, this was the side of the street reserved for resident's travel use. King Construction did no' install side sever crossings, on this side, until the sewer main was complete and all ea.-.terly connections were installed. Duruing the time frame, of Ms. Houlbjery's claim, King Construction maintained a usuable, lust controlled lane for traffic. ,owever, the City of Renton Water Department was working on this side of the road, Mkiny cuts through the pavement, to install the nw water service lines. Native backfill was used vithout cold mix. The Water Department neither properly cleaned their work sites nor maintained dust controll. King Construction cannot accept respu sltility for this claim as the work was not under our control. We did not assumeresponsibility for those patches until the Change Order, to compact and patch the water service excavations, was signed on Oct.aber 17, 1988. Please send me a your proposed time table as to when this work is to be preformed, and your preferred method of lawn restoration, sod, or seeding. Inc. 13313 1/2 8th St East Sumner, Wa. 98390 Subject: Renton Sewer Project S-448 Dear Brad: In regards to your letter of November 14, 1988, and the M. A. Segale letter of November 10, 1988, there appears to be a misconception of the specification which was changed. The specification change was the contract Special Provisions section, WFATMER AND MOISTURE IIMtfATIONS which required air and ground temperature of 60 degrees F. minimum for the placement of the 1 fabric. The Asphalt Institute told me that the fabric could be suc:essfully placed in any conditions that the asphalt could be placed. The st_-Aard specifications state that a 0.10 to 0.20 foot compacted thickness surface course may be placed to 45 degrees F. If the compacted thickness is increased to 0.21 to 0.30 Foot, the surface course may be placed at 35 degrees F. This paving should be done now if a dry day occurs. I have reviewed King Construction's comments and I would add the following additional facts: 1. The dust problem was mainly caused by the patches done by Renton Water Dept. 2. However, the tr,.cking of the dust was mainly created by the traffic of the contractor's equipment (dump trucks, backhoes, loaders,...etc.). Local traffic was minimal. I have often advised the contractor's drivers to slow down within the work area due to exressive dust. I recommend t.ha, we split the claim two-ways between the City and King Construction. I would assume she did not understand the conversation or had her facts otherwise incorrect, but I would remind you that Section 1-07.16 of the Supplemental Specifications and Section 1-07.16 and 7-17.3(2)H of the Special Provisions, are quit specific that all areas of landscape, either lawn or other plantings are to be restored to their original or better condition, and that this work is incidental to the other items of work. Please send me a your proposed time table as to when this work is to be preformed, and your preferred method of lawn restoratior , sad, or seeding. If seeding is your choice, please carefully review Sections 8-01 and 8-02 of the Standard Specifications for the requirements for planting, care and maintenance. Segale letter of November 10, 1988, there appears to be a misconception of the specification which was changed. The specification change was the contract Special Provisions section, WEATHER AND MOISTURE LIMITATIONS which required air and ground temperature of 60 degrees F. mtnimum for the placement of the fabric. The Asphalt Institute told me that the fabric could be successfully plated in any conditions that the asphalt could be placed. The standard specifications state that a 0.10 to 0.20 foot compacted thickness surface course may be placed to 45 degrees F. If the compacted thickness is increased to 0.21 to 0.30 Foot, the surface course may be placed at 35 degrees F. This paving should be done now if a dry day occurs. Dust has been a problem thru the entire project. The contractor has been instructed by the project Inspector to devote more effort to his dust control program. I do not believe there is any way short of closing the street to all traffic, or cold mixing all trench work, that the dust problem could be totally eliminated. The problem is made worse by the City Water Crews replacing old water services. The contractor can claim the problem is caused by the Water trenches and not his sewer trench, j and vica-versa.
