Ladies and Gentlemen:
This letter is to apply for a street use permit to install 150 feet of 8 inch sanitary sewer main
within King fount), right-of-way. This work will be done in IOCth Avenue SE between SE
166th Sueet and Mill Avenue South as shown on the attached sewer plan. The sewer line will be
installed to serve the above prnperty which is experiencing a nonrepatrable septic drainfield
failure and has peen cited by King County Health Department (a copy of the notice of violation
is attached).
The subject property is within the service area of Sons Creek Water and Sewer District which
does not have a sewer line in the vicinity of the site. Attached is a copy of Sons Creek's release
of its service area to the City of Renton.

Dear Lyon:
Mr. Cantellay has not paid the latecomer's amount and we now are faced with his bring
hooked to the city's sewer and yet refusing to pay a legitimate fie. He has failed to pursue
his remedies in court and apparently does not have a cause of action against the city.
Therefore, I would suggest that we take the following steps:
1. Write Mr. Cnntellay and inform him that he is delinquent in hie payment and must
bring the full sum to the city within ten days.
If he rails to do so give his notice of Intention to require disconnection of his sewer
from the city system.
1. Involve the King County Health Department as they may be in the position to
require bim to pay or vacate his house.
i. If all of the issues are not cleared up, I would suggest that we file a declaratory
Judgment action in the King County Superior Court to make sure that we are on
strong legal ground. -
Since some of these steps will require the active involvement of your department, I thought
1 should share my thoughts with you before accepting the responsibility of pursuing this
action further.

Re: Recovery Cost sanitary sewer Main Extension in 104th
Ave. B.E. Project No. B-380
Dear Mrs. Tomlan:
I am in receipt of your November 24, 1989 petition letter
for reimbursement towards the original cost of the 8"
Sanitary Sewer Main you installed in 104th Ave. S.F.
In order to initiate a latecomer agreement and place your
petition letter before City Council, the $1,000.00
processing fee is due and payable at this time.
Per City of Renton Ordinance No. 4189, the City is required
to notify the benefitting property owners of any impending
latecomer fee twice. Once with the preliminary cost
estimate and secondly when the final co.;ts are submitted.
The first notification must occur prior to the completion of
1 the improvement.
The only costs allowed under the terms of a latecomer
{ agreement are those costs directly related to the
j 1onstruction of the 8" Sanitary Sewer Main line. Design
cost, side sewer cost and City of Renton permit fees are not
allowable costs for reimbursement.
The $2,630:94 figure I quoted you in my November 15, 1989
letter is in error. The corrected estimated reimbursement
possible from the Nichols property is $3,630.94 which
includes a credit for the $1,000.00 processing fee.
Upon receipt of your $1,000.00 processing fee, I will submit
your petition letter to the Council and begin preparation of
the latecomer agreement.
