Dear Dave:
I reviewed Chapter 5, entitled Latecomer's Agreement, of Title IX T)
(Public ways) of the city code, the code section on latecomer's
agreements. The code does not clearly answer the question about j
the council's discretion in establishing final costs that exceed #
I the initial preliminary cost. t
The code establishes an initial appeal to the council within .t
twenty days of notice of the city's intention to establish a Tkk
latecomer's agreement. The intent of this section is to give all
parties an opportunity to know whether or not a latecomer's
agreement, and its assessments, will be established. A later
appeal is not called for by tae city code, but any party can
address the council about any topic it wishes, and so there is .,
still an avenue open to protest later increased assessments.
Code section 9-5-6 indicates that if the improvement and costa
thereof are consistent with the preliminary approval, the (city '.
council) shall grant the latecomer's agreement and authorize the
mayor and city clerk to sign the same. Although this section
i could be clearer, the intent is to give the council an additional
opportunity to pass upon the latecomer's agreement if the
assessments are not substantially the same as initially estimated
and accepted by the city. The city council would then determine
what was fair before authorizing the mayor and city clerk to sign
the agreement.

SUBJECT: Private Held Latecomers(Ord.4189)
During the 'preliminary approval' stage of the Kindle's sanitary sewer extension
latecomers request. the Utilities Committee posed two questions for which they
requested your consideration. Both questions deal with the final cost exceeding the
initial preliminary cost that was utilized for initial notification to the affected properties
and toil there was no protest of the original assessment.
The first question is whether or not either City Council or affected properties have the
right to open for appeal the final assessments. The second question is whether the
Council has the authority to determine an equitable assessment amount (i.e. use
preliminary costs in lieu of the higher final costs).
The construction this project has been completed and we are currently preparing
thn final latecomer 4ocuments. Prior to approaching the Utilities Committee with our
submittal, we will need your input on the above listed items.

The Utilities Committee concurs with the recommendation of the Public Works Department
and recommends Council .)prove the unitary sewer latecomer agreement and preliminary
assessment roll. We reco—mend preliminary approval be granted for a period of two (2)
years.
Per City of Renton Ordinance No. 4189, we recommend Council set the duration of the
agreement to be ten (10) years with the option to extend the agreement, for one time only, €
for a period of up to an additional five (5) years.
The Utilities Committee recommends Council authorize the City Clerk to notify the
property owner listed on the preliminary assessment roll by tegistered mail of their rights
and options to participate in the latecomer agreement.
The Utilities Committee recommends that if no protests are received, that Council authorize
the Public Works Department to accept submittal of the final cost, upon completion of the
sewer project, and prepare the final assessment roll.
The Utilities Committee recommends that the proponent be notified that if the final
assessment is greater than the preliminary assessment, Council has the discretionary power
to designate a second appeal period or to set an assessment they feel is appropriate.
Committee further recommends that if the proponent finds a ,auation where cost is more
than anticipated, the) either resubmit to Council a cost estimate for consideration prior to
continuation or proceed at their own risk.

The Cost Data information supplied by Mr. Houghton for this project is acceptable with
the following changes.
A) There will be two(2) manholes on the project,
B) The lamphole will not be used, being replaced by the second manhole (Item
A),
C) The six-inch pipe for side sewers should not be �ncluded in the assessment.
The net change is an additional S378.70 (including tax) for a new total of$11,557.02.
Staff does feel, however, that while this estimate is within an acceptable ran i r D range, it is m the
lower end of this range. We would hope that the developer will make every effort to
keep costs close to this estimate.
As for method of assessment we feel since none of the lots receive any more benefit than
the others, dividing the cost equally between the four lots is the most equitable.

The Utilities Committee concurs with the recommendation of the Plannutg/Building/Public Works
Department and recommends Council accept the final construction costs for the subject Kindle
sanitary sewer installation,though the costs exceed the preliminary costs,as fair and reasonable.
Per City of Renton Ordinance No. 4189, we recommend Council set the duration of the agreement j
to be ten(10)years with the option to extend the agreement,for one time only,for a period of up to
an additional five(5)years.
The Utilities Committee concurs with the recommendation of the Department, and recommends
Council accept that the final costs be distributed equally among the four (4) affected properties,
three(3)of which arc owned by the developer.
Upon payment of th- $200 latecomer processing fee, the Utilities Committee further recommends
Council authorize the Mayor and City Clerk to sign the agreement,and that the City Clerk secure the

RE: Private Held Latecomer's Agreement - Riadle -

I reviewed Chapter 5, entitled Latecomer's Agreement, of Title IX
(Public Ways) of the city code, the code section on latecomer's
agreements. The code does not clearly answer the question about
the council's discretion in establishing final costs that exceed
the initial preliminary cost.
1 The code establishes an initial appeal to the council within
twenty days of notice of the city's intention to establish a
latecomer's agreement. The intent of this section is to give all
parties an opportunity to know whether or not a latecomer's
agreement, and its assessments, will be established. A later
appeal is not called for by the city code, but any party can
address the council about any topic it wishes, and so there is
still an avenue open to protest later increased assessments.
Code section 9-5-6 indicates that if the improvement and costs
thereof are consistent with the preliminary approval, the (city
council) shall grant the latecomer's agreement and authorize the
mayor and city clerk to sign the same. Although this section
could be clearer, the intent is to give the council an additional
opportunity to pass upon the latecomer's agreement if the
assessments are not substantially the same as initially estimated
and accepted by the city. The city council would then determine
what was fair before authorizing the mayor and city clerk to sign
the agreement.

During the 'preliminary approval' stage of the Kindle's sanitary sewer extension
latecomers request, the Utilities Committee posed two questions for which they
requested your consideration. Both questions deal with the final cost exceeding the
initial preliminary cost that was utilized for initial notification to the affected properties
and that there was no protest of the original assessment. `
The first question is whether or not either City Council or affected properties have the
right to open for appeal the final assessments. The second question is whether the
Council has the authority to determire an equitable assessment amount (i.e. use
preliminary costs in lieu of the higher final costsl.
The construction of this project has been completed and we are currently preparing
the final latecomer documents. Prior to approaching the Utilities Committee with our
submittal, we will need your input on the above listed items. 1

ISSUE: Mt. Emmett Kindle has requested a latecomer agreement for
reimburser^ent toward the estimated cost of 263 L.F. of 8" PVC sanitary
sewer pipe proposed for installation to serve his property on Jones Avenue
NE, together with three(3) adjr<ent lots in the Kindle Short Plat.
BACKGROUND:
To meet the comprehensive plan and requirements of City codes, an 8" sanitary sewer main
is proposed for installation to serve the developer's p"�perty. The proposed installation will
benefit a total of four (4) parcels which include: Lot B Kindle Short Plat, owned by
others, Lots C and D of said short plat and an adjacent parcel, owned by the developer.
PROPOSED APPROACH:
The proposed approach is to establish a preliminary latecomer agreement in favor of Mr.
Kindle, following the procedures as mandated by Latecomer Ordinance No. 4189.

October 22, 1990 - Letter from Mr. Emmett Kindle, requesting latecomer reimbursement
for sanitary sewer improvements proposed for installation in easement to serve his property

October 31, 1990 - Letter to Mr. Kindle from Property Management staff acknowledging
his 10/22/90 letter of application, requesting additional information as required by the
Latecomer Ordinance. (Exhibit 11)
November 15, 1990 - Response to 10/31/90 letter from Mr. Richard Houghton, Engineer j
for Mr. Kindle. Required additional data provided. (Exhibit 111)
November 29, 1990 - Proposed Cost Estimate sent to Wastewater Section (Mike Benoit) for -
review and suggested method of assessment. (Exhibit IV) 1
December 5, 1990 - Response from Wastewater Section added one manhole to cost estimate I
and eliminated the inclusion of the cost of 15 L.F. of 6" PVr sewer pipe. The net change !
is an additional$379.70 (including tax) for a new estimated total of St 1.557,02. Wastewater ,
recommended dividing the estimated cost equally between the four benefriting lots, as the
most equitable method of assessment. (Exhibit V) 1
December 20, 1990 - Preliminary Assessment Roll prepared. (Exhibit VI)
January 9, 1991 - Sanitary Sewer Extension design plan 5-536 for subject project reviewed
and approvri for construction by the Wastewater Utility Section. (Exhibit VIU
February 7, 1991 - The City Attorney approved the Preliminary Assessment Roll as to legal 1
form, provided that the requirement for the sewer line was not triggered by the short Plat, 1
ie. required off-site improvement. (Exhibit VIIp I!I
February 18, 1991 - Attorney's question re: short plat provision, referred to Wastewater
Section.
February 25, 1991 - Response from Wastewater Section slates that the triggering of off-site
improvements as defined in the City of Renton subdivision ordinance would not apply, 1
because Kindle's short plat was an existing short plat and not a proposed short plat.

In addition, it is Larry's opinion that since the sewer extension was initiated by the
Kindles, the restrictive covenant regarding City initiated or LID instituted improvements
would not apply to the lots affected by the proposed latecomers.

Therefore, it is the recommendation of the Wastewater Utility Section to proceed with the
Kindle latecomer as proposed. (Exhibit IX) j

MISCELLANEOUS INFORMATION:
Parcel C and D, Emmett Kindle Short Plat, are undeveloped. Parcel B of the Short Plat
(aka Parcel wl on Assessment Roll), owned by Glenn Gordon and the adjacent parcel on
the north owned by the developer, are improved. t

The zoning for all four parcels is R-I, Residential, single family (7,200 square feet), F
ACTION PLAN:
The Public Works Department asks the Utilities Committee to consider our staff
recommendation regarding the proposed Kindle latecomer.
If the Utilities Committee concurs with our staff recommendation, Committee can
recommend Council concurrence and request the preliminary roll be forwarded to the City
Clerk, for notification purposes.
If protest is received within 20 days of notification, the Council may hold a public hearing
and establish a record or delegate to the Hearing Examiner for recr.,,mended action to the
Council.
Following the results of the public hearing and the expiration of the 14 day request for
reconsideration period, the Public Works Department will take one of the following courses
of action. When we concur with the Hearing Examiner's recommendations, staff will
prepare an Agenda Bill for the consent agenda. When we disagree or take exception to the
Hearing Examiner's recommendation, staff will prepare an Agenda Bill requesting referral
to Committee. Notification will be provided to appellant and developer of
recommendation/action M appropriate.
If no protests are received, we await completion of the improvement and submittal of final i
costs for preparation of the final assessment roll.

RECOMMENDATIONS:
The Public Works Department recommends the Utilities Committee grant preliminary I
approval, for a period of two (2) years, of the Emmett Kindle latecomer agreement for
sewer improvements.
We suggest the duration of the agreement be set for ten (10) years, with the option to
extend the agreement, for one time only, for a period of up to an additional five (5) years.
Following the Utilities Committee concurrence in the Public Works Department's
recommendations, the Committee will recommend Council concurrence and request the
preliminary roll be forwarded to the City Clerk, who will notify the affected property I
owners.

Bear Mr. Houghton:
The sanitary sewer olan for the subject meject has been res:ewed and approved by the Wastewater
Utility Section.
Prior to issuance of a Public Works construction permit the following shall be provided/completed:
1) Executed documents for the sanitary ;ewer main easement as well as for the ingress/egress
easement. The easement documents shall be accompanied by an 8i X 14 sketch of the
easement stamped by a licensed surveyor or civil engineer. Attached are blank easement
forms for dedication by individuals.
2) Engineer's cost estimate for all work associated with the proposed project.
3) Original mylar or photo mylar of original for signatures and for City's records.
4) Copy of signed Latter of Agreement between developer and the owners of Lot 'A" and Lot
'B- regarZsag restoration of those lot:.
5) Name, :ddress, phone number and City of Renton business license number for the
developer's contractor.
6) Pre-comtructioi conference with the City of Renton, all affected private utilities, all
contractors, and me developet. Requires a minimum of one weeks notice.
7) The Cit)'s acceptance of its CIP project for West Kennydale Sanitary Sewer Interceptor S-
374. Anticipated acceptance date is late spring or early summer of 1991.

I have researched the City Attorney's concern regarding improvements being required as a
result of the short rlat. Larry's concern was based on the assumption that this was a
proposed short plat, not an existing short plat. Therefore, the triggering of off-site
improvements as defined in the City of Renton subdivision ordinance would not apply.
In addition, it is Larry's opinion that sin" the sewer extension was initiated by the
Kindles, the restrictive covenant regarding City initiated or LID instituted impro•-ments
would not apply to :Ae lots affected by the proposed latecomers.
Therefore, it is the recommendation of the Wastewater Utility Section to proceed with the
Kindle latecomer as proposed.

1. CONMCME agrees to provide all material and equipment, and to perform
all labor for the following work at E. Kindle Short Plat as set forth in the
Plans dated November 13, 190, Sheet 1 of I.

(a) Furnish and install approximately 264 LF of 8" PVC pipe, (2) ea. 48"
diameter manholes, 18 LF of 6" PVC sid^ sewer pipe, restoration of
landscaped areas, restoration of asphalt drive.
Lump sum price for said sewer installation is Ten thousand, nine
hundred ten dollars ($10,910.00).
(b) Above price does not include applicable Washington State Sales Tax. j
(c) Contractor agrees to complete said sewer installation within 6n days
from date of Contract or date of permit which ever is most recent.
II. Any and all required permits shall be obtained and paid for by Owner I
and surveying shall be done by owner or his representatives. '
III. Payment for work herein shall be by monthly estimates less 5% retainage.
Retainage shall be placed in escrow and be paid thiry (30) days after
completion of the work. Any delinquency of such payments shall bear
m interest at the rate of twelve (12%) per cent per annum until fully
paid, and OWNER shall be liable for any attorney fees incurred in
connection therewith.
IV. CONTRACTOR shall comply with all provisions of the State Workmen's
Compensation and Medical Aid Acts, State and Federal Social Security
Acts and all laws and taxes that may apply to the construction under
this contract.
V. OWNER, its officers, representatives and employees shall not be liable
for any injury or damage either to person or property which may occur or
arise from construction or work under this contract, including the
supplying of both materials and labor, CONTRACTOR shall hold harmless
i and defend OWNER against all claims and shall indemnify and repay them
( for all expenses, damages or losses resulting from or alleged to be
1 caused by any act or emission of CONTRACTOR, its employees or agents, ;
which may arise from the construction work herein contracted for.

VI. The CONTRACTOR, for itself, its successors and assigned, and the OWNER,

The Cost Data information supplied by Mr. Houghton for this project is acceptable with
the following changes:
A) There will be two(2) manholes on the project,
B) The lamphole will not be used, being replaced by the second manhole (Item
A),
C) The six-inch pipe for side sewers should not be included in the assessment.
The net change is an additional$378.70(including tax)for a new total of$I1,55'..02.
Staff does feel, however, that while this estimate is within an acceptable range,it is in the
lower end of this range. We would hope that the developer will make every effort to
keep costs close to this estimate.
As for method of assessment, we feel since none of the lots receive any more benefit than
the ethers, dividing the cost equally betwe.n the four lots is the most equitable.
