LOCATION: 2514-2520 N.E. Ninth Place SUMMARY OF REQUEST: Applicant seeks site plan approval for a ten unit residential complex on two contiguous vacant parcels, zoned to permit multi-family development. COMMITTEE REVIEW: The review was conducted at 9: 00 a.m. on, April 2, 1990, in the Renton Municipal Building. The Committee review was conducted after receiving written comments from all divisions of the Public Works Department, all divisions of the Community Development Department, and the Fire, Police, and Parks Departments. The following exhibits were entered into the record: Exhibit No. 1 Yellow file containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit No. 2 Site plan (amended and received February 26, 1990) Exhibit No. 3 Landscape plan (amended and received February 26, 1990) . Exhibit No. 4 Building elevation plans. Exhibit No. 5 Utility and grading plan. Exhibit No. 6 Floor plans. FINDINGS, CONCLUSIONS, AND DECISION: Having reviewed the written record in the matter, the Site Plan Review Committee now makes and enters the following: Findings: 1. The applicant, PABCO, has requested site plan approval to allow construction of a ten unit multi-family development on two contiguous parcels, the western parcel with R-2 (low density multi-family) zoning, and the eastern parcel with R-3 (medium density multi-family) zoning. The proposed development will include three discrete buildings of two stories, including one and two bedroom dwelling units. The structure on the western parcel is proposed to have two townhouses; each of the structures on the eastern parcel is proposed to have four apartment units. Structures will be finished with hardboard shiplap style horizontal siding and cedar trim; hipped roofing will be constructed of composition shingles. The complex is proposed to have 18 parking stalls. Active recreation areas are provided for children; passive recreation and congregate areas are provided for adults. Site Plan Review Commit a Report and Decision April 6, 1990 Page 2 The site is currently vacant, except for one abandoned, dilapidated garage. 2 . The applicant's file containing the application, the State Environmental Policy Act (SEPA) documentation, the comments from various City departments, the public notices requesting citizen comment, and other pertinent documents was entered as Exhibit No. 1. 3 . Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43 .21.C, 1971 as amended) , a Determination of Non- Significance - Mitigated was issued for the subject proposal on March 5, 1990, with the following conditions: a. That the applicant provide revised site plans, in advance of site plan review, which reconfigure Buildings "A" and "B" (either through relocation of structure or reduction in density) to achieve better separation between structures to protect privacy and defensible space, to protect view corridors, to preserve air and light circulation, and to facilitate provision of emergency services. These mitigation measures are designed to address aesthetic impacts, land use impacts, housing impacts, and environmental health (noise, light and glare) impacts. [Note: This information was provided on 2/26/90, to the satisfaction of the Planning Division. ] b. That the applicant be required to provide a plan for insulation of residential units to an interior ambient level of 45 dBA, subject to approval by the Building Division, in advance of the issuance of a building permit. c. That the applicant provide a traffic mitigation plan (e.g. streetlighting, sidewalks, curbs, gutters) subject to approval by the Transportation Systems Division, in advance of the issuance of site preparation/building permits. d. That the applicant develop a storm water management plan, including a 25 year design storage/five year design release rate (determined by approved hydrograph method) , biofiltering swales (or baffled oil/water separators to filter water on the site, and required catch basins, subject to approval by the Public Works Department, prior to the issuance of site preparation/building permits. e. That the applicant provide watermain improvements and sanitary sewer line improvements to N.E. Ninth Place (and/or pay necessary fees) to a fair share, with specific plans subject to approval by the Public Works Department in advance of the issuance of site preparation/building permits. f. That the applicant provide the following construction mitigation measures: 1) an erosion control plan; 2) a plan for periodic watering down of the site; 3) a plan for wheel- washing of construction vehicles prior to their leaving the site; 4) an approved schedule for on-site construction activities, limiting hours of operation; 5) an approved hauling schedule and haul routes; 6) a cash street cleaning bond in the amount of $2, 000.00; and 7) a site/building identification plan (on the site and on the structures in order to facilitate emergency services and inspections) . These plans are subject to approval by the Public Works Department, Planning Division, Police Department, Building Division, and Fire Prevention Bureau in advance of issuance of site preparation/building permits. Site Plan Review Commis e , Report and Decision April 6, 1990 Page 3 In addition, the applicant is encouraged to take the following action(s) : a. Provide a voluntary contribution of $150. 00 per unit for development of regional public recreation areas. 4 . Plans for the development have been reviewed by all City departments affected by the impact of this proposal. 5. The subject proposal is generally consistent with the Comprehensive Plan Map designation which calls for multi- family development on this property. 6. The site plan as presented, provides sufficient parking to comply with the Parking and Loading Ordinance of the City of Renton. 7. The subject site was annexed into the City in 1946 by the Adoption of Ordinance No. 1246. The site was zoned R-2, Low Density Multi-Family Residential (westerly lot) , and R-3 , Medium Density Multi-Family Residential (easterly lot) on November 19, 1979 by the adoption of Ordinance No. 3372. 8. Land use surrounding the subject site is single-family residential, low density multi-family residential, and medium density multi-family residential. Sunset Boulevard runs near the northeast corner of the site at an elevation well-above the subject parcel. 9. The applicant's site plan complies with the requirements for information for site plan review. 10. SITE PLAN APPROVAL CRITERIA Section 4-31-33 lists ten criteria that the Hearing Examiner is asked to consider along with all other relevant information in making a decision on a Site Plan Approval application. These include the following: a. Conformance with the Comprehensive Plan, its elements and policies; As noted in Section #5, above, the proposed development is generally consistent with the Comprehensive Plan Map designation which calls for medium-density multi-family housing for the entire site. The density level proposed for the easterly lot directly conforms to this designation and to the underlying R-3 zoning. Low density multi-family residential development is proposed on the westerly lot, based upon the underlying low-family residential use (R-2) zoning. Similarly, the proposed multi-family residential complex is compatible with Comprehensive Plan Goals, Objectives and Policies for Residential Development (Section IV) , for Urban Design (Section III) and for Landscaping (Section II) . b. Conformance with existing land use regulations; The residential complex (as proposed and/or recommended) generally conforms to land use regulations/development standards (e.g. density, height, set backs, coverage) established in the Zoning Ordinance for R-2 (Section 4-31-7) , low-density multi- family development and for R-3 (Section 4-31-8A) , medium density multi-family development. • Site Plan Review Commie •e , Report and Decision ; April 6, 1990 Page 4 , The planned/recommended development also is generally consistent with requirements set in the Landscaping Ordinance (4-31-34) (e.g. number, size and diversity of plantings) and in the Parking and Loading Ordinance (Chapter 14) (e.g. number, size and dimension of spaces, location and dimension of driveways and maneuvering areas) . [Note: Because two separate sites are included in this development, and because some of the required improvements for the R-3 parcel are located on the R-2 parcel, provisions will need to be made to ensure that the two portions of the development are maintained as a single complex -- this could be achieved either through conversion from two lots to a single lot, or through use/access agreements (e.g. restrictive covenants, easements) which run with the property. ] c. Mitigation of impact to surrounding properties and uses; Staff identified potential impacts from the proposed project to the surrounding properties in the following areas: aesthetics, noise, light and glare, traffic circulation, and public utilities. The Environmental Review Committee issued a Determination of Non-Significance - Mitigated, for this project on March 5, 1990, with conditions developed to address the above-defined environmental impacts (See Section 3 above) , as they would affect surrounding properties. Similarly, conditions established in conjunction with this site plan review are intended to mitigate impacts from the proposed development. For example, proposed design and location of buildings, parking and service areas, recreation areas, landscaping, and screening at all site boundaries (combined rockeries/ retaining walls, new solid wood fencing, and existing solid wood fencing, six feet in height) provide an acceptable level of separation/privacy between the site and abutting developments, providing privacy and defensible space for residents and neighbors (this amenity will not fully visually separate the site from neighboring sites, owing to changes in grade and building heights, but should be designed to improve privacy for first floor residents, visually separate the site from the parking area of the property to the east, contain vehicular light and glare, and provide property definition These improvements also offer a more attractive view for residents of neighboring developments and passersby. Improvements required to the right-of-way should result in more efficient, safer circulation for project- generated vehicles (approximately 60 ADWVTE) and pedestrians, as well as local non-project related traffic. Further, upgrading of off-site utilities lines should result in better services to the neighborhood as a whole. Finally, on-site recreation facilities, together with a requested contribution to the improvement of local public recreation facilities, are planned to mitigate impacts to those neighborhood recreation areas. This proposed multi-family residential complex provides an appropriate transitional use between single-family Site Plan Review Commi" :e Report and Decision April 6, 1990 Page 5 residences to the west and south, and more densely designed multi-family developments to the north and east. Improvements to this essentially vacant site, which is overgrown with vegetation, should enhance the appearance of this section of N.E. 9th Place. It may also enhance the attractiveness of nearby commercially- zoned sites for new development or redevelopment, thereby improving the viability of the neighborhood as a whole. d. Mitigation of impacts of the proposed site plan to the site; Staff identified potential impacts from the proposed project to the subject property in the areas of aesthetics, noise, light and glare, and traffic circulation. As noted above, the Environmental Review Committee issued a Determination of Non-Significance - Mitigated, for this project on March 5, 1990. In that document, conditions have been established to address the above- defined environmental impacts to the site (See Section 3 above) . Similarly, conditions established in conjunction with this site plan review are intended to mitigate on-site impacts. Proposed plans for design and location of structures, recreation areas, landscaping (including retention of significant trees) , screening (e.g. boundaries, patios, parking areas) , access and parking plans, and entry way signage plans have been developed in a way which generally promotes an attractive, safe, functional development for residents and visitors. For example, the recreation areas and congregate area (with covered seating, lighting, and plantings) are located so that they are accessible and visible from all residential structures, but are sufficiently separated from living areas so that there will be no undue noise to those areas. The landscaping and screening are designed to provide an attractive view and to enhance separation between disparate activities (e.g. living areas, recreation areas, parking areas, dumpsters) . All dwelling units will have screened patios and adjacent exterior storage facilities. Staff will recommend minor modifications to the proposed exterior lighting plan to enhance appearance, and to improve efficiency and safety of routine operations and for emergency management. e. Conservation of area-wide property values; The proposed development is generally anticipated to have a positive impact on property values since the proposed residential complex will be located on a currently unimproved property and will provide residential development in an area where such development is appropriate. f. Safety and efficiency of vehicle and pedestrian circulation; The proposed development is anticipated to generate approximately 66 ADWVTE (ITE Report) . Proponent proposals and City recommendations for pedestrian linkage (48" wide sidewalk) and vehicle access and circulation routes, exterior lighting, and signage should facilitate safe passage to and through the site. Site Plan Review Commi :e Report and Decision April 6, 1990 Page 6 g. Provision of adequate light and air; The proponent's project design, in combination with conditions established in conjunction with environmental review, provide for separation of buildings from neighboring sites, and for open space and recreations areas which are adequate to ensure an environment which offers sufficient light and air to both residents of the proposed and of neighboring dwelling units. h. Mitigation of noise, odors, and other harmful or unhealthy conditions; Residential structures have been located at a sufficient distance from one another and have been sufficiently improved with interior insulation (by Building Code requirements and Environmental Review Committee conditions) so that interior sounds will not migrate to/from other on-site activities or neighboring developments. Similarly, requirements for screening, for site boundaries as necessary, for private patios, and for parking areas should reduce noise impacts to dwelling units. Because the site is proposed for residential use, odors and other unhealthful conditions are not anticipated. i. Availability of public services and facilities to accommodate the proposed use; and Public services and facilities are generally available to the site, with current resources and/or with improvements provided by the applicant. Emergency service resources (fire, police) are adequate to provide for anticipated service needs. Standard requirements for signage, access, sprinklering, alarms systems, and similar improvements will facilitate efficient service provision. Renton School District officials report that the anticipated three school-aged children can be accommodated at Highlands Elementary School, approximately one-quarter mile to the south of the site, McKnight Middle School, approximately one-quarter mile to the north of the site, and Hazen High School, approximately 1-1/2 miles to the east of the site. Highlands Park and North Highlands Park, two quite small neighborhood parks, are within one mile of the site. Because there is a need for additional neighborhood facilities to serve the growing residential community, the applicant has been requested by the Environmental Review Committee to make a voluntary contribution of $1500. 00 ($150 per unit) to improve existing facilities and create new ones. Gene Coulon Park, a regional facility, is approximately 1- 1/2 miles west of the development. In conjunction with the issuance of building permits, the Public Works Department will require that the proponent improve existing water mains on N.E. 9th Place to accommodate this development. Standard off- site improvements (e.g. curbs, sidewalks, gutters and streetlighting) will also be required at that time. Site Plan Review Commi :e Report and Decision April 6, 1990 Page 7 Storm water runoff management system development requirements were also established in concept in conjunction with environmental review (See Section 3) . System specifications will be established by the Public Works Department at the time of building permit. j . Prevention of neighborhood deterioration and blight. The development is seen by staff as having a positive impact on the existing residential and commercial neighborhoods, serving as a transitional use between those developments, and contributing to the local neighborhood identity by supporting existing services and businesses. Conclusions: 1. The subject proposal generally complies with the policies and codes of the City of Renton. 2 . Specific issues raised by various City departments and focused on were: a. Aesthetics b. Noise, light and glare c. Traffic circulation d. Public Services/Utilities 3 . The proposal essentially complies with the Comprehensive Plan designation of Medium Density Multi-Family Use. Decision: The site plan for PABCO apartments, file no. ECF; SA 001-90, is approved subject to the following conditions: 1. That the applicant comply with all conditions established in conjunction with the Environmental Determination of Non- Significance, Mitigated, issued on March 5, 1990. 2 . That the applicant ensure that the two separate lots included in this development are maintained as a single complex -- because some of the required improvements for the R-3 parcel are located on the R-2 parcel -- either through conversion from two lots to a single lot, or through use/access agreements (e.g. restrictive covenants, easements) which run with the property. The newly developed single property or the use/access agreement must be approved by/filed with the City of Renton and duly recorded with King County. 3 . That the applicant provide a revised exterior lighting plan with additional decorative pole lighting fixtures to fully illuminate: a) the parking area; and b) the south side of the site in the landscaped area (if that area is not sufficiently illuminated by street lighting) . 4. That the applicant provide a landscaping maintenance bond in the amount of $2, 000. 00, to be valid for a period of three (3) years, and to be deposited into the appropriate City fund, with the bond being subject to the approval of the City Attorney, in advance of the issuance of site preparation/building permits. The Committee on February 7, 1990, decided that your project may be issued a Determination of Non-Significance-Mitigated with the following conditions: 1) That the applicant provide revised site plans, in advance of site plan review, which reconfigure Buildings "A" and "B" (either through relocation of structure or reduction in density) to achieve better separation between structures to protect privacy and defensible space, to protect view corridors, to preserve air and light circulation; and to facilitate provision of emergency services. The property is zoned R-3 (Medium Density Multi-Family) and R-2 (Low Density Milti-Family) . Buildings will be two stories on the R-3 portion and one story on the R-2 portion. Access to the site will be from a single curb cut on N. E . 9th Place which will be improved with curb, gutter and sidewalk along the site frontage. Eighteen (18) parking spaces, located mostly at the back of the site and not visible from the street, will be provided. Particular care has been taken to site the buildings to provide maximum livability and privacy while minimizing impact on adjacent properties. General Location: The site is: located in Section 9 Township 23 N, Range 5E on the North side of N. E . 9th Place. The western boundary is approximately 132 feet East of Edmonds Avenue N. E . . The site averages 150 ' deep. The Cortina Apartments are adjacent to the North and the Frederick .1 Apartments are adjacent to the East. (See attached legal description. ) B. I shared staff concerns regarding too high density, limits on view corridors, need for additional distance from neighboring multi-family uses, need for improved/relocated residential amenities and parking. Mr. Custer and Mr. Butrim were not receptive to the specific changes proposed by staff. They were, however, amenable to making some changes to residential density by eliminating one of the townhouse units and increasing outdoor play areas; they will look at other changes, as well, with an eye toward achieving goals set by the City. They would like to retain building orientation, which is away from neighboring homes. They also point out differences in topography, which serve, in part, to mitigate proximity of those units.
