I Please find enclosed Ralph Gilbo' s bill for appraisal services in
preparation for the Shane trial. As you will recall, Mrs.
Shane' s attorney has made the claims that her loss is now over
$20, 000.00 for what we believe is a electrical easement worth not
more than $500. 00. Because of the great difference we had to do
a full appraisal. At the last minute, Mrs. Shane' s attorney had
a conflict and the case has had to be continued. It is
unfortunate that we have to spend this much money to get ready
for trial , but we have no alternative. Could you please process
this bill and see that Ralph gets paid directly.
There is no new trial date established, but I will let you know
when I receive the new trial date.

Shortly before trial you asked for a continuance , which I agreed
to. The last note in my file indicates that you were to renote
the matter . I h, ve not been provided a copy of the note.
I also would like to take the deposition of your expert Ono
Millard. Of course, the date of that deposition is dependent
upon the case being noted for trial and the actual trial date .
Could you please tell me if you have renoted the matter for
trial. If not, would you please do so. If you want to seek an
early trial date, would you please call my office so that we can
agree as to acceptable dates.

Vie new Honey Creek Sewer Latecomers will be based upon two sets of charges:
Front footage charges for properties that directly abut the sewer;
Area wide charges based upon per house, par apt. - flat rates, and
area charges for commercial, institutior,al, and industrial develop-
ment.
The new interceptor sewer is 5000 feet long. Properties fronting along
the pipe will pay the costs of an average 8" sewer for direct services
along their frontage. Based upon the recent LID 331 - Smithery Ave. S.
costs; ($70,621 for 1057 l.f. of 8") $74.38 per centerline foot, or
$37. 19 per property frontage on each side of the sewer pipe.

The area wide charger will reflect the benefits of the trunk sower. I'll is

The new interceptor system and pipes can accommodate 500 qpm of new waste
waterflow at the peak hourly rate - this is an average daily capacity of

600 ft.2 of tloor space. while City Code has a maximum lot coverage of
65% of the gross site, our development experience shows that the lot
coverage of buildings to gross site, is 50% or less. If we assume 33%
lot coverage, we will produce 100 gpd per 1800 ft.l of gross site. An
acre of commercial development would be equivalent to 12.1 houses, when
connecting for a peak hourly flow rate of only 1.5 for cc�mercial devel-
opments. The commercial development charge is .05760/ft_ of gross site
(12.1 house equivalent x $250 -. 43560 ft/AC) .

This Memo is to confirm a conversation tha
t you and I had
September 19th or 20th at City Hall . I indicated to you
that I had received a call from Mary Shropshire of Puget
Power, phone number 462-3032 . She indicated to me that
Puget Power wanted to put a mini-pad transformer on the
Shane power easement. I told her that this was a surprise
to me and no one had mentioned such a desire to me. Therefore,
my order of use and possession did not mention any above-
ground facilities. You indicated that you did not know that
Puget Power wanted to put an above-ground transformer on
the project and had therefore not told me of their intention.
You were going to follow through with their design people
and see if you could eliminate the problem. if you cannot,
please let me know so I can try anZobta a modified use
and possession order.

SUBJECT: Honeycreek Sewer Project
Barbara:
Report on status of the above referenced project.
The preliminary survey work for the project is complete. With this
information a route has been selected. 90% of the right-of-way has
been acquired. There are ^nly 3 pieces which are still in negotiation
1 ) Raymond Slater, 180+ of right-of-way; 2) Bob Berg, 90+ of right-of-
way; and, 3) Ms. Susan Collins/Wilcox, 800+ of right-of-way. If
negotiations fail we will have to go to the condemnation procedures.
The design for the gravity portion of the project is slated to be
complete in October of 1984. The lift station and pressure line design
should be complete by December 1984.
Tt.e Environmental Review has been completed, Fish and Game and Hydrau-
lic permits are also acquired. We are s,. bmitting to King County for a
right-of-way permit for work on Devils Elbow. This should be completed
by August 24th.
This project is budgeted in 1984 at $715,000. The Department ha:, applied
twice for grant monies through Ref . 39, In 1983 we were not successful ;
however, in 1984 we did make the grant eligible list. As you know upon
application for that grant we were turned down. This is quite upsetting
especially after a great deal of time has been spent on this process.
On August I5th, Mr. Eergstrom and I went to Olympia and met with
Mr. Don Moos, Director of the Department of Ecology: Mr, Glenn Fiedler,
A-.st. Director, and Mr. Mike Palko, Grant Supervisor. The purpose of
the meeting was to a=_certain the reason or reasons for this grant being

withdrawn and what we could do to get back on board.
They were helpful and explained the problems with our particular project.
It mainly has to do with definitions. We also had some additional informa-
tion of which they were not aware. Out of all of this I think we have, for
the time being at leas! , the project "on hold". This does not mean we have
a sack of money yet. We have to get some letters from the Health Depart-
ment and get them to the D.S.H.S. Specifically we need a letter from our
local Health Officer saying there is a health hazard with this system.
If this letter is deemed suffirient by the head of "DSHS " then we will in
turn say there is a health problem and let the Department of Ecology know.
This, according to D.O.E. is enough to get us back on the list znd funded.
We are now in the process of preparing a preliminary package of plans to
send to D.O.E. This will give us an early reivew so design, changes re-
quired by D.O.E. can be made early.
Be aware that there is a restriction on when we can do construction in the
creek area. This time period has been missed for 1984 so June of 1985 is
now the earliest we can start by the Fish and Game permit.
We are continuing to work the problems and should have some answers to the
grant funds within 3 weeks. I ' ll report to you as soon as I have something
Solid.
Our plan now is to have everything set to go by June of ll9 . . . .whether we
obtain a grant or not.

Alternate Equipment Review and Recommendation
Dear Bob:
At your request, we hive completed our review of the alternate equipment
bids submitted by Puget Constructors, the apparent low bidder for the above
referenced project. Our review included proposals `rom N.C. Engine Power
of Spattip. WA, for a Caterpillar engine/generator set; Power Systems of
Renton, WA, for a Cummins engine/generator set: and from Say Power and
Control of Auburn, WA, for a John Deere engine/generator se! (original
submittals are attached).
The submittal data indicates that all three equipment suppliers are
expeipncpd in the type of work required by our contract specifications. We
have worked with N.C. Engine Power and have found their work satisfactory.
We. have checked with the references provided by Power Systems and Bay Power
and Control , and have also received satisfactory ratings for their work.
Parts and service for both the Caterpillar and the Cummins are provided by
N.C. Engine Power and Power Systems respectively, the proposed suppliers
for this project. Parts and service for the John Deere unit are provided
by Craig Taylor Equipment Co. of Renton. WA, anti are not available from Bay
Power and Control . We believe this is not a significant disadvantage to
the City since Puget Constructors must provide authorized warranty service
for the system for one year, regardless of whe provides the service. At
the expiration of the warranty period, the Citi may want to "shop" for the
best service available which may not result in any of the three suppliers
providing extended service. The engine and generator systems are standard,
commercial products and can be serviced by a variety of sources.

Dear Dick:
The information you have provided me concerning the contract
indicates to me that the contract is in appropriate legal form
with the exception of the insurance limits. Contract Section
7-1,18 requires One Million dollars orimary coverage and
Five Million dollars umbrella coverage . The policy for this
contractor has Five Hundred Thousand E�llara primary limits
with Five Mill_on Five Hundred Thousand Dollars in umbrella
coverage. V,'.Aile the total is the same as required by the
contract, the e.mounts of the insurance are not exactly what
is called for t,y the contract. However, I feel like the
discrepancy is minor and if the Department wishes to waive the
minor discrepancy, it may do so.
If you waive this minor discrepancy, then the contract is
approved as to legal form.

Dear John;
Power Systems, Division of Cummins Northwest, Inc. is pleased to
know of your interst in our equipment for water project W-815.
As you may know Power Systems is the biesel Generator Division of
Cummins Northwest , Inc, located in Renton, Washington. Power
systems has been designing and building custom diesel generator
and controls for many years. In that time we have assembled
many trailered standby generator sets similar to the one for this
project. Power Systems specializes in interconnect and control
systems. All of this accomplished at the Renton office and shop,
from design to complete test prior to shipment to job site. We
also, do site inspection to assure proper installation and
operation of the equipment.
I cannot help but stress the extreme efforts taken by Power
Systems to assure proper operation of the system before shipment .
Atter receiving an order or letter of intent Power System
proceeds �o put together a complete submittal including a bill
of materials to be used and drawing of equipment, control and
power circuits.
Power Systems is hoping to supply a complete trailer mounted
125kW diesel engine generator system with a weather proof
enclosure as specified for water project W-815.

We have reviewed the Contractor's insurance limits and they ap-
pear to meet City Spec. 7-1. 1A, special provision "Public Li-
ability and Property Damage" The Contractor has three policies;
PCP-85-136 of $500,000 limits as per the affidavit and a supple-
mental $1.000,000 umbrella policy UM 8F-103-04, and a further
excess umbrella policy MN-050756 of $4,500,000. Please check
and see if our interpretation is correct.
ITEM f3 Foundation Material - it Mice_Off-Loading:
Public Works has reviewed and considered the impact of this
minor off-loading, While the Contractor obviously off-loaded
the material price, our estimated amuunt of 50 tons should
not 0e a major impact.

The contract as forwarded to me has several minor problems .
1. The Minority Business Enterprises form at
paragraph number (a) does not have one of the
two choices selected. I think we can infer that
choice but it would be best to have the contractor
complete the form.
2 . The insurance certificate does not disclose adequate
insurance. Section 7-1 .18 of the Standard Specifications
required a million dollar single limit insurance for
bodily injury and property damage . The insurance
disclosure shows only $500,000 .00 . I recall Standard
Specifications requiring only $500, 000 .00, but
apparently we have changed this limit upwards .
3 . As a final matter and perhaps an incidental one,
I did notice that the foundation materials were
bid at 1C per ton. Obviously this item was seriously
under'uid. If this creates any question about loading
of the bid, then it should be coYsidered now and not
later . ?r

SUBJECT: Honey Creek Sanitary Sewer Project
This project, as yo Know, was broken into several phases. All phases 'cave peen bid
except the emerrAencv rower and are either complete or under contract. The target
data for compietion of a p ases s eptember 1, 1985. Total miney budgeted for
all phases is $960,000 plus the grant of $396,000 for a total of $1,356".
We now are at $,11,,2..46.L66992.�with the contracts. Also we have consultant and Inspection
fees in the approx mf ate amount of $100,000. So, as of now within budget (counting
the consultant fees). What the cost of emergency power will be we dq�4not know yet.
We estimate $200,000. This is required b�D,S.H.S, so we have no choice. The unit
will be port' a i�Te so`_we can useTt at other locations. if that is any consolation.
The monies for the completion of this power unit are available within our Utilities
C1P Budget. We have requested D,S.H.S. to snake the power unit grant eligible. If
this request is granted we will be over total budget by about $100,000.
This project has been a long time in the processi however, we are pleased with the
progress that has been made to date. Earlier estimates for this project were at 3
million and we should finish at about 1J2 of that figure.
This system when completed will allow the Council to remove the moratorium on
connections In the N.E. quadrant of the (�itv• As you know we have had several
Inquiries from developers about this very subject,

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTY
AND PROPERTY RIGHTS BY EMINENT DOMAIN PROVIDING
FOR THE PAYMENT THEREOF; AUTHORIZING THE CITY
ATTORNEY TO PREPARE A F':TITION FOR CONDEMNATION
IN THE SUPERIOR COURT IN AND FOR THE COUNTY OF
KING AND FOR THE PROSECUTION THEREOF FOR THE
ACQUISITION OF SUCH PROPERTY AND PROPERTY RIGHTS
FOR THE HONEY CREEK SEWER INTERCEPTOR PROJECT.
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SUCTION I: The City Council finds acquisition of the following
described property and prope ty rights is necessary and for a public
purpose and use, i .e. the Honey Creek Sewer Interceptor Project,
the properties to be acquired being described on attachment "A"
which is incorporated herein as if fully set forth. The City of
Renton is authorized by laws and statutes of the State of Washington
to ,appropriate lands and property rights, through the exercise of
its tights of eminent domain within its cor?orate limits necessary
for the above-stated purpose .
SECTION II: 'the City Attorney is hereby authorized and
directed to commence condemnation proceedings against the owners and
all other parties in interest in the above described lands and
improvements, if any, as provided by law, to prepare the necessary
petition for condemnation; and commence and prosecute such action
in the Superior Court in ar.d for the County of King against all
owners and interested parties in the hereinabove described property
and property rights for the City of Renton. Such proceedings shall
be to determine the just compensation for the appropriation of
such property and property rights by the City of Renton.
SECTION III : Compensation for the acquisition of said
property and property rights shall be made from funds heretofore
committed fog that purpose by the ^ity of Renton.
SECTION IV: Nothing in this Ordinance shall be construed
as a waiver by the City of Renton of its right to decline to take
and ?ay for said property and property rights after the amount of
Just Compensation has been ascertained, and within the time allowed
by law.
SECTION V: This Ordinance shall be effective upon its
passage, approval and five days after its publication.

Services Contract Amendment No. 3
Please have executed the et�ached Amendment No. 3 on the Money Creek
Sanitary Sewer Project Professional Services contract with HCWL Engi-
neers. City Attorney review is attached.
This project is the Honey Creek Sewer Interceptor which the City has
received Department of Ecology Referendum 39 Grant Funds, This pro-
ject is on a "fast track" short construction schedule. About $1 .2
Million dollars of construction work will be compressed into several
months of time this summer. Amendment No. 3 provides full time con-
sultant inspection and construction management on this large project.
Ci ,y staff is unable to cover this project in addition to our already
scheduled projects. The issue raised by the City Attorney on costs
is, of course, a legitimate question. However, the inspection fee
of $77,500 amounts to about 6`t. of the construction project cost of
$1 .2 Million dollars. This compares favorably to ot„er inspection
costs such as Grady Way Bridge, $750,000 inspection and construction
management fee on a $4.5 Million dollar job - 16.6% cost of inspec-
tion.
It is the department's recommendation to do this work. After execu-
tion, please return a photo copy for our files.

Dear Bob:
I have reviewed the contracts submitted to me. If I understand
it correctly, Scott is doing Phases C and D. If Scott is
being considered for Phase A iii any fashion, you should note
,.nat item 17 in Schedule A contains an error in that the
per item written words are "two hi—Ired" but thr numerical
listing is 115250 .00" per item. I cote that the amount of
the bid bond is for the sum of Schedules C and D so this
apparently is not a problem.
Scott ' s insurance is in the amount of $500 - 000 .00 per occurrence
while the insurance requirement -ontained in Special Provisions
pages 12 and 13 requires One Miilion Dollars single limits
per occurrence. The umbrella insurance amount iL adequate.
With these comments the Scott contract is approved as to legal
form.
With respect to the Alia Contract for Phases A and It, I note
significant discrepancies in bid prices on items 9 and 10 ir.
Schedul-- A for bedding material and bank run gravel between
the bids of Alia and Scott. I also note that Alia 's bid has
^120,000 .00 in mobilization, a figure that ppears to me to he
quite high . Alia' s bid may be front-loaded. This conclusion
is furthered by Alia' s bid on item No. 22 for finishing and
cl-aan up at only $100 .00 . That figure appears to be very low.

the bid itself may not be disproportionate, I am concerned
about it being front-loaded. of course, I leave that decision
up to the Engineering Department.
Ali-a' . certificate of insurance is also only at *he level of

With these comments, and anticipated minor changes, t:ie Alia
contract is approved as to legal form.
