Leary Way Seattle WA 98107 Subject: Latecomer Agreement for Eden Estates Dear Mr. Ferullo: On April 7, 1986 the Renton City Council concurred in the findings of the Utility Committee and denied your latecomer request for any reimbursement from others for the watermain you installed to serve yolr development of Eden Estates. Their reason being that the watermain extension is a standard extension across your own frontage. Council further concurred with the Utility Committee to recommend that a latecomer be granted for the sanitary sewer main installed nt N.E. 28th St. from Kennewick Pla.:e N.E. to west margin of Eden Estates. The 'atecomer cannot be collected unless the affected property, known as Tract 51 , C.D. Hillman's Lake Washington Garden of Eden No. 1 , is .subdivided. Tract 51 as it exists today does not receive any benefit from the sewer since it is available to the property on Kennewick Place N.E. However, if the property were subdivided into smaller lots it would receive suh�cantial benefit from the sewer installed in N.E. 28th St. and no benefit from the sewer line installed parallel to the easterly property line P� said Tract 51 . Utilities Utilities Committee Chairman Clymer presented a report Committee concurring in the recommendation of the Public Works Department Shattuck and to accept the low bid of Gary Budd Construction Company in the S. 23rd Street amount of $33,008.44 for Water Project W-709, 8- inch PRVs at Water Project South 23rd Street and Shattuck Avenue South; Engineer 's estimate: (Referred 45,933.85. Estates Latecomers Request Ron Olsen and I have reviewed the latecomers utilities request from Fiorito Brothers for the Eden Estates residential development off of N.E. 27th St. and Nirklanu Ave. N,E. The developers extended the B" watermain off of the Canyon Oakes Condo- miniums line and extended the main into the plat and to their east property lines. This is the standard extension across their frontage, and there was no off-site main work. I recommend the water latecomers request be denied. The developer extended the sanitary sewer off of N.E. 27th St. up the old N.E. 28th St. right-of-way (undeveloped) , through their plat and to the east property line. The only off-site main frontage along the new sewer line is Mr. Moji 's property. This is Tract #51 of C.D. Hillman's Garien of Eden, Division N1.
