The download and/or use of this software is only authorized if you are an original purchaser (or an authorized Beta evaluator) of the PACTware software from one of the PACTware consortium member companies KROHNE Messtechnik GmbH (“Licensor”). If you are an original purchaser of the PACTWARE PSsoftware, this software is subject to the same terms and conditions agreed to upon original purchase of the PACTWARE PSsoftware (see "software license" below). NOT AUTHORIZED to install, download, copy, or use or otherwise benefit from this software. FURTHER, IF YOU ARE NOT AN ORIGINAL PURCHASER (OR AN AUTHORIZED BETA EVALUATOR) OF THE PSACTWARE SOFTWARE, INSTALLATION AND USE OF THE SOFTWARE WILL SUBJECT YOU TO ANY AND ALL LIABILITY ASSOCIATED THEREWITH UNDER APPLICABLE LAWS. Authorised installation of this software in no way transfers title or ownership of the software to the recipient. Title and ownership remain with the PACTware Consortium. If you agree to these terms and conditions proceed with the software installation. IF YOU DO NOT AGREE WITH ANY OF THE ABOVE TERMS AND CONDITIONS, DO NOT PROCEED WITH THE SOFTWARE INSTALLATION; CLICK ON 'NO' BELOW. By installing, copying, or otherwise using the PS, you agree to be bound by the terms of this Enduser Licence Agreement (“Eula”). SOFTWARE LICENSE 1. LICENSE GRANT All software programsPS which are is embodied in human readable source form or machine readable object form and which includes, but are is not limited to, programs having a series of instructions, statements and data, and related materials provided by the PACTware Consortium e.V. are is the property of the PACTware Consortium e.V. and/or others and are subject to the terms set forth in this License, in which Purchaser (of this License, in furtherance “Licensee” ) is provided solely with a personal and nonexclusive license to use such programs solely for their internal business purposes in the country in which the software was furnished and for execution on the system for with which it was provided. Licensee may install only one copy of the PS on his computer file server within his personal system. Licensee may not transfer the present licence to third parties nor grant sublicenses. 2. COPYRIGHT AND TITLE No title to the intellectual property in the software programs or material is transferred to Purchaser under this license. All software and its copyrights are owned by the PACTware Consortium e.V. and/or its suppliers. The software is protected by copyright laws and international treaty provisions. Therefore, Purchaser must treat the Software like any other copyrighted material (e.g., a book or musical recording) except that Purchaser may make copies of the programs for use only with the system for which such programs were acquired and as far as necessary for backup purposes. Purchaser must reproduce and include the copyright notice on any backup copy, provided that the backup copy is not installed on any computer. Licensee may not remove or otherwise alter any copyright notices on the PS or any of its copies. 3. RESTRICTED USE: Purchaser Licensee shall not export or re-export the programs or material without the appropriate licenses. Purchaser Licensee agrees not to reverse engineer, decompile, or disassemble or otherwise alter the Software or otherwise attempt to discover the source code or create a new installer for the PS. Purchaser Licensee may not rent or lease the Software to any third parties, but may transfer the Software and written materials on a permanent basis provided no copies are retained and the recipient agrees to the terms of this Software License. 4. NO WARRANTY Licensor expressly disclaims any warranty for the PS. The PS is provided “as is” without any warranty of any kind, especially the running of the PS or the use for a special purpose. The entire risk arising out of the use or performance of the PS remains with the Licensee. This does not apply for intent or gross negligence behaviour of the Licensor. 5. TERM AND TERMINATION The present licence is granted for an unlimited period of time. The licensor may at any time terminate this Eula with immediate effect, if you fail to comply with the terms and conditions of this Eula. In such event you must destroy all copies of the PS. 6. APPLICABLE LAW; JURISDICTION This Eula is subject to the laws of the Federal Republic of Germany. Place of jurisdiction is solely Duisburg. 7. SEVERANCE If any part of this agreement is found void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms.
