on the prints. Please note at the proposed P-9 crossing East Valley
Highway(Sheet 16)we are proposing nct to install the ultimate culvert
crossing at this time due to the uncertainty of the P-9 channel grades.
We are proposing to provide an outlet for the drainage from the east
and address the P-9 crossing when it is more definite.
On sheet 36,note that we are proposinq to extend S.W.27th St to the
"6 line of Sec.25 to provide access to Longacres property. We are
not addressing the P-1 Channel crossing at this time due to the un-

This Is in response to the questions outlined in your August 26th memo.
A. Financing of LID 314--Based on our previous discussi,ins,I recall that the
City is presently committed to the tune of$650,000 on this project. The
Mayor is understandably concerned and would like some answers to the following
questions oefore requesting that the Council approve additional interim
financing:
I. Why must the City purchase-he right-of-way rather than the LID
participants(are them.any options)?
2. How mu,;h money will be required to purchase the right-of-way'.
3. Now soon after the R/N acquisition will the project go out to bid
and then what kind of construction time frame are ere talking about'
Please reserve some time on Monday.August 31,At 2;00 p,m.t,discuss this
issue with Barbara,Ted anu me.
8. Storm Drainage Utility--From an operational standpoint,this is a concept
whose time has come. From a practical standpoint.I believe that we must
recognize the political realities involved with this issue: 1981 is an
election year;the Council has been criticized for levying large rate
i nc�eases this year;METRO Is talking about another rate increase to cover
the 201 Fatuities Program";the garbage contract Is about to be
renegotiated which may result in another substantial rate increase. For
these reasons.I believe the Council would be;ess th enthusiastic len
faced with a proposal that would create another,burdanan"on the taxpayer,
However,due to input from the attorney regarding the City's potential and
ez lsting liability and other logical arguments for the establishment of a
Drair,ige Utility,I believe we should begin preparing a proposal that would
establish the utility in 1983. The following questions must be addressed:
1. what is the legal process that we must 1`011 ow to receive voter
approval?

2. How n.uch revenue will be required to establish and operate a viable
utility? Mow will these figures affect present ratepayers?
3. What existing problems can be addressed by establishing the utility7
4. What have other municipalities in similar situations experienced?
It appears to me that a thorough aralysis of our needs,options,goals anu
timetables should begin soon in an effor•to establish a Storm Drainage
Utility in 1983. it would probably be appropriate,given the Mayor's
approval,to form a committee of appropriate sta.f members to address these
issues and formulate a plan.

Relocation of Puget Power Facilities
Dear Don:
As I told you in tur rec
ent telephone conference we have been
unsuccessful in persuading Puget Power to make the installation
of the relocation of electric utilities at their own cost
pursuant to the terms of Section III of Ordinance No.2428
(the franchise ordinance). We Fave not even been successful in
persuading Puget Power to make the installation at their cost
reserving the question of who shall pay for the installation for
a later determination.
Therefore,it will be necessary:or the City of Renton to proceed
with the relocation of the utilities at the cost of the LID,
reserving all of the rights of the Cite and the LID for reimburse-
ment of the expenses of construction to be determined by further
negotiations or litigation with Puget Power. In that regard,
we do not mean toleave the implication chat we will definitely
'
recommend such litigation.igation There i:a�ery good legal question
as tothe applicability of the term of Ordinance No.2428 or
Schedule 71 of the Puget Power Tariffs'Aiich was flled cn July
19,!968 and became effective on August 19,1968,twelve days-
after the franchise ordinance was accepted by Puget Power and
ten days after the ordinance went into effect upon publication
b,its'own tem.
In anv event,it appears to that under the current tariffs
which have been in effect sincr 1977,that the maximum cost to
the City or the LID will be 157.of the cost of the project excluding
cost cf trenching and restoration of the sate because one lane or
more is being ad(;ed to the widening of t1street.
Therefore,you should make appropriate arrangements to have the
City's contractor trench and restore the premises and coordinate
with Puget Power for the installation cf the utWties. By the
terms of the Ordinance,the funds due- Puget Power by the
City of Renton are pavable within thtr t days.

RE: Puget Power involvement in LID 314
We have reviewed Your Memorandum of March 23.1981 and
the attachments. We are of the opinion that Puget Power
is not requited to participate in LID 314 until the City
determines that the public health,welfare,convenience
and pedeatrial and vehicular traffic safety in any street
or road widening or relocation project requires conversion
of existing overhead facilitie a to an underground installation
on ama�oror arterial street or roadway cerrving an average
of 10,0 0 v ehicies or more per day. Tile City may not require
Puget Power tc convert more than 1.5 miles of such street or
roadway to underground utilities in any one year. These
requirements are set forth in City of Renton ordinance
No.2432. in any event,the obligation of Puget Power to
make such installation at its cost is subject to the
"applicable filed tariffs"or the Published policies
of the respective itilities.
City of Renton Ordinance No.2428 which grants Puget Power
the franchise to transmit electricity through the City of
Renton requires that the installation of underground utilities
at the y shall be"subject to(the
expense of the utility
utilities)liti es filed tariffs". *
Therefore,a review of the"applicable tariffs"is essential
to ascertain any answer to the question of whether the City
may require Puget Power to provide the installation at the
present time. In reviewing Mr.Copps'letter of March 12,
1981,we note that paragraph 5-b of Schedule 71 of Puget
Power's filed tariffs provides as follows!
Nothing herein cc wined shall affect he rights or
obligationsofthe ompany under any contract for the

conversion f electrical facilities from overhead to
underground which was entered into prior to the
effective date hereof."

That tariff was filed on February 16,1977 and became
effective on March 18,1977. The fra-.chise ordinance
(Ordinance No.2428)was passed on Aueus'S,1968.
Ordinance No.2412 which requires the urdergrounding of
facilities was passed on Septe.�ber 23,1968. Therefore,
since both of the ordinances were approved prior to the
effective date of the cited tariff,it is our opinion
that the cited tariff does not affect the contract
between the City of Renton and the utility as expressed
in the two ordinances.
Therefore,it is our opinion that the utility must provide
underground inst€llation of its utilities at such time as
the average vehicular traffic reaches 10,000 vehicles per day.
As you have noted in your correspondence to the utility,
the average vehicular volume does not yet reach 10,000
vehicles a day. However,it seems clear to me that Puget
Power would be well advised.o participate in the under-
grounding of the utilities at such time as the trench is
open,rather than being required by the City to later come
in and underground the utilities at a time when the other
improvements are already installed. You may wish to forward
a copy of our opinion letter to the utility with our
suggestion rhat they make their installation of improvements
at the present time as a;.aster of convenience to themselves
and of cost savings to their rate payers.
One further matter needs comment. We would suggest that the
City request that the utility give notice to the City of any
application by it for change or adoption of tariffs which
might concern matters over which the City has jurisdiction,,
such as undergroi•nding of utilities. We would not want the
regulatory Jody to adopt tariffs which were in violation of
our ordinances,or which created an ambiguity or conflict
between the utility's duty to the City and to its regulatory.

Reference is made to Pugat Power's letter of March)2,1981.
I. Meet with Jack Olsen. Determine the total amount of cost they
a:a expecting the City to participate with them on the un�'er-
ground conversion. Puget Power or property owners must pay as
part of the LID cost which is in accordance with the ordinance
(7432).
2. Electrica)tariff may'a in conflict with franchise agreement
2428. In cry opinioo, franchise agreement would be legally
binding upon the Power Company over any filed:.ariff.
3. City could provide the trench which would be joint with street
lighting. Prig coordinated plans rl.Wad for contract.
4. Ordinance may be silent on projected vehicle traffic;but it
would cost Puget Poi less to put the system in now than after
the roadway improvements are in and the developers requesting
power;n a peace meal fashion.
The ordinance states they have to install the facilities at
their cost when vehicle volume reaches10,000,which may be not
far in the future,
The question;s,would they prefur to put the system underground_
now or told to in the near future when the volumes jump to 10,000
vehicles per day?
The franchise agreement binds the Power Company to the City
ordinance by powers invested in the agreement. It is mostly to
Puget Power's advantage to move now.

and they are currently being reviewed by our Engineering Department.
We certain' agree with the City's determination that public health,
welfare,con.enience and future vehicular traffic safety requires the
conversion Of t"existing overheaO facilities to underground installation.
With regard to„ .,ance 2432.Section II,Cost:,we are naturally concerned
over Puget bearing the entire cost of the project. A requirement outlined
in Section Il addresses itself in part to"major or arterial streets

As you know we are about to receive the plans and specifications from
Jones Associates. However,we are already aware of several changes to
those plans. These changes are basically caused by right-of-way acqui-
sition problems which we hair discussed with you. Twe changes
anticipated are in alignment only and quantities fl bid items may change
somewhat. Other than-�,.at the basic task does not..range. We are working
now to determine the extent of these changes.
Because of the basic problems related to P.E.costs we are going to let
Jones go and take over contract ourselves as soon as we receive the
plans and specifications. At that,time I anticipate problems with Jones
regarding contract awarding related to final fee.
A major concern of mine is just where do we stand when we start revising
Jones plans which a,e stamped by them. Could we be in a problem with Chic
also?
We are proposing to write an addendum to contact outlining changes and
advising the bidder to consider his bid with the changes in mind.
I would like to meet with you very soon to discuss these items and our
approach to solving them without buying the Farm.
