area instead of a systematic program of development.
2. Mitigation of traffic impacts resulting from
the development of the potential projects

Dear Mr. Houghton:
Enclosed are copies of 1981 correspondence requesting that the
assessment for L.I .D. No. 314, which would normally fall against
lot one of Renton short plat No. 014-81, be formally transferred
by the City of Renton from lot one to lots two and three of the
short plat.
This letter is to renew the earlier request in light of the fact
that the L. I .D. is nearing certification.
Please note that thi engineers on the project have segregated the
amount of the prelixinary assessment. among the three lots in the
short plat, and have indicated to us that the tranfer of the
assessment can readily be accomplished if the City of Renton
approves it.

Banyon Investment Group (Heiman M. Allenbach) has agreed with the
purchasers of lot one of the short plat to pay for the above LID
assessment against lot one when and if it becomes final.
This letter is to formally request that at the time the final
assessment role is approved the assessment amount which would
normally become a lien against lot one of the above-referenced
short plat oe shifted to lots two and three of the short. plat.

assessment for Parcel Number 45, City of Renton L.I.D. Number 314
to the three lots created by City of Renton Short Plat Number 014-81.
The segregated assessments are:

Lot 3 34,057.08

The enclosed calculation sheets dated 5/28/81 give the details of
my calculations. Please note that the estimated assessment was revised
to $101,912.81 between the original preliminary hearing (11/4/79)
and the first continuation of the preliminary hearing (12/10/79).
A copy of the revised preliminary assessment notice for Parcel Number 45
is enclosed.
During our calculation of the final assessment roll we will calculate
separate assessments for each lot of the short plat, as we would do
for any property which was subdivided between the preliminary and

an assessment from one parcel to another. This can only be done upon

Relocation of Puget Power Facilities
Dear Don:
As I told you in our recent telenhone conference, we have been
unsuccessful in persuading Puget Power to make the installation
of the relocation of electric utilities at their own cost
pursuant to OW terms of Section III of ordinance No. 2428
(the franchise ordinance) . We have not even been successful in
persuading Puget Power to make the installation a; their cost
reserving the question of who shall pay for the installation for
a later determination.
Therefore, it will be nece_•sary for the City of Renton to proceed
with the relocation of the utilities at the cost of the LID,
reserving all of the rights of the City and the LID for reimburse-
ment of the expenses of construction to be determined by further
negotiati,)ns or litigation with Puget Power. In that regard,
we do not mean to leave the implication that we will definitely
recommend ouch litigation. There is a very good legal question
as to the applicability of the terms of Ordinance No. 2428 or
Schedule 71 of the Puget Power Tariffs which was filed on July
19, 1968 and became effective on August 19, 1968. twelve days after the franchise ordinance was accepted by Puget Power and
ten days after the ordinance went into effect upon publication
by its own term; .

Relocation of Puge+ Power Facilities
Dear Don!
he I told you in our recent telephone conference, we have been
unsuccessful in persuading, Puget Power to make the installation
of the relocation of electric utilities at their own cost
pursuant to the terms of Section III of Ordinance Z4). 2428
(the franchise ordinance) . We have not even been successful in
persuading Puget Power to m:,ke the installation at their coat
reservingg the question of who shall pay for the installation for
a later dstermindtion.
Therefore, it will he necessary for the City of Renton to proceed
with the relocation of the utilities at the cost of the LID,
reserving all of the rights of the City and the LID for reimburse-
ment of the expense: of construction to be determined by further
negotiations or litigation with Puget Power. In that rugard,
we do not mean to leave the implication that we will definitely
recommend such litigation. There is a very good 1Rg41 question
as to the applicability of the terms of Ordinance ,io, 2428 or
Schedule 71 of the Puget Power Tariffs which was filed on July
19. 1968 and became effective on August 19, 1966. twelve days
after the franchise ordinance was accepted by Puget Power and
ten days after the ordinance went into effect upon publication
by its own terms
In any event, it appears to us that under the current tariffs
which have been in effect since 1977, that the maximum coat to
the City or the LID will be 15" of the cost of the project excluding
cost of trenching and restoration of the site because one latke or
more is being added to the widening of the street.
Therefore, you should make appropriate arrangements to have the
