Said heretofore rrntioned grantee, its successors or assigns, shall

of constructing, maintaining, repairing, altering or reconstructing said
utility, or raking any connections therewith, without incurring any legal
obligations or liability therefore, provided, that such construction, main-

accomplished in such a canner that the prtvate inproverents existing in the right
right(s)-of-way shall not be disturbed or damaged, or in the event they are
