Whether the proposed subdivision conforms to requirements established in the City's Subdivision Code? • The proposed two-lot subdivision generally conforms to Subdivision Code regulations (e.g. reasonable boundaries, suitable size, configuration and dimensions). • 2. Whether the proposed subdivision conforms to requirements established in the City's Zoning Ordinance and Comprehensive Plan for residential development? • The subject property is zoned for single-family use on the Land Use Map and similarly designated on the Comprehensive Plan Map. Proposed lot size, dimensions and configurations are consistent with code requirements; the proposed lots are sufficiently large to accommodate single-family homes. Residential development would be consistent with Comprehensive Plan Goals, Policies and Objectives for residential development. 3. Whether the proposed variance is consistent with criteria established in the City's Zoning Ordinance? • The proposed pipestem access to Lot 'B" is permitted by the Zoning Ordinance and the Subdivision Code; the planned action also conforms to Fire Code regulations and Transportation Systems Division policies/standards. The property is 100 feet in width and 189 feet in length. Given this configuration it . would only be possible to subdivide the property under Code provisions with either a variance for a pipestem access or a variance to allow two non-compliant lots (e.g. too-narrow widths, impermissible lot width/depth ratio). Based upon these • circumstances, together with the precedent for pipestem lots in the area, and the confirmation by various City departments of the viability of the proposed access to the lots,it appears that the proposed variance can be supported under the Variance Criteria in the Zoning Ordinance. 4. Whether the proposed subdivision and variance would have any deleterious impact upon neighboring land uses? The subject property is located in an area which is generally developed with single- family homes. There are a number of vacant lots in the area as well. No undue burden to the City is anticipated with maximum development of the site and vicinity properties: 5. Whether the proposed subdivision is supportable by underlying public services/infrastructure? • The Fire Prevention Bureau and the Police Department do not anticipate any . difficulty in providing service to the subject property with the proposed subdivision/variance actions. The Public Works Department reports that no unusual impact is anticipated to transportation, to water service or storm water management --with connections and/ori improvements as required by Code. Because the property is located in the Heather Downs Moratorium District, it will not be possible to provide sanitary sewer service to the property at the time of subdivision as is required. The proponent has obtained necessary deferrals from the • City Council (Utilities Committee) and has received written notice that such connection must be permitted/provided prior to development. Maximum distance to fire hydrant is 300'. Design Engineering: Traffic Engineering: No significant transportation impacts. Utility Engineering: Parks and Recreation: No adverse impacts in the area of recreational needs. Building Division: Approved. Current Planning Division: 1) Recommend approval of 2-lot short plat; 2) recommend variance to allow pipestem access to lot "B"; and 3) off-site street improvements are needed at this location. Long Range Planning: Approval of the short plat into 2 lots does not appear to be a problem. The variance request seems unnecessary and a hardship has not been demonstrated. The existing lot width is 100.7' and section 4-707(c)(2)(a) indicates lot width should be no less than 50'. SUMMARY OF ACTION: Planning Division Recommendation: Approval of both requests. PLANNING DIVISION REPORT: The Planning Division Report was received by the Examiner on March 20, 1990 PUBLIC HEARING: After reviewing the Planning Division Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: MINUTES The hearing was opened on.March 27, 1990 at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow File containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Plat Map The hearing opened with a presentation of the staff report by MARY SAVELA. ASSISTANT PLANNER, who gave the following report. The applicant wishes to subdivide this property to create two parcels for future single family development. Lot B would require the creation of a pipestem to provide access to NE 5th Place. The request complies with the Comprehensive Plan and is located in a single-family area of the city. The request complies with all subdivision regulations with required street frontage, width-to-depth ratio, and when standard improvements are made to the property the Public Works, Fire and Police Departments do not anticipate there will be any undue burdens on public services or city infra- structure. Standard improvements must be completed before the short plat can be recorded. Because the property is located in the Heather Downs moratorium district it will not be possible to provide sanitary sewer service to the site at the time it is subdivided. A deferral has been obtained from the City Council and the applicant has received correspondence stating the,sewer must be connected prior to any development on the property. Continuing, Ms. Savela reviewed the criteria for a variance and noted there is no other way for this property to be developed without a pipestem lot due to its configuration and because it is located in a portion of the city that is almost completely developed. The variance is necessary to provide_the same rights and privileged to this applicant as are enjoyed by other surrounding properties. She said there are other pipestem lots in the northeast Renton area that were platted prior to annexation to the city and without pipestem access these properties could not have been developed. The variance will not be detrimental to the public welfare or other property in the area; there is adequate buffered space between the site and adjacent properties and sufficient visibility and sight distance to provide safe , ingress and egress to and from lot B, with a pipestem access. Planner Savela acknowledged.staff recommends approval of the short plat and variance requests. The Examiner pointed out the suggestion by Long Range Planning that the site could accommodate two 50 ft. wide lots side-by-side and thereby negate the need for a variance, but Savela stated it is a question Ernest Tonda SHPL, V-005-90 March 30, 1990 Page 2 of whether or not the city wants two long skinny lots which would also require a variance because this property would require a 60 ft. width. She believes the variance allows two lots of a better size and configuration than the 50 ft. size alternative suggested by the Long Range Planning staff. ERNEST TONDA, 528 Edmonds Avenue N.E., Renton 98056 asked, and received clarification on the Heather Downs moratorium referred to by staff. He acknowledged he has written confirmation from the city council advising he must be hooked up to sanitary sewer services prior to development of the site. He said at one time there was a house on lot A which was hooked up to city services and he assumes anyone that may build on lot A could automatically hook up to sewers because that property had been hooked up before. Ms. Savela referred him to his letter from the council and told him staff would be willing to work with him to work out further details if he would bring in his paperwork from the city council. The Hearing Examiner said his understanding is that the property, even though divided into two lots, would only be permitted to hook-up one lot to city services. Mr. Tonda said lot A will be developed and lot B will not be developed. The Examiner suggested that the face of the plat should''document the fact that both lots are in the sewer moratorium area and any sewer hook-up must be given city council\approval - in that way anyone purchasing either lot would be aware there may be some potential problems and the lot may not be developable for a certain time period. Savela noted staff's concurrence with the Examiner's suggestion. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:25 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Ernest Tonda, filed a request for approval of a two-lot short plat and a variance for pipestem access. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. 3. The Environmental Review Committee (ERC), the City's responsible official, determined that the proposal is exempt from an environmental assessment. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located in the 2500 block of N.E. Fifth Place, just east of Edmonds Avenue N.E. 6. The subject site was annexed to the city with the adoption of Ordinance 1246 enacted in 1946. The site was classified R-1 (Single Family; Lot size - 7,200 sq ft), its current classification, with the adoption of Ordinance 2497, enacted in August, 1969. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family uses, but does not mandate such development without consideration of other policies of the Plan. 8. The applicant proposes dividing the 19,032 square foot lot into two lots. Proposed Lot A would be 8,000 square feet. It would be 80 feet wide across its frontage along N.E. 5th Place and 100 feet deep. 9. Proposed Lot B, at 11,032 square feet, would have a 20.70 foot wide pipestem providing access to N.E. 5th Place. The main portion of the lot would be 100.70 feet wide by 89 feet deep or approximately 8962.30 square feet in area (less the pipestem which cannot be used in calculating buildable area). The pipestem would be 100 feet long. 10. While the Zoning Code permits development on lots with a width of 50 feet, the Subdivision Code requires new lots to be platted at 60 feet. Pipestem access for residential properties is permitted with a variance. 11. The area is primarily developed with single family homes. The zoning, R-1., reflects this predominant land use. 12. The subject site is located in an area of the city that is subject to a sewer moratorium. New hookups to the system are not permitted without specific authority of the City Council. The Ernest Tonda SHPL), V-005-90 March 30, 1990 Page 3 applicant apparently is permitted to hook up one of the proposed parcels, but written permission was not provided at the public hearing. 13. A ten inch water main runs along N.E. 5th Place. An existing eight inch sewer line also runs along N.E. 5th Place. Storm water is conveyed to the west to an 18 inch line running along Edmonds Avenue to N.E. 6th Place. 14. The subject site is located in the Renton School District. 15. The Highlands Neighborhood Center is located approximately one-third,of a mile north of the site. c CONCLUSIONS Short Plat 1. The proposed subdivision appears to serve the public use and interest. The division will actually create only one additional developable lot by dividing one lot into two. This additional lot is in an area already served by an urban infrastructure, (subject to limitations described below) and will avoid forcing additional development out beyond the urban area. The division for residential purposes is also compatible with the Comprehensive Plan. • 2. Since the site is located within Renton's sewer moratorium boundaries, development on the site will depend upon the availability of sewer service: While some capacity remains in the line, hookup to the sewer system is dependent upon Public Works Department review and City Council approval. Until the applicant has demonstrated such final approval, no new development will be permitted on either of the newly created lots. 3. ' In addition, to avoid any possible misunderstanding by either the applicant or potential purchasers, approval of the subdivision will require that the face of the'plat reflect that the site is within the sewer moratorium area and development is subject to City Council approval of an appropriate sewer hookup. 4. The proposed lots, Proposed Lot A at 8,000 square feet and Proposed Lot B at 8962.30, both meet the minimum R-1, 7,200 square foot lot area requirements of the Zoning Code. In addition, the lots meet the 60 foot minimum lot width requirements. -', 5. The lots are quite regular in shape and generally conform to the development pattern in the general vicinity. Both lots provide the necessary legal frontage, including the pipestem lot (See Variance discussion below). 6. Development of the one'additional lot would increase the school age population by approximately 1 student. Traffic would increase by approximately 10 vehicle trips per day. 7. Other than the sewer capacity situation, the site is served by appropriate city utilities and the Renton School District. Adequate infrastructure is available to support this development. , Variance 8. Variances may be granted when the property generally satisfies all the conditions described in part below: a. The applicant suffers undue hardship caused by special circumstances such as: the size,' shape, topography, or location where code enforcement would deprive the owner of right and privileges enjoyed by others similarly situated; b. The granting of the variance would not materially harm either the public welfare or other property in the vicinity; • c. The approval will not constitute a special privilege inconsistent with the limitations on other property in the vicinity; and J " d. The variance is the minimum variance necessary to .11ow reasonable development of the ,„ subject site. The applicant's property appears ripe for the variance requested. 9. The depth of the subject site, combined with surrounding development, makes development of 1 the subject site difficult, particularly if the applicant wishes to develop lots that meet the Ernest Tonda SHPL, V-005-90 • March 30, 1990 Page 4 general requirements of the R-1 zone. The subject site is approximately 19,000 square feet which is more than double the standards found for R-1 development. The already existing surrounding development would not permit an access road to be provided to reach what would be the rear, or remote lot, with public access. Pipestem access would provide a reasonable means of providing access to this interior lot. 10. The proposed 20 foot wide pipestem would permit access to the interior lot while providing sufficient width to avoid adversely affecting the neighboring lot to the east. The pipestem driveway would simply serve as one more driveway in this area. This access method should not have an adverse impact on the general welfare. 11. The approval of pipestem access is specifically provided in the code to allow access to larger parcels where public roads can no longer be developed. Similar pipestem driveways have been permitted in this and other areas of the city where interior parcels could not otherwise be developed. Approval of the variance would, therefore, not extend a special privilege to the applicant. 12. The Code provides that the pipestem access be at least 20 feet wide. The proposed driveway meets that standard while still providing reasonable development potential on the remainder of the property. 13. In conclusion, both the subdivision and the pipestem are reasonable and provide a means of assuring development that is compatible with surrounding development and both the Zoning Code and Comprehensive Plan. DECISION The two-lot Short Plat is approved subject to the following conditions: 1. The applicant shall have to demonstrate City Council approval of exemption from the sewer moratorium for any development of the newly created lots. 2. The face of the plat shall reflect that the site is within the sewer moratorium area and development is subject to City Council approval of an appropriate sewer hookup. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning pending land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This public communication permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The applicant, Ernest Tonda, is seeking to subdivide a 19, 032 square foot residential property into two lots (Lot "A" at 8, 000 square feet and Lot "B!' at 11, 032 square feet) for future development with single-family use. The property is zoned for single—family residential use (R-1) and is undeveloped. Both of the proposed 'lots comply with development standards established for R-1 properties. Mr. Tonda also is requesting a variance for a pipestem access to proposed Lot "B" . 2 . Various City departments and divisions have reviewed and . commented on the proposal. Discussion of their comments is incorporated in the body of the report. 1 � ! PRELIMINARY REPORT TO 7-7-' . HEARING EXAMINER SHORT PLAT 3 . Approval of a short plat is based on several factors. The following criteria have been established in Section, 9-12-5 of the Renton City Code to assist the decision-maker in reviewing the plat: a. Compliance with the Comprehensive Plan: The Comprehensive Plan Map designates the subject property as Single-Family Residential. The proposal therefore is in keeping with the Comprehensive Plan Map. It also is. consistent with the Comprehensive Plan Goals, Policies, and Objectives for residential development. b. Compliance with the Underlying Zoning .Designation: The subject property is zoned R-1, Single-Family Residential which requires a minimum of 7,200 square feet. per lot. The proposed short plat will comply with the requirements - of the R-1 zone. Proposed Lot "A" will be approximately 8, 000 square feet and proposed Lot "B" will be approximately 11, 0.32 square feet. The configuration of the proposed lots also conforms to the requirements of the R-1 zone and the Subdivision Ordinance. Each of the lots is of sufficient size and configuration to allow full compliance with the required setbacks. When the subject property is developed, the area population will be increased by two families, or approximately six to eight persons. c. Compliance with Subdivision Regulations: The plat as designed meets the requirements for residential plats as follows: 1) Lot "A" has the required street frontage and Lot "B" will have access to the street by way of the pipestem if the variance for the pipestem is granted. 2) Each lot will meet the width to depth ratio. 3) The size and shape of each lot meets the minimum requirements for area and width as established in the R-1 zoning designation. 4) The side lot lines are at right angles to the existing street. d. Level of Burden Short Plat Will Create on Public Services: When the standard improvements (see attached staff comments) are accomplished, the Public Works Department, Police Department, and Fire Prevention Bureau do not anticipate any undue burden to infrastructure or services from the proposed subdivision/variance or subsequent development of the property. The standard improvements must be completed before the short plat can be recorded. Because the property is located in the Heather Downs Moratorium District, it will not be possible to provide sanitary sewer service to the property at the time of subdivision as is required. The proponent has obtained the necessary deferrals from the City Council (Utilities Committee) and has received written notice that such connection must be permitted/provided •prior to development. PRELIMINARY REPORT TO _' HEARING EXAMINER VARIANCE • 4 . The Hearing Examiner, in considering a variance request is asked to consider the following conditions and find that each exists: a. That there are special physical circumstances or conditions affecting said property such that the strict application of the provisions of this Ordinance would deprive the applicant of the reasonable use or development of his land: The subdivision code under Section 9-12-8 (X) (6) (c) (4) allows pipestem lots by a variance application provided that the pipestem lot meets the minimum lot size as required by the. Zoning Code, that the length of the pipestem does not exceed 150 feet, and that the width of the pipestem is a. minimum of 20 feet. The subject pipestem access to the subject lot, Lot "B." , meets each of these requirements. The applicant seeks to provide pipestem access in, the design of the short plat as there is no other way for the property to be developed to its full potential due to the fact that the subject property is located in an area of the city that is fully developed. b. That the variance is necessary to insure such property the rights and privileges enj'oyedby other` properties in the vicinity and under similar circumstances: The granting of the variance request does not appear to grant special privileges based upon the fact that there are a number of pipestem lots in northeast Renton as a result of unusual or unique configuration. of many parcels which were so platted prior to annexation to the City of Renton; without pipestem accesses these properties could not b.e developed. Approval of the variance will insure that present and future owners of the lots will enjoy the same rights and privileges as other property owners in the vicinity. c. That the granting of the variance will not be detrimental to the public welfare or injurious to other property in the vicinity: Staff believe that the granting of the variance will not be detrimental to the public welfare or injurious to other property in the vicinity, based upon the fact that there• is adequate buffered space between the site and neighboring properties, and there is sufficient visibility/sight distance to permit safe ingress/egress for vehicles and to allow safe pedestrian passage. Granting of the variance is, seen to be positive, as well, because this action will facilitate future development of homes on this site. City studies and private market analyses indicate a need for such housing. H. He has requested an exemption from the sewer moratorium. Section III of the moratorium (Resolution 2764) allows Mr. Tonda the right to petition the City Council for the authority to connect to the existing sewer, limiting the existing parcel to one connection not to exceed one (1) EDU. This department would recommend that Mr. Tonda be granted, as stipulated in the moratorium, a waiver of the terms of the moratorium for this one connection to service the existingparcel. Since the above mentioned property is adjacent to a sewer that is listed as being "at or above capacity", this department recommends that no other exemption (allowing more than the one connection) be granted. The Current Planning Division has stated that there is nothing in the City's subdivision ordinance that prohibits a short plat when a moratorium is in effect. Community development would make recommendation to the Hearing Examiner that the plat be approved with a condition stating that there was one (1) EDU available to service the plat (one connection). Most likely, as part of the recommendation, the remaining lot(s) would have a covenant prohibiting development until such time there was sufficient sewer capacity to service them. This:memo is a response to your memo requesting input from the Community Development Department on the request from Mr. Tonda to allow his property to be exempted from the sewer moratorium so he can plat his property. The City's Subdivision Ordinance does not prohibit processing a short plat application when a moratorium is in effect, in this case a sewer moratorium rather than a development moratorium. Further, the moratorium established by the City Council did not prohibit development outright in the sewer moratorium area. Resolution 2764 provides opportunities to create additional EDU's through interim improvements to the . sanitary sewer systems. Thus, the possibility exists that additional EDU's may be available to support the other lot(s) of Mr. Tonda's proposed plat in light of your Department's recommendation to grant one connection to the plat. If the Tonda plat is approved before sufficient EDU's are.available to the site, a recommendation would be made to the Hearing Examiner to approve the plat with a condition stating that there was one (1) EDU available to service the lots in the plat. Most likely, as part of the recommendation, the remaining lot(s) would have a covenant prohibiting development until such time there was sufficient sewer capacity to serve the lot(s). VARIANCE REQUEST TONDA SHORT PLAT JUSTIFICATION A. The geometry of the original lot does not lend itself to being divided into two lots that meet the frontage requirements of the subdivision ordinance. By use of the pipestem, two lots can be created both 'of which meet the square footage requirements . One lot will have 80' of frontage on N.E. 5th P1 . and the depth would be 100' . The lots will be above and look out over Highbury Park to the south. B. The granting of this variance will not be detrimental to anyone in the area. C. This is not a special privilege to anyone. You have only to look at lot 60 and lot 64 in Highbury Park which is located immediately south of this property. They are both pipestem lots. D. This is the only variance needed to accomplish the short plat of two lots.
