Forest A 28 Unit Apartment Community Renton, WA Dear Ron: We are currently proceeding on the referenced project and feel we are on schedule at this point. During our contracting for the project, we have come across an issue we i would like vour reconsiderat4on of. During our plans review, the Public Works review indicated a potential need for a "Wet well" adjacent to the existing pump station on Union Street. We were not informed of a need for the facility when we completed our rezone and site plan approval in September 1988, despite a review of our plans by Public Works/Engineering at that time (copy of report to Hearing Examiner attached as Exhibit A) . When this issue arose during our plans review, we were concerned that objection to the Wet Well would delay our project into the rainy season and we were told that the Wet Well was just not that expensive of an item. Since that time, we have determined the cost of the Wet Well, which is very high, (approximately $20,000) . We have also reviewed the need for the Wet Well with the City of Renton Maintenance Department, our engineer and the City's engineer, and all question the need for it. We have been informed that the current lift station was installed 5-6 years ago and that it has two separate pumps, so that in an emergency situation, whereby cne pump p 11061 N.E.2nd St,Sum 111 •Bellevue.WA 98004• (206)646-8846• FAX(206)646-8856 _l w e Page 2 Ron ilsen October 24, 1989 failed, the second pump would be a backup. If both pumps failed, the City of Renton Maintenance Personnel felt that � . the current lift station had adequate storage capacity to _ accommodate sewage requirements in the area, until repairs could be made. Furthermore, we are aware of an area wide sewer moratorium in the area of our site. Accordingly, we have been told no more hookups will be permitted until the sewer system in the area is completly upgraded. We have also been told a system upgrade would involved abandonment of the very lift station that we are being required to install an expensive Wet Well next to. Ron, we would like to formally request reconsideration of the wet Well requirements on our project for the following reasons: 1.) We completed a rezone and site plan approval in September 1988. This approval involved circulation of our plans to all departments including Public Works/Engineering. If an expensive item like a Wet Well would be required, we feel we should have been notified P� this time, so we could reasonably anticipate this -ge item in on our project feasibility budgets. 2.) We have been informed by the City of Renton Maintenance Department, our engineer and the City's engineer that the need for a Wet Well is questionable. 3.) There is an area wide sewer moratorium in the area, and the City's plan in the near future is to abandon the Union Street lift station all together. It seems unreasonable for us to incur a major expense for a facility that has a questioned need, that will in all probability be abandor.ed in the near future. We strive very hard to provide affordable housing for city residents. Additions♦ costs such as this would have the net result of increasing our rental charges to prospective tenants, something we would prefer not to do. Pursuant to the City of Renton's Environmental Ordinance and SERA (RCW 43.21[C), 1971, as amended) the Environmental Review Committee, the responsible official, issued a Determination of Non-Significance - Mitigated, on August 8, 1988. Mitigation conditions are listed as follows: a. That the applicant develop a design plan for open space, landscaping and screening which maximizes open epace/natural environment for both habitat enhancement and passive/active recreational opportunities for residents (adults and children) . Note: The Committee felt the applicant should consider an alternative site plan that orients some of the buildings to N.E. 5th Street, thereby reinforcing the existing streetscape and placing parking at the rear of the site as a puffer between the unite and commercial development to the south. { b. That the applicart limit construction operations to hours between 9:00 a.m. and 5:00 p.m. on Naturdays and that nQ ! construction operations occur on Sundays to mitigate noise 1 impacts. c. That the applicant be required to periodically wet down the construction site with water to limit dust and debris. d. That the applicant be required to wash down truck wheels with water prior to their leaving the site to minimize tracking of dirt onto the public right-of-way. e. That the applicant be required to provide a bond in the amount of $1,000.00 to ensure street clean-up during construction operations. 3. Various city Departments have reviewed and commented on the proposal. The majority of the staff reviewers recommended approval for the proposal with conditions. (See attached Etaff ( Comments) . Two comments which need to be addressed are as fellows: i a. The Traffic Engineers comments have been modified. The new conditions which the applicant will have to comply with are as follows: 1. The applicant shali be required to pay a trip generation fee of $404.80. 2. That the applicant provide street lighting plans. b. The Police DOp♦♦artment the applicant: 1) address the comiblex and 2) provide crime prevention hardware such as an slats system, lightin dead bolts. REZONE CRITERIA 4. The subject property has been designated G-1, General Use since the property was annexed into the City of Renton in November, 1966. Since that time the property has not been considered for a rezone. In this this plan, properties in the immediate area of the site currently unrer consideration were designated either Commercial or Office/Office Park with the hope of creating an employment base for the surrounding residential area. Since the adoption of the Northeast Renton Plan, the City Council has approved rezones to R-1, Multiple Family in the immediate area even though the properties were shown as potentially suited for commercial or office/office park development. This has been a transitional area since the plan has shown the area suitable for multiple family, commercial and office park development. Many of ' these properties which have rezoned for multiple family use, nave been developed with multiple family projects. As stated in the Comprehensive Plan Compendium, the Comprehensive Plan is a guide for development which is not intended to be precise or dictate the future use of each parcel of property in the City. The final test to datermine whether a rezone is appropriate is to address the question of timeliness; whether the 79zone of the subject property is appropriate at this time. Based upon the facts that the site is adequately served by public services; that the area has been determined to be better suited for multiple family development rather than commercial or office development; and the fact that the property is the last site to be rezoned in the immediate area, staff have determined that the rezone request is timely. Section 4-738(D,1) of the Renton Municipal Code lists ten - criteria that the Hearing Examiner is asked to consider along with all other relevant information in making a decision on a Site Plan Approval application. These include the following: a. Conformance with the Comprehensiv-e-Plan, its ejements and oolicies; See discussion above under 4 (b) . The site plan is predicated on the applicant receiving approval of the rezone application. C. Mitigation,fipact to surrou d n roperties and uses: ' The project design is such that the applicant has attempted to minimize impacts to the surrounding properties by: 1.Installing a six (6) foot high fence around the property (Note: The applicant needs to be aware that tho six (6) foot fence will not be allowed along N.E. 5th Street. The fence may only be four (4) feet in height) . The fence needs to be asolid, sight- obscuring structure built or wood, brick or similar material. ; 2. orienting the development so that light and glare impacts on adjacent properties as a result of vehicles entering and leaving the site is minimized by shielding adjacent properties by the fence, landscaping and the location of the buildings; and 3. Designing the bulk and height of the buildings in a manner compatlable 3 with the adjacent projects. Adfiiiak d. Mitigation of impacts to the sit l_ The applicant's project has taken the site constraints me into consideration. The buildings are oriented in a manner which allows for adequate air and light; the buildings aro not clustered together but rather there is come open space between each building; the buildings are oriented, to the greatest extent possible, in a manner which reduces the units which will have direct views into other units; and the landscaping areas designed to minimize damage in the pedestrian and vehicular circulation areas on-site. Finally, in order to enhance the design of the project ( and impactd of views onto the parking, the applicantif should limit the use of carports on the Bite to only4the clustered parking stalls located in th- center of the parking area. No carports should be located adjacent the buildings. Any carports which are used should be designs,' to be architecturally compa' _ble with the exterior treatment of the buildings c.;d should be softened with landscaping. e. Conservation of area-wide property values; The subject proposal is not anticipated to adversely Impact surrounding property values and, in fact, hsould enhance those values.
