Since all the street crossings are completed for the large
storm drain% on Lind Ave, S.V. at S.M. 19th St.. we are
requesting that the damaged street lighting conduit above
the storm drain crossings on the east and west side of Lind
A". Southwest be repaired as quickly 41 possible,
Broken wires and Junction boxes must be completely replaced.
Conductors can only be Spliced In Junction boxes,

Dear Mr. Hogan:
Your letter of July 20. 1983 providing the Hold Harmless Agree-
ment requested for the \" gas line placed on top of the City of
Kantor's sanitary sewer Is a,ceptable with one revision. The
last sentence of paragraph one states "the lelltati3n of said
joe min f" the -rigina;;jy proposed tONttalw is incorrect.
The plans which acco-vanied Your permit regwst show the 6"
gas line to be located approximately where it was installed.
However, at a preconstructlon conference, the conflict In ques-
tion was discussed and the tins was to be placed to the west of
the proposed position where no conflict would exist.

Dear Mr. Monaghan,
Yuur letter of June 5, 19PI raines a concern about the location
of approximately 1500 'oat of V qae main located along the west
boundary of the East Valley Road between station point 19 + 42
and station point 54 + 44. You feel the location of the gas
main could potentially conflict with the sanitary sewer that
runs in the name area and have requested that we hold the City
harmless from any damages that might occur as a result of its
location, Washington Natural i;as Comp., does hereby agree to
hold the City of Renton harmloss from ,.ny damages that are
caused by the deviation of said qas mein from the originally
proposed location.

Sanitary Sewers and Stations
Dear Don.
In response to your letter dated July 14, 1983. we will
proceed with the installation of the lift station.
The 'intent of Section 5-1.01A is for changes requested by
and that benefit the contractor. It was not a requirement of the
specifications to submit this plan. The suggestion was submitted
at the request of the City of Renton and was an effort to make
the City aware of the impact of the monitary value of this decision,
therefore, it does not apply.
Section S-1.08 was not intended to cover situations that are
as drastic or life endanggering as this. We have complied with
Section 5-1.09 and
Per Section 4-I.OS of the standard specifications and the
general provisions of the City of Renton's specifications, we
disagree with your interpretation and will appeal it.
Your letter states that you are withdrawing your offer of
spplitting the power cost, therefore, we will withdraw our offer
oP absorbing the other costs. May this letter serve as notice
that Cascade Septic Service. Inc. w?th pursue compensation for
all coats related to this change per the contract documents. This
amount cannot be determined at this time. but will be considerably
greater than the S3,043.00 mentions,; in your letter. As soon as
the amount can be determined, you wiil be notfied.

Having reviewed your letter of July 1, 1983 regarding the location
for the Sanitary Sewer Lift Station, I concur in your request to
reposition the lilt station to minimise the Inpe Ct of existing utilltf es. Regarding responsibilities, 1 believe Section 5-1.OlA
of the Stand+^1 Specifications adequately defines our rf;t,onsf•
bilities.
As for your request for additional compensetlon, 1 find that it
ix not iustifted and it is the re`ore dented. Sections 5-1.08

Sanitary Sewer Lift Station
Dear Don'
In response to your request for our proposed construction
procedure and in response to your June 23, 1983 letter, you will
find two (2) drawings enclosed. One drawing shows the existing
location of the power and telephone and the location of the lift
station per the City of Renton drawing. None of the power or
telephone lines are shown on the plans. The locale of these
Will increase the cost of the installation substantially. it
is our opinion, at this time, that it will likely be in the
$15,000.00 range. It would be necessary to drive H-beams and
utilize 4 x 8 timbers in lieu of steel sheets in these areas because
the conduits and cables conflict with the sheeting for the lift
station. We have contacted Puget Power and they say that their
conduits are basically a temporary by-pass for Boeing and that
service could be disrupted at a charge of $2.646,00. The telephone
company save that their cable+ cannot be disrupted, due to the
delicate computer operation of Boeing. To build the lift, station
as the City's plans show it would necessitate removal (if the
conduits in much the same procedure that we used on 16th. The
telephone company has told us that the ducts are in '1' sections
so these would have to be removed and replaced then encased in
concrete. It would also necessitate the relocation or removal
and replacement of the power lines. Our proposed location needs
t, he reviewed by the City since Cascade Septic Service, Inc will
accept no responsibility,
In review of this situation, it seems that the Citr has a
choice of a Change Order to a scan to be determined later, probably
on A Force Account baste, for the removal and replacement of the
telephone duct and the power or reviewing our proposal and issuing
us a Change Order in the amount of $2.646.00 plus our 15" overhead
and profit. Time is of the essence since this is the last major
eonatruction item to be completed.

Ed's construction procedure is to use 40' 12" H-beano, driv_
them and drop 1" x 8" x 20' sheets in between the H-besma to use a
shoring. We also intend to install 4 dewatering wells. One at each
corner to control the water. In order to maintain the sewage going
into the existing lift station, it is our intent to install a sewage
grinder pump in the existing manhole and pump it into the force
main that run& across Lind into the 15" sanitary sewer, recently
installed by us. We would install a visual and audio alarm.
Then if anything went wrong with the pump we could respond
instantly. On non working days we would come by once a day to
check it. It is our belief that by doing this we will be able to
assure hoeing continual service. We will not be able to proceed
with any of the work on this lift station until the location is
'atermined.
Again I request your immediate attention so we can complete
the project on a timely basis and without env further delay or
damages. If I can be of any further service, please contact me.

Dear Dick:
Reading Section 9-1.04 on Force Account work would lead one
to the conclusion that the City is required to pay only one
mark-up for overhead profit and other payments, Since those
mark-ups have already been included in the subcontractor's
billing to the City, there is no ada.cional requirement that
extra compensation be added in. Force Account wort: is a
real bonus to the contractor in that .t gets its out-of-pocket
expenses plus a guaranteed percentage for overhead and profit.
Since the risk factor is removed the profit factor is fixed.
It is my opinion that the Force Account regulations do net
anticipate payments of a fixed percentage to the subcontractor
plus an additional fixed percentage to the prime contractor.
If the contractor refuses to sign the change order, then 1
would suggest that you tell him he must sign the change order
and then appeal the dec'aion through arbitration to the American
Arbitration Association

Dear Nark:
In response to your let ;r of June 21, 1983 regarding the above-mentioned
subject. I agree that we need to work together to get that job done. How-
ever, your claim that there is an unresolved conflict which the City has
not addressed in a timely manner in order to establish delay on the City's
part, and therefore damages, is incorrect.
The only conflict that exists with the structure was brought to my atten-
tion June 10, 1983. The problem was discussed with the superintendent
and the conflict was resolved. However, my solution to the conflict did
not solve the construction problems that exist with the other utilities.
I did state, however, that if your firm wished to make a counter proposal
which would facilitate the station's construction, I would be more than
receptive to review it. To data. you have not submitted said proposal
which conceptually appear to be quite feasible.
In conclusion, I must, therefore, state that I find no grounds for a
claim for delay or damages which ycu have indicated might be due.

In conjunction with the work being performed under the contract
awarded to Cascade Septic Service, Inc., certain extra work was
required to be performed both by the prime contractor and his
subcontractors. In preparing the Change Ordrr, I followed the
specifications, a copy of which is attached regarding mark-ups.
The prime contractor is arguing that once I have applied the
appropriate mark-ups to his subcontractors' extra work, I should
apply an additional 151 mark-up to cover his r overhead and
profit I do not Interpret the specifications that way, nor have
they been interpreted that way in the past. On specific work
that the prime contractor has performed, the appropriate mark-ups
have been paid. The questloa only pertains to work performed by
his subcontractors, Attached Is a sample of a subcontractor's
extra work submittal.
As you interpret the specifications, does the prime contractor
receive a 15% mark-up on time and materials work performed by
a subcontractor?
If he does not receive the mark-up and he refuses to execute the
Change Order, how do you suggest I proceed.

sanitary sewer lift station, I am not interested in arguing
semantics with you. I am interested in getting the protect
completed within the allotted time. We have discussed this
problem at two weekly jcb meetings since my letter of Mav 27, 1983.
There is a conflict between the access hole, wet well and
the power line. It is unreasonable to assume that we are going
to build a lift station 22' deep with approximately 10 conduits
hanging over our head. These lines are not shown on the drawings.
Per your request. I am preparing a proposal for relocating the

are being damagsd and delayed.

tion that said vases haw actually been paid.
This verification will also be required from your subcontractors

for saw cutting is not the total responsibility of the City. It

Item 2.

Dear Mark:
Yuur letter of May 27, 1983 regarding the Sanitary Sewer Lift Sta-
tion has a number of major errors in fact which need to be clari-
fied. "first, there Is no conflict between the litt station and
other utilities that I am aware of or that have been brought to
my attention.
The conflicts you are purporting exists are construction conflicts
and not actual conflicts with the lift station. As the plans show
the top of the station and wet well are at or below elevation 7.68'
which Is of a sufficient depth to prevent any conflicts.
Again, regarding the purported conflict, if you, as the contractor,
`eel that they could be better handled by a repositioning of the
station within ,he easement in order to facilitate construction, I
would, as always, review your proposed revisions. However, no con-
flict has been specifically defined nor-has there been a specific
raquest submitted for it to evaluate.
Therefore, my actions in no way have damaged or delayed your opera-
tion and I will, in no way entertain a request for damages which are
unearned.

RE: Installation of Lift Station
Dear Don:
The purpose of this letter is to recap the situation
regarding the installation of the lift station. On May 18, 1983
Cascade Septic Service, Inc. informed the City that there was
a potential conflict between the telephone, power and installation
of the lift station. The Citv cf Renton said thev would have the
rest of the utilities located and that Doug would stake out the
corners of the easements and we looked at the possibility of
moving it. On May 25, 1983, Cascade Saptic Service, Inc. again
said that the utilities had been located and asked for the Cicy
to come over and look at it to see what changes could be made.
At that time, you indicated that as far as you were concerned there
was no conflict. I said that it was impossible to sheet the hole
safely and with the power being directly over it and the phone running
across at the other end. You indicated that that was not your
problem. May this letter serve as notice that your decision
Is both damaging and delaying us, As soon as the damages can be
assessed, you will be so informed.
Next week Cascade will physically expose the utilities to
determine the exact extent of the conflict. At which time we
Will supply you with more information.

which Ed signed outlining our position with regard to paving on
the morning in question.
On the morning of May 18, 1983. the pavement had already started
to show signs of failure. These areas are to be replaced at your
cost before any additional paving on S.W. 16th St., east of Lind
Avenue S.W., takes place.
When Ed is ready to remove the asphalt, he can contact Martin who
will paint those areas which wi'1 be removed. All asphalt removed
will be saw cut and the edge: protected until such time as the mix
is replaced.
If you wish to be involved in the decision making process regarding
paving, you should have a representative of the company with decision
making capabilities meet with the inspector and your subcontractor
at the job site each morning prior to paving.

Arrived on project at 5::5 a.m., 5/16/83. 1 called "Tiny" at Segale's office at
6:00 a.m. and told his that subgrade was too wet to put A.T.B. down on. He stated
that Mark Perry had called him at 5:00 a.m. and stated he wanted S.W. 16th St. paved.
I told him that Mark Perry did not determine that, but that I did.
At approxirately 7:30 a.m., Cascade's foteman arrived on project and I told him. that
it 'ue saw the superintendent before we to make him aware that S.W. 16th could not
be paved because of subgrade being too wet.
Between 8:00 and 9a00 a.m., Superintendent asked me about paving 16th and I stated
at that time -.-hen subgrade dried out he could pace or sign a "speed letter" stating
he would be liable for any breaking up of asphalt. He stated "No way am I going to".
At approximately 10:00 a-t,. I vent over subgrade with John ¢ukovich and we both
agreed that some areas were dry enough, but also some areas were still very wet.
I stated to John at this time l did not want to pave for the above r..asons. At 'his
time Project Engineer arrived on the project and I explained the shove to him. A
"Speed Letter" vas written up (see file). Also, at this time I was told that asphalt
trucks were on their way by both John and Ed. At approximately 10:15 a.m. E. Mudge
read and signed the "Speed Letter".
Segale then proceeded to put ATB down on S.W. 16th St.
It should be noted that after first lift of ATB was put down, several areas began
pumping end breaking up. huperintendent sad one area In front of "ARCO" station
dug out and patched.

Dear Don.
May this letter serve as notice that Cascade Septic
Service, Inc- nor it's sub-contractor H.A. S^gale, will be
held responsible for damage due to sub-grade failure. Con.rary
to your belief, we did not direct our sub-contractor to pave
without regards to sub-grade conditions. John Vukonich from
M.A. Segale and Ed Mudge from Cascade Septic Service, Inc.
received permission to pave from Martin without any conditions.
It was not until after extra trucks had been ordered and the
ATB had been processed at Segale's plant that Martin produced
this Speed Letter. The letter was signed under duress. We
were faced with the possibility of buying the AT.B. It is not
reasonable to have us liable for Martin's decision.
I agree that the authorization to pave should come from
Martin but it should be directed to Cascade Septic Service, Inc.
and not to M.A, Segale.

As pw are aware, the excavation for Puget Power's vault number 19
located on the west side of East Valley Road at Station 69 ♦ 60 was
billed to Puget Power as a nnn-overhead conversion cost.
It has been pointed out by Jim Klippert that this vault excavation was
required to provide an underground location for an existing transformer
serving the adjacent storage building.
Therefore, we req %st that the billing for the excavation of this
power vault be charged to the underground conversion cost for the
overhead system which is a part of the City's cost and notify Jim
Klippert that this cost may be deducted from their project bill Ltg.

St. As the width of the street was reduced from five lanes to 36' in the
design process, the ability to use the R/W for parkino was eliminated.
Therefore, provisions should be made to place "No Parking" signs on East
Valley Road as soon as possible, particula* since Sea Galley patrons have
already started to park in the R/W.

an 18" Storm Drain that was not marked. Water from the 18" drrin filled
the new 60" Sewer Line Manhole 07. plus 30' of open ditch in about 20 to
25 minutes. No work could be done the balance of the day. We set up a
6" water pump to remove water from the new line and trench.

The contractor is preparinq to pave East Valley Road north of S.M. 41st
St. As the width of the street was reduced from five lanes to 36' in the
design process, the ability to use the R/4 for parking was eliminated.
Therefore, provisions should be made to glace "No Parking* signs on East
Valley Road as soon as possible, particularly since Sea Galley patrons have
already started to park in the R/M.

Ed Asked about payment on the materials on hand and Don
said that to the best of his knowledge, with the exception
of the controller for the traffic signal , they had all
easily accountable items paid for and Ed Agreed.
Canem was going to start setting bases, foundations for
the lights and when ran out thev were going to start
putting in their junction boxes and then pulling the wire,
The electrical inspector came by and asked that we remove
that: temporary wire from A-Economy.
CASCADE:
Received okav to extend the mainline on 19th in lue of
having to pour a new manhole base for the additional work
there.
Received permission to use some type of repair band instead
of installing a new manhole on the 18" that needs to be
repaired
Evervone agreed that we wanted to be done with 16th St. by
May 1, 1983. That is about the time Longacres starts up.
it was agreed on that Cascade would accept the City's proposal
as far as the repair of the sanitary on 16th.
CASCADE: continued
l Cascade will submit a new schedule next week or so reflecting
a August 26, 1983 completion date revised from May due to
the weather conditions this winter.
Cascade stated ti,at they wished to be paid for the Change
Order 81 at a $1.00 per Yard for all material placed on
East Vallev
MLW
They have repaired their work
They will start pouring sidewalk out front of Yonkers and
then continue north.
Cascade is going to prep from East Valley from A-Economv and
MLW will jump in ar.d pour the curb when it is propped and
fall back and continue pouring the sidewalk
CITY:
Thev asked about the time schedule on getting Lind patched
Cascade replied that they would cry and do it the ,same tir„e
that Segale comes in and starts paving down by : '.c �, uth
and of the project .
Don requested a new schedule
Don asked about the time frame for getting the water services
on l6th to run across the street . Cascade responded that it
would happen next week,
SECALE
will come in the first of next weak and start paving on the
south end of the project from 43rd to where thev left off m
dohnathsns and than jump up ahead up by A-Econo storage and
go around up into Lind

depth for the trenching between S.M. 23rd St. and S.V. 16th St.
as this was not a joint trench area. There was 3,106 L.P. of
trench at $0.21L.f. for a total of $819.16. As the City was
only keeping track of the Quantities, it is necessary that pay-
vent be made directly to Cascade Septic Service, Inc.

Dear Ar. Steensland,
On the morning of March 1, 1963, representatives from the
Boulevard Trucking Company and three members of the City's
staff met with tro at the fill site to discuss the hauling
and filling operations covered by the subject permit.
The outcome of the meeting was that Boulevard Trucking would
improve the haul road into the site and keep the city mad-
way clean. The city would work with Cascade Septic Service,
contractor for LID #310 , to see if more water could be. allowed
to drain off of the site.
These fa-ts were established, if tracking of mud onto the
city roadway occurs, the city will write citatior, to you, John.
as representative of the Austin Company and to Boulevard Truck-
ing, as well as stop work at this site.
There wao also a request by Boulevard Trucking to run their
equipment at night. However, 1a)n Miller, Public Works Field
Superintendent, had previously made the decision not to allow
this. Since Mr. Millur was unable to attend the meeting, his
decision will stand until he has reason to change it.
This item was not mentioned but it would be advisable for
Boulevard Trucking to contact Cliff Bates, or sense other person
in the Street Division, to chock the rework to the haul road
prior to restarting hauling into the site. Th. phone number
is 235-2615. Also, check with Mt. Gary Norris, Traffic Division
on signage needed for the area.

Boulevard is filling the land, with dirt, on the corner
of 16th and Lind. They are tracking a great deal of mud onto
16th, which is a newly paved street, then sweeping the mud
into the catch basins recently installed by us. In the process,
they are tearing up the pavement and disturbing the condition
of the subgrade underneath the paving.
Cascade Septic Service. Inc. will not be responsible for
the damages being caused by their actions. If you have any

Per our agreement each of those days, in the morning, there was
more than a forty (40) percent chance of rain, even though
it did not rain daring the day. Therefore, these days sb uld
not be charged.

Subject: Update on L.I .D. 714
At present Puyet Sound Power s Light Co. and Washington Natural Gas
Co. are installing their facilities on East Valley Road and S.W. 16th
Street. Our contractor, Cascade Septic Service, Inc., is completing
the various utility crossings and connections on East Valley Road 6
S.W. 16th St. These cros•,ing should be completed by mid-March.
Depending upon the weather, the Contractor will proceed to complete
the curb and gutter on S.W. 16th St. and East Valley Road. Once this
is completed, placement of the paving can proceed. The sidewalks and
street 1!ghting installation will parallel the curb and utter and
paving operations, but may continue after they are completeo. It is
an^icipated that the paving on East Valley Road and S.W. 16th St. will
be completed by the end of May.
While the work on East Valley Road and S.W. 16th St. Is proceeding, the
contractor and utility companies will be Installing their underground
facilities in S.W. 27th St. and S.W. 19th St. Once the onde,yround
work has been completed, the contractor will proceed to Install the
surface improvements on these streets with s prohobie completion In
August of this year.
The sanitary sewer installed in S.W. 16th St. has some problems which
will require that portions of the line be relaid. - e contractor is
currently proceeding with a cleaning, pressure grouting and television
inspection program to re-evaluate the magnitude of the problem with the
I'ne. Once this has been completed, he will proceed to correct the
problems. It is not known when or how Ionj this repair will take, but
It will be pursued as diligently as weather and ground conditions per-
mit.
Once the sanitary sewer on S.W. 16th St. is repaired, the Contractor will
continue laying the sewer on Lind Ave, S.W. and commence construction of r

the sanitary sewer lift station at S.V. 19th St. and Lind Ave. S.Y.
After the sewer has been tested, the contractor can proceed with the
Improvements and signaliiation at S.V. 16th St. 6 Lind Ave. S.Y.
It Is projected that all phases of the project will be completed by late
fall, with the L. I.D. hearings before the end of the year.

Dear Don:
On February 22, 1983, while installing a catch basin
at Station 93+65 as shown on the revised prints, we encountered
an existing telephone duct in conflict with the catch basin
in question. We were not able to install the catch basin as
shown on the plans because of this conflict. This has resulted
in an extra cost to our company which cannot be fully evaluated
until the conflict is resolved and for which we expect to be
compensated.

Replying w your letter of January lsth; it would make no sense whatsoever to stop
woyk at S.W. 9th as It will be completed in two weak$. The 245 will have all ptpe
laid along Last Valley to two or three days. The 1811 will make the connection
Where the 245 started within two weeks. I was on the Joh with you at It,0 today
and the job was going slog very nicely -- pipe was being laid in the box, no
material was Being wasted and the %star situation was being handled. The ponds nn
\ both sides of S.W 19th are being Iw red by lettkig water Re into the 60-inch line
/ and the water table to being lowered, helping the entire Job, and will also help
you in the future. When :has# lines are connected in full the water table will be
going d..wn as the ponds drain Into the 60-inch line.
As'lar as compaction Roes, the pit rue is going into the trenches and we are com-
pacting it to the best of our ability under present conditions. The trucks are
running on it and compaction equipment is compacting it. This gravel will drain
out in the next two or three months and it will be as tight as concrete. Vou must
remember, you wilt Se going back and partia:ly excavating he new trey h over again
with the installation of the new sanitary sewer, which will be between the 12-imh
waterline and the new 60-inch storm line. Your grade will be within a foot or two
elevation of the 60-inch.
As you at►ted, it will benefit you because we are putting this hsdding material
around the 60-inch pipe and it will keep your trench dry if, a% T suggested, you
put a pump deep tern the bedding gravel. I do not believe you will have any
problao whatsoever as you have to partially excavate this same trench, and by con-
tinuing on and getting this work done it will lower the water table.
If the City of Renton would like to take a test on the compaction done today, we
would he happy for them to do so, and, if need be, we will hit it again before you
come in to do the sanitary line. All our work will be cleaned up and free-drain-
Ing when we leave the project.

Dear Frank-
The purpose of this letter is to recap the events regarding
the installation of the 60" storm cn SW 19th St. . Both the
Citv ar4 Cases& have suggested to Frankie and Vince that You
should i .,o working due to the water levels of the pond and
the moisture content of the material beins placed around the
pipe. You have a great deal of experience and an excellent
reputation Based on these two factors, it was decided that
yoi* could proceed. even though you were not meeting the spec-
ifications, if you would submit in writing a letter saying that
You will accept full responability and later, if necessary,
bringing the material up to the compaction required. Also,
the agreement was that you would leave the elevation of
19th St. approximately 1' above sub-grade and that all
materials removed during the day would be compacted that night
so that the moisture content would not go uo if it rained.
You have rot done this . Your letter of January 12, 1983 does
not specifically address these items. We responded with our
letter dated January 13. 19U, again asking that you cover these
items specifically and accent full responsbility.
Enclosed You will find a copy of a letter from the
City of Renton again stating that you are not meeting the
compaction requirements and that you will he totally responshile
for any deficiencies at your awn expense. 1 again request ,
in writing, that opu state that You will accept responsiblity
and that You will leave the pre-load approximately 1' higher
than sub-aade and that the area be compacted when you leave
each night and all materials disturbed during the day will be
compacted. If we do not receive this letter by Monday, January 17,
1983, we will atop you from continuing to work.

We are in receipt of your letter dated 1-12.83. The content
of the letter is fine, however, we feel it needs to be more
complete before we can present it to the City of Renton. You
do not state what you will do after the 60 to 80 days. It is
important to us that you put in th a letter the intent of what
you will do to cause this material to be up to the City's spec-
ifications at the end of 60 days, weather permitting. Also
state that you will prove to the City of Renton that the compaction
is up to specifications (90%) . Also as agreed verbally, you will
write your intent to leave the areas that you are working mounded
and compacted to the best of the ability o: the soil at this time ,
therefore allowing it to dry out.
In order to continue construction on the project, we ask
that ,you respond immediately.

1 have reviewed the television tape of the 18" sanitary sewer
line in S.M. 16th St. between Raymond Ave. r. .W and Lind Ave. S.Y.
The line is not laid to a uniform grade and it has excessive infil-
tration due to separated joints and porous pipe.
Enclosed Is a copy of the Inspection reports for your review. This
sectlon of sewer line is unacceptable in Its current condition and
you will be required to correct the problems by re-laying the line.

Subject: 60" Storm Installation on S.N. 19th St.
Dear Mark:
Please be advised that 1 have verbally received the results of the
compaction test on the trench over the 60" storm line on S.M. 19th
St. east of Lind Ave. S.Y. and they do not meet specifications.
Therefore, you will be required, at your expense, to do whatever Is
necessary to secure the specified compaction on the trench line.
Also, since your subcontractor's operation cannot comply with the
specification as regards to compaction, you will be required to
correct all deficiencies at your expense. This corrective action
will Include, but not be limited to, replacing, as needed, the
Class 1*51' pit run material which has been unnecessarily wasted as a
result of the method of operation and time of Year chosen to do the
work.
Please so advise your subcontractor and advise what correction ac-
tion you propose to take.
