Gentleman:
This letter is to serve notice that this office is not Satisfied with
the progress. or the method of prosecution of the referenced contract.
In accordance with the contract specifications It is the contractor's
responsibility to provide sufficient manpower and equipment to perform
the work in a safe and professional manner within the time stipulated in
the contract. It is apparent from the work so far that the proper equip-
ment and sufficient manpower are not being utilized. The excess time to
make the inilial tie-in to the Metro trunkline is resulting in Increased
costs and inconvenience to the City as well as creating a safety hazard
to the public.
This office has rerelved complaints from McGarry Plumbing about broken
sewer services, broken electrical services and loss of business due to
your operation. They also complained of not being notified In advance of
construction.
Henceforth you will be expected to perform all work in accordance with
the specifications and to pursue the completion of the project within the
contract time limit.
All orders issued by the City Inspector shell be carried out as soon as
possible.
Any deviation from the specifications shall be duly noted and a correction
notice or a stop work order will be issued.
Should you have any questions, please call me at the above number.

CAG-037-84 - Suspension of Work
Gentlemen:
At a meeting this date between yourselves and members of the Public Works
Department, it was mutually agreed upon to suspend work on the referenced
contract until June 19b5, to avoid public inconvenience as a result of the
high probability of being unable to complete the repaving.
Said suspension shall be in accordance with tie provisions of Section 8 of
the Standard Specifications.
Also, in accordance with Sectior 8 of the Standard Specifications, you will
be required to resume work when so directed by the Engineer and to take
precautions to prevent damage to or deteriorations of the work during the
period of suspension.
As your contract time has expired, it will be necessary to secure the
concurrence of your bonding company regarding this suspension of work.
Also, all licenses, bonds, permits and insurance are to be continued
until the works completed.

Subject: South Tobin Street Sanitary Sewer Work Progress
Gentlemen:
The contract completion date for the referenced project is October 17, 1984.
Per the Weekly Statement of Working days dated September 11, 1984, there were
28 working days remaining on the contract as of September 7, 1984.
A "Schedule of Completion" submitted by your office at the beginning of the
project indicated August 17 for the installation of Manhole 01. A revised
Schedule of Completion was submitted September 3 indicating September 6 as the
date for installation date for Manhole el, including backfill and compaction.
Manhole ►1 was actually installed September 10 and a. this date backfill
and compaction has not been den .
Your attention is directed to Sectiun 8-1.03 of the Standard Specifications:
"The progress schedule and supplementary progress schedules shall be consistent
With time and order of work requirements of the contract. Adequate material ,
equipment, and labor shall be provided by the contractor to carry out the
progress schedule submitted by him and to complete the contract within the
time specified."
In accordance with Section 5-1.13 "All work under the contract shall be performed
under the continuous supervision of competent personnel experienced in the class
of work specified, and incompetent or careless or negligent employees shall be
forthwith discharged by the contractor upon written request by the Engineer."
It is your responsibility as contractor to evaluate your personnel and equipment
and to adjust your forces and equipment as necessary to complete the work within
the proscribed contract time, or the City may direct you to do so. It is
suggested that you take direct charge of the project.
As of this date there have been no reasons for delays which would justify an
extension of time on the subject contract. You are therefore advised that
liquidated damages in the amount of $210.00 per workinq day will be assessed in
accordance with Section 8-1.09 of the Standard Specifications, for any days for
which an extension of time is not granted. You are also reminded that you will
be responsible for maintenance of the project area if extended over the winter
months.

Dear Mr, Ford:
Your letter of October Sth has been reviewed by this office. A number of
issues discussed in said letter need answer.
Initially you contest your responsibility for paying the Starkovitch/
McGarry claim for damages. Your explanation is that the City did not
obtain necessary lands for the conttruction of this project. However,
you were provided with a IS ft. easement and a prudent contractor would
have found that sufficient enough land in which to complete the constrw -
tion. Also, you attempted to use a sloped ditch approach which of
necessity went behind the easement provided to you and destroyed the
access to McGarry's business. This was your choice of methods and .rot
the City's. You are referred to th,s contract which places the respon-
sibility for such claims on you.
You have also complained about water on the job. Please refer to the
contract specification documents which detailed the water problems on
this project. There is nothing that you encountered the+ should have
surprised you. You have also extended the problems which you experienced
on the job. The major)+V of those problems were of your own making or
were of so re,nlpr*J in nature that they should have been easily resolved.
In fact, •, data. the City has not received a request for extra compensa-
tion or for extra time. The City believes the+ this is due to the fact
that you realize there Is no extra work involved and ri conditions which
Involve an extensic.r of time.
You have also aer+,boed In the letter the matter of Stop Mork Orders.
They were necessary because you felled to properly prosecute your work
and to provide access to the McGarry Company'a property despite the feet
the+ McGerrry had been denied access for nearly a eonth. If you believe

the "top Work Orders have been unfairly Issued you should have appealed
them. Rather you did nothing.
You mention that you had over 20 people in your employ that were capable
of completing restoration while continuing pipelaving operations. A
check with City personnel indicates that no more than S person; were ever
on the job at any one time. A further cherk with other owners indicates
that other of your projects are undermanned and behind time. It appears
unrealistic that 20 persons were available for work On this particular
project. If those persons ware available one must question why It took
you one month to remedy Mc0arry's problem.
You complain about the City's requirement that a compaction test be done.
You Initially compacted with a small machine which the inspector had
doubts about and whether or not the area would pass the compaction require-
ments. Subsequently you brought in extra equipment and continued the com-
paction and the area was compacted at least an additional 6". From this
Information It is clear that the original compaction would have been
insufficient and the City was correct in requesting the test. The fact
that you ordered paving materials without checking with the inspector
as to the acceptability of prior compaction is imprudent on your part and
can not be blamed on the City.
Further, you complain about the City's Stop Work Order due to Infiltration
of water into the main line. You claim that the Inspector didn't check
the plug Installed to prevent such infiltration. In fact the City staff
did notice that the plug was improperly installed but the installation
was done by your company and not by the City. Additionally, at least two
City employees witnessed the amount of infiltration and It was substantial.
This infiltration was a violation of both the contract specification and
Metro policy.
I am at a loss as to how you can criticize in this Instance.
Lastly, you complain about the City's contac"ng the bonding company.
Your performance to data has not been satisractory and the job Is signl-
ficantly behind time. The City as considered removing you from the job.
Under those circumstances the City must contact your bonding company. If
the bonding company has seen its way clear not to write bonds to you that
is a problem between you and them caused by your own actions. It would be
shortsighted of the City to require a bond and then threaten the viability
of that bond by hot contacting the bonding company when significant
problem& ere encountered.
The City is willing to work with you to try and finish this project.
However, you are cautioned to cl Oss ly to l low the spec it scat Ions. Any further
violation of the specifications will cause the City to review the possibi-
lity of removing you from the job. Until such time as you have adequately
completed this job the City will not consider you as a bidder on another
future City project.

mance cf the work.
It is only prudent for the City to scrutinize ell of your problems In IIM
with determining whether or not to consider you an acceptable bidder In The

It you feel aggrieved by this letter, 1 would suggest that your company
and tee Public Yorke Department sit down and attempt to resolve the ewlst-
Ing problems.

Your letter of September 11, 1984, forwarded to us Mr. McGerry's
letter of September 17, 1984, outlining a forthcoming claim by
him, on the above referenced project. We are installing the new

tie-in was travelling in the select fill placed around the
Metro line. with a required setback for our wells of 17
Feet, we could not dPMater the sane required.Tnstead our
wells penetrated only into the clay/silt soil indigenous
to the area. With Our wells in these soils that do not
conduct water, our efforts we-e fruitless.

After a period of two weeks, and with no change in the
groundwater level, we elected to open-sump the excava-
tion. On August 31, you instructed us to close the open
excavation and restore utility service to Mr. McGarry
before our work on the tie-in had begun.
On September a, you placed a stop work order on the
project due to the fact that Mr. Mccerryts office did not
have utility services. We may remind qca that there was
no way for Mr. McGarry to conduct business out of his
office, due to the tact that there was an open excavation
9 feet deep at the front steps of his office. This action
by you was frivolous the impractical. Because of the written
order he had given the previous Friday to restore service
and bsekfill the excavation prior to completion, your in-
spector felt it should be enforced. Upon a personal visit
to your office, the situation was rectified after informing
You of the actual situation, which apparently no one had
done prior to that time.
After a length of time trying various .methods, we finally
came close to the Metro main.
Upon reaching a close proximt�q to the main, we encountered
steel sheeting left in place .nen the main was installed.
The sheeting made it impossible to excavate the area around
the main without alternative methods. We scheduled in a
clam-shell type excavator to perform the final portzon of
the excavation.
Aft *r finally dawaterinv and exposing the main, we found
that we had centered our sheeting and box in direct, align-
ment with a joint on the main. This made it impossible to
core the main with the sheeting configuration. After re-
aIiening the box, we were finally able to mako the tie-in.

to use the vibratory compactor, which nearly resulted in

restoration on Mr. Mcaerry's property. You then called in
the police, who threatened us with arrest it we did not comply.
We had at that time over 20 persons in our employ and were
completely capable of completing restoration vh•le continuing
pipelaying operations.

testing on the area to be paved. It is the owner.t ra-
sponsibility to obtain and perform testing services so
as not to delay the contractor in :he performance of his

in obtaining testing services cost of the loss of I3 tons
cf AsphaIt, which was on the site a: ti.e time your inspector
mentioned tests would be required. we lost the next day
to testing and not being able to reschedule our paving crew
until the following day. The next day was lost for paving
due to adverse weather. The Area was finally paved three
days after your inspector required testing And during this
time you were also enforcinq the stop work orJ• r placed on

to your satisfaction if you do not obtain testing and enforce

the future with a different scope. we are currently in
contact with our attorneys to determing our legal standing
for the possibility of a suit for anticipated profits.
We have been striving to satisfactorily progress on the project,
but in light of the groundwater problem, aforementioned unforeseen
subsurface conditions and frivolous acts by quo and your re-
presentatives, we can only progress as fast as conditions dictate,
which is apparently not good enough for you.
Without considering the facts, you have threatened us with taking
the project out of our harts and placing it with our bonding
company. You awarded a project to another contractor to which
we were entitled. You ylacec stop work orders on us without first
considering the facts or justifications. You failwd to properly
schedule testing se as not to delay our progress. We only hope
that we can resolve issued with you without threats and frivolous
actions. Rather than dealing with us directly, you have exerted out-

Gentlemen:
On Saturday, September 29, 198,, a field inspection by this
office round groundwater from your sewer trench entering
Petro's trunk line. Monday morning, October 1, 1984, It was
discovered that the plug installed In the west and of the pipe
was not seated propeirly and was allowing groundwater to enter
the system.
Your field superintendent has been advised on several occasions
that no ground water would be permitted to enter the new ly-leld
sower pipe. You are again reminded that all sewer trenches will
be dewatered in accurdence with the specifications and no ground
water will be permitted to enter the sewer system.

The contract completion date for the referenced project is October 17, 1984.
Per the weekly Statement of working days dated September 11, 1984, there were
28 working days remaining on the contract a of September 7, 1984.
A "Schedule of Completion" submitted by your office at the beginning of the
project indicated August 17 for the installation Of Manhole 01. A revised
Schedule of Completion was submitted September 3 indicating September 6 as the
date for installation date for Manhole al , including backfill and compaction.
Manhole al was actually installed September 10 and as of this date backfill
and cmpactton has not been done.
Your attention is directed to Section n 1.03 of the Standard Specifications:
"The progress schedule and supplementary progress schedules shall be consistent
with time and order of work requirement% of the contract. Adequate material ,
equipment, and labor shall be provided by tr. contractor to carry out the
progress schedule submitted by him and to to the contract within the
time specified."
in accordance with Sectirn 5-1.13 "All work under Lhe contract shall be performed
under the continuous supervision of competent personnel experienced in the class
of work specified, and incompetent or careless or negligent employees shall be
•nrthwith discharged by the contra=tor upon written request by the Engineer."
It is your responsibility as corr:ractor to e,aluate your personnel and equipment
and to adjust your forces and equipment as ne:essary to complete the work within
the prescribed contract time, or the City may direct you to do so. It is
suggested that you take direct charge of the project.
As of this date there have been no reasons for delays which would justify or,
extension of time on the subject contract. You are therefore advised that
liquidated damages in the amount of $210.00 per working day will be assessed in
accordance with Section 8-1.09 of the Standard Specifications, for any days for
which an extensio,, of time is not granted. You are also reminded that you will
be responsible for maintenance of the project area if extended over the winter
months.

Jane: per your memo of 9/20/84, here is the background of toe referenced
Cldiul.
This 1s a City sanitary sewer project awarded to Ford Construction Co. on
July 16. 1984. In order to install the sewer plain as designed, it was neces-
sary to acquire a 15' construction easement across the property occupied by
McGerry and owned by Rudy J. Starkovitch. Mr. Starkovich granted the ease-
iient on May 22, 1984. The easement runs between two buildings occupied by
McGerry, one being an office building and the other a storage shed. Behind
the buildings to the west is an area used by McGerry to store lumber.
In order to connect to the existing Metro trunkline in Burnett Ave. 5.(see
print), it was necessary to excavate a pit approximately 25' deep. The
contractor hegan preliminary work in the easement August 20, 1984 (install-
ing well points, etc. On August 28, 1984, he began excavating the pit for
the Metro tie-in. During the initial excavation, the contractor broke the
sewer connection and the electrical service to McGerry's office building.
These services were temporarily reconnected, however, the sewer connection
was again broken the next day. On Augus . 29, 1984 at approximately 3:30 p.m.,
the contractor's excavating machine broke down and w-s not again in operation
until September 4, 1984. On August 31, 1984, the City issued a correction
notice ordering repairs be made to the utilities and building (the contractor
tore the front steps loose from the building and undermined a corner of the
building. He finally completed the tie-in to Metro's trunk line on September 7,
1984.
During the period from August 28 to September 24, McGerry was unable to use his
office building due to the contractor's operation. The contractor was directed
by the Public Works Department to cease pipe-laying operations on September 17,
1984 until McGerry's office and parking lot were restored. This was completed
on September 24, 1984.
As of this date, McGerry is able to resume normal business; however, the contractor
is continuing pipe laying across the westerly portion of Starkovich's property and
will probably require another week to cross the property.

It would appear that most of McGerry's allegations are valid considering the
following:
1. He was not notified by the contractor as to when he was to begin construc-
tion o, the time involved to complete construction (as required by the con-
tract).
2. The extent of the excavation was such that he was unable to get access to
his office building (see photos).
3. The original time schedule submitted by the contractor to complete the sewer
installation across the Starkovich property was two to three working days.
He has now expended 30 working days and is still approximately 5 days away
from being off the Starkovich property.
Attached are copies of some of our correspondence to Ford Construction Co. since
the beginning of the project. If you desire additional information, nlease
advise.

This letter to to give the City of Renton notice that I
be filing a claim agdinat said City for damages to my will
busine as caused by sever construction work at 75 Burnett
South in Penton. Because of the nature of the work and the
street and access being torn up I have been locked out of my
business establishment for the past thirty days, since no
excess have been provided, and the utilities have been
di:connected for the sane period of time. furthermore I was
given nr notice that this work was going to be done or when
It wo�ild take place. The first I was to realize of it wav
when I saw the machinery move in on the pn -ty and start
trenching.
I have not yet completely been able to calculate the amount
of damages since they are still working on the pruperty.
Also the amounts for any lost business and inconvenience due
to this work. Also have they not rely not given me any
notice of when this work was to start , but they have not
given me a date when they will be finished, so I may once
ag^in start normal business operations.
This letter will also corroberate a verbal claim mad,. -y Rudy
Sterkovich and myself In the City Engineers Office two weeks
ago to Robert E Bergstrom.

Gertlemen,
Tiis letter is to serve notice that this office is not satisfied with
the progress, or the method of prosecution of the referenced contract.
In accordance with the contract specifications it is the contractor's
responsibility to provide sufficient manpower and equipment to perform
the work In a safe and professional manner within the time stipulated in
the contract. It is apparent from the work so for that the proper equip-
ment and sufficient manpower are not being utilized. The excess time to
make the Initial tie-in to the Metro trunkline is resulting in increased
costs and inconvenience to the City as well as creating a safety hazard
to the public.
This office has received complaints from McGarry Plumbing about broken
sewer services, broken electrical services and Icss of business duo So
your operation. They also complained of not being nntifiod in advance of
construction.
Henceforth you will by expectec to per,orm all work in accurdance with
the specifications and to pursue the completion of the project within the
contract time lim;t.
Ali orders Issued by the City inspector shall be carried out as soon as
possible.
Any deviation from the specifications shall be duly noted and a correction
notice or a stop work order will be Issued.

Subject: South Tobin Street Sanitary Sewer
Gentlemen:
On September 10, 1984, a speed letter was giv-n to your foreman in the field
directing that all pipe laying operations cease after the sewer is installed
across the Starkovich uroperty, -.;ntil such time that all restoration was
completed, including building repairs, plumbing and electrical repairs,
parking lot paving and incidental repairs. At a subsequent meeting with the
Office Engineer, September 13, 1984, you were directed to perform the restora-
tion adjacent to McGerry's Plumbing Office when sufficient pipe was layed past
the building. You were directed to restore the property to its original con-
dition in order that McGerry's Plumoinq could resume normal business activities.
At the end of the working day, Friday, September 14, 198r your foreman was
instructed that sufficient pipe had been laved to permi -estoration an,, that
no more pipe was to be installed until the. restoration had been completed.
At 7:30 A.M. , Monday, September 17, 1984, the City Inspector reported the
crew was excavating in preparation for laying pipe. The Inspector was
directed to post a Stop Work Order until the matter was 1•esclved. When the
crew showed indications of ignoring the Stop Work Order, a p, '-e officer
was rel,uested ! assist in enforcing the oraar.
The Project Engineer visited the site at 9:00 A.M. and you agreed to proceed
with the restoration work and to secure the pipe installation operation until
the restoration was completed. The Stop Work Order was then withdrawn and
you were allowed to proceed.
You are advised that any future issuance of a Stop Work Order will result in
suspension of all work activities-upon completion of securing the site-until

This letter is to notify you that because of unsatisfactory work parfor-
a nce on the presen, contract you hold with the City, the Tobin Street
Sanitary Sewers, I am unable to recommend your company for the abovc
referenced contract. The lack of progrwss on this project with the
City and the fart that you are not going to be able to complete this
Project within the time stipulated leads the C,ty to the conclusion
that you would not be able to perform on the above referenced project.
You were advised vwsbaily as well as formally (by letter) of our concerns
relaflve your work performance on September 4, 1984.

Subject: South Tobin St. Sanitary Serer - Restoration
Dear Mr. Mc Gerry:
This letter is to confinn our conversation this date at your
place of business at Burnett Ave. S. and S. Tobin St., at which
you stated that you were satisfied with the restoration that
has, so far, been done and that you are able to resume your
normal business. The paving has been completed to the west end
of )uur building and the sanitary sewer and 4lectrical services
have been recannected.
One remaining item is the railruad tie planter which ,you stated
you would Inform the contractor later if you decide you want it
replaced.
Your patience is requested during the remaining work across
your business property. If any problem shocld arise, please
call me inmedietely at 235.26.1.

a City project or something being done by an independent contractor?... .Are his
allegations true in your opinion? Anything you can do to shed some light on the

business caused by newer construction work at 75 Burnet
South in Ire,., . . Because of tb= nature c the work ani the
street and access tieing torn up I have been locked out of my
business establishment for the past thirty days, since no
access have been provided, and the utilities have been
disconne ,ted for the same period of time. Furthermore I was
given n,. notice that this work vas going to he done of when
it would take place. The first I was to realize of it was
when I saw the machinery move in on the property and ttart
trenching.
I have not yet completely been able to calculate the , mount
of damages since they are still working on the property.
Also the amounts for any lost business and inconvenie ce due
to this wrrk. Also have they not only not given me a y
notice of when this work was to :tart , but -hey have lot.
given me a date when they will he finished, so I may , ace
again start normal business npe bons.
This letter will also corroberate a verbal claim made by Rudy
Starkovich and myself in the City Engineers Off;ct two weeks
ago to Robert E Bergstrom.

Subject: South Tobin St. unitary Sewer Improvements
Gentlemen:
At 10:00 a.m. this date a correction notice was issued to your
foreman directing him to dewater the sewer trench in accordance
with the specifications. After failing to comply with the
correction notice, a stop work order was issued at 1:30 p.m.
In accordance with Section 61-3.02 of the Standard Specifications,
"the contractor shall furnish, install and operate all necessary
equipment to keep excavations above the foundation level free
from water during construction --- The stop work order will
remain in en act until all requirements of the correction notice
are met.
