HOLD HARMLESS AND RELEASE AGREEMENT

This Hold Harmless Agreement is executed this "Y= day of
January, 1992, by Eland Building Limited Partnership ("Eland").
Recitals
Z_
O s A. Eland is the owner of the real property ("Property")
O legally described on Exhibit A attached hereto and incorporated
w herein by this reference. The Property is part of Blume
cc Distribution Facility (the Pc-tien of which is located on the
0: Property the "Project") which is the subject of city of Renton
File Nos. ECF-112-89 and SA-112-89 ("Application").
j B. The Application seeks site plan approval of the
O Project, a warehouse/office complex, including one structure,
parking and service areas, landscaping and recreational
1 amenities.
1 I C. On April 11, 1990. the Environmental Review Committee
1 of the City of Renton issued a Revised Determination of
Non-Significance Mitigated for the Project, which included inter
alia. Condition No. 6 requiring a "Hold Harmless" Agreement
insuring that the municipality will not be responsible for any
damage occurring to the site or developments thereupon resulting
from flooding on the Property.
NOW, THEREFORE, in consideration of the City of Renton's
issuance of site preparation/building permits and a certificate
of occupancy for the Project, Eland agrees as follows:
1. Hold Harmless_. Eland covenants and agrees that it
will, for the life of the Project, protect, defend and hold the
City of Renton harmless from and against, and hereby releases
the City from and against, any and all claims, demands, losses,
damages, costs, charges, liabilities and attorneys' fees arising
from any damage occurring to the site or improvements located on
the Property resulting from flooding on the Property, including,
but not limited to, any flooding or damage to the site or
improvements on the Property resulting from the existing
retention or detention pond located on and adjacent to the
Property; however, nothing herein shall require Eland to f
protect, defend or hold the City of Renton harmless from, or to If
release the City from, the consequences of the City of Renton's

sole negligence, the sole negligence of any of the City of
Renton's agents or employees, or the consequences of any future
development around the existing retention or detention pond.
2. Agreement_ to Run With the -Land. The burden of this
Agreement shall be deemed to run wih the land and shall be
enforceable against Eland and its successors and assigns,
including, without limitation any present and future owners of
the Property or any portion thereof.

4. All existing fire hydrants most remain in service. All new hydrants should be
wrapped with burlap until accepted by the City.

5. Permits will be required for all on site fuel storage tanks.
6. 24-hour adv.nce notice should be given to rim Prevention in preparation for
witnessing sprinkler system hydro test.
7. All closures of existing City water valves must be coordinated with the City of
Renton construction inspector in advance. A double check valve assembly will be
required on fire hydrant for constriction w atcr use. This may be obtained from the
City by contacting the 4th Boor Customer Sen�ice counter and posting an
deposit.
S. Emergency vehicle access throughout the site must be maintained at all times.
9. Don Cole mentioned that the sprinkler system designer expressed concern about
having sufficient pressure available via the single 10-inch fire water line to the
building as designed Don recommended that the applicant touch bases with the
sprinkler designer regarding this issue. A redesign might be required.
WATER.
1. TRI-M Construction is the utility contractor.
2. The City went through the required procedure for testing,Bushing,and
chlorinating the water lines prior to conrecti>n to the City mairw hoots discussed
include

A) Vertical crosses are required at ends of water lines-these serve as pig launches

and sediment traps. 4
B) Water lines must be pigged oat:using poly
pig.
C Water lines must be pressu,:tested at 150 psi plus static head,which usually
works out to 200-220 psi.
D) Water lines must be chbrinated. No dry chlorine is allowed Applicant rents a
pump and obtains chlorine fror i the City.
E) Water purity tests are required. City lab picks up purity samples on
Wednesdays. Applicant will need to use courier service to submit samples on
other days.
3. Water line Bushing water should be drained into sanitary sewer only.
4. Water lines and fittings are to be pohwyrapped.
S. Thrust blocks must be formed Concrete used must be delivered to the job(no on,
site mixes).

6. Construction staking is required for easements. Staking shall be marked so as to be
understandable to the inspector.
7. Applicant must sign authorization of special billing and water service application
forms.
8. Connections to City mains arc made by the City. Contractor performs excavations
and supplies materials and the City crew makes the connection.
9. Crus;ied rock backfill to gnde is required in City right-of-way.
10. The City asked who will be submitting as-built drawings. This was not yet
determined. All changes must be shown on as-builts. -�
11. 24-hour in advance inspection request is required. Inspection number is 277-5570.
All work must be inspected by City prior to backfill.
12. Major changes should be submitted to the City engineers from the applicant's
project engineer.
STORMWATER:
1 The City expressed concern about which piping materials the applicant would use
fat storm drain lines. The design calculations were performed around concrete
pile,therefore,rougher pile such as CMP is not an acceptable substitute. PVC
pipe is discouraged by the City in paved areas with less than Y of fill. An acceptable
I product would be CPEP(high density po4 clhylenc pipe,corrugated exterior,
smooth interior). Fill depth is not as critical for this type of pile. ADS N-12 or
Hancor HvQ are acceptable types of CPEP pipe. CPEP pipe only requires pea gravel
bedding to springline whereas PVC pile requires pea gravel over the crown of the { '
ipipe. The Contractor stated they will get back to the City on proposed pipe ! '
1 materials after completing pricing comparisons. I,
2. The biofultration swalc should be the first order of work. Planting must take place
i before biof Itmtion swales arc placed into service. Overflows should be used until
biofultration swales grasses arc well enough established to a^cept flow. t
3. An inspect ion tee is required on the downstream side of the oil/water separators.
4. Final adjustments to grade must be made on inlets and catch basins prior to paving.

5. Backfilling requirements arc the same as for water mains: 95%compaction under
pavement,and crushed rock to grade in City right-of-way.
6. Applicant must continue to use previously approved temporary erosion control '
plans.
