It appears to say that persons connecting to the sanitary sewer facilities in the special assessment district shall pay the fee. Since your memo indicates that your connection will be outside of the Honeycreek Sewer Interceptor service area, then it would not appear that the charge should be levied on the senior housing. If this does not resolve the issue I would suggest that we establish a meeting with the utilities division and fully explore the issue. This property is Induced in the Hcneycreek Sewer j Int>rteptor Service Area-as marked on the attached Ordinance copy. However, since i we knew that the proposed building would not be connected to sanitary sewer facilities In the Special Assessment District,the existence of this latecomers agreement seemed to be inconsequential. i " We have now learned that the Utilities Engineering Division intends to levy the Special Assessment Additional Fees when the short plat application is processed, because a small portion of one wing of the building will overlap onto the edge of the Bales parcel. The attached sketch shows the proposed building footprint and site lot lines,together with the planned location of the new sewer line wnich will connect to the Krkland Avenue N.E. sewer main via NE 16th Street, outside the Hcneycreek S,wer Interceptor Service Area. Perhaps our interpretation of the Ordinance(and in particular Section II the, is open to correction. We are requesting your opinion as to whether or not this project will be subject..to the special assessment additional fees, based on the description provided in this memo and attachments.
