AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
APPROVING AND CONFIRMING THE ASSESSMENTS AND
ASSESSMENT ROLL OF IDCAL IMPROVEMENT DISTRICT
NO. 314 FOR THE CONSTRICTION AND INSTALLATIOY OF
SANITARY SEWERS, WATER MAIN, FIRE HYDRANTS, CURBS,
Gl'TTERS, SIDEWALKS, STREET LIGHTING AND ALL
NECESSARY APPURTENANCES IN THE VICINITY OF EAST
VALLEY HIGHWAY AND S.W. 16th ST. FROM SR 167 RAMP
NORTHERLY AND WESTERLY TC LIND AVENUE S W. , RENTON,
KING COUNTY, WASHINGTON, BY D"INC ALL WORK NECESSARY
IN CONNECTION THEREWITH, LEVYING AND ASSESSING

ORDINANCE NO 3396 (LID #314)
WHEREAS the . rsessment roll levying the special assessment
ag,inst the property located in Local Improvement District 1%- , 314.
generally descri _d as construction end installation of sanitary
sewers, w9.ter main, fire hydrants, curbs. gutters , sidewalks. street
lighting and all neceasary appurte..ar.ces in the vicinity of East
V41ley Highway and S.W. 16th St . from SR 167 Ramp northerly and
westerly to Lind Avenue S.W. , Renton, King County, Washington,
created under Ordinance No . 339b, nested January 21 , 1980 has .een
filed with thf City Clerk of the City of Renton. bashington by the
Director of Public Works , as provided by law, and
WHEREAS due notice of the time and p'a:r of hearing thereon
and making objections and pretests to said roll was dciv pub. ished at
and for the time and in the manner provided by law, fixing he time
and place of hearing thereof. f,r April 9, 1984 at the hour of
8 00 P.M in the City Council Chambers, City Hall, Renton, Washington,
and due notice thereof was timely mailed by the City Clark to each
property owner shown o., "aid roll as provided by law and as further
specified in RCW 35.44.090 and said hearing having been duly held as
aforesaid and that proposed assessment ro.l having been withdrawn
following objections and due notice of the time and place of hearing
thereon and making objections and protests to said revised roll was
duly published at and for the time and in the manner l _ded by law,
fixing the time and place of hear:eg thereon for June 4, 1984 at
the hour of 8 00 P t, in the City Council Chambers , City Hall , Renton,
Washington. and :.ur atice thereof was timely railed by the Citv
Clerk to each propccty owner shown on said roil as provided by law
and as further :oecific . it RCW 35 44 090 and said hearing having been
duly held as aforesaid, and
WHEREAS at the time and place fixed and designated in said
notice, said hearing on bai,, assessment roll resulted in the following
protests and!or objections , as received by the City Clerk prior to.
at and during said public hearing, to-wit -

and the City Council having duly considered said assessment roll
together with the written protests filed in connection therewith, as
aforestated, and having duly considered said protests, and the Citv
Council sitting and acting as a Board of Equalization for the purpose
of considering the roll , benefits to be received by each lot , parcel
and tract of land shown upon said roll, including the increase and
enhancement of the fair market value of each such parcel of land by
reason of said improvement,
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON.
WASHINGTON, DO ORDAIN AS FOLLOWS
SECTION I: That the assessments and assessment roll o°
Local Improvement District No. 314 which bus been created and established
for the purpose of paving the cost of construction and installation
of certain water mains, hydrants, and appurtenances thereto, and all
as more particularly described in Ordinance No 3559, further reference
hereby had thereto, and all in accordance with said Ordinance, be and
the same is hereby in all things approved and confirmed, so that the
total amount of the assessments and assessment roll of said Local
Improvement District is in the sum of $ 7,056,579.90.
SECTION II: That each of the lots, tracts , parcels of land
and other property _hewn upon said assessment roll is hereby determine,!
and declared to be specially benefited by said improvement in at least
the amount charges against the name, and the assessments appearing
against the sane are in proportion to the several assessments appearir�
upon said roll There is hereby levied and assessed against each lot,
tract or parcel of land, or other property appearing upo said roll .
the amount finally charged against the same thereon.

SECTION III . That the assessment roll as approved and
confirmed shall be filed with the Director of Finance for collection
and said Director of Finance is hereby authorized and directed to
publish notice as required by law, stating that said roll is in his
hands for collection and that payment of any assessment thereon or
any portion of said assessment can be made at any title within thirty
days fror, date of first publication of said notice, without penalty,
interest or cost and that thereafter the sum remaining unpaid may be
paid in ten equal annual installments with interest thereor, fixed at
an estimated rate of _ 12 % per annum, except that if the net
effective interest rate fixed on the local improvements bonds hereafter
issued for Local Improvement District No. 314 is other than 11 ;.
the interest rate on the unpaid assessments shall be revised to a
rate of 1,2 of It in excess of the net effective interest rate on
such bonds, such rate to be fixed hereafter by ordinance. The
first installment of assessments on the assessment roll shall become
due and payable during the thirty day period succeeding th, date one
year after the date of the first publication by the Director of
Finance of notice that the assessment roll is in his hands for
collection and annually thereafter each succeeding installment shall
become due and payable in like manner. If the whole or any portion
of the assessments remain unpaid after the thirty day period, interest
upon the whole unpaid sum shall be charged at the rate as determined
above, and each year thereafte: one of the installments, together with
interest due on the unpaid balance, shall be collected. Any installment
not paid prior to the expiration of the thirty day period during which
such installment is due and payable shall thereupon become delinquent .

All delinquent installments shall be subject to a charge for interest
at the rate specified above and for an additional charge of _10 ti
penalty levied upon both principal and interest due upon such installment
or installments. The collection of such delinquent installments will
be enforced in the manner provided by law.
SECTION IV: All of such assessments or installments thereof
nd interest and penalty , if any thereon, when collected by the
Director of Finaice shall be paid into Local Improvement Funa,
District No. 314 of the City of Renton as created by said Ordinance
No. 3396. and shall be used solely for the purpose if paying the
principal and interest on the warrantF ind bonds drawn upon or issued
against said Fund, or in case no bonds have been issued, then in
payment of an_- installment note or notes as provided for in RCW
35.45. 150 as may he determined by the City Council of the City of
Renton.
SECTION V. This Ordinance shall be effective upon its
passage, approval and five days after publication.

The project shall con:;ist of the wideninq and improvement of East Valley
Road from S.M. 41st Street to S.M. 16th Street to 36 feet curb to curb;
the widening and improvements of S.N. 16th Street fror East Valley Road to
Lind Avenue to 36 feet curb to curb; the construction of S.Y. 27th from
East Valley Road to the proposed Valley Parkway 36- and 44-feet curb to
curb; and the construction of S.M. 19th from East Valley Road to Lind Ave.
S.N. 36 feet curb to curb.
Improvements shall consist of surcharging, gradirq, paving, illumination,
curb, gutter, sidewalk, storm drainage piping, installation of water and
sewer piping, construction of a sanitary sewer lift station at Lind Ave.
and S.M. 19th, and construction of a traffic signal at Lind Ave. and S.M.
16th.
