On September 26, 1978 we we., contracted to fabricate and furnish one Smith B Loveless pump station for the purchase price of $9,343.00. This equipment was to be used on a project for the City of Renton, Washington known as Lind Avenue, Southwest, Contract B - Sewage Lift Station. Tht engineering firm of Gardner Engineers, Seattle, Washington, approved the engineering submittal data on the Smith 6 Loveless pump station on or about November 22, 1978 and advised Coluccio to proceed with manufacture of the pump station. The pump station was subsequently released to production, was completed and shipped the week of March 25, 1979. Smith A Loveless Invoice No, 27188 was forwarded at this time in the amount of $9,343.00 which was payable on a Net 30 day basis. We have received absolutely no payment from Coluccio as of this writing and, therefore, consider the contractor in default of this contractual commitment. Stanley T.
