Enclosed you will find the construction cost estimates prepared for us by Touma Engineers. This estimate includes the required 150? , bringing the total cost to $ 23,610.00 . Motion: Moved by GUTTMANN, seconded by NELSON, toaccept the deferral request and grant for a 6-month period subject to a bond being posted for 150% of the estimated value of the improvements. MOTION CARRIED b. OFF-SITE DEFERRAL APPLICATION (CURBS, GUTTERS, SIDEWALKS, STORM DRAIN, LIGHTING, PAVING), ROBERT FETTERLY, 956 FIELD AVENUE N.E. Facts: Field Ave. N.E. is improved to King County standards with a roadway section consisting of 28 foot pavement, curb and gutter (rolled) on both sides, and 5-foot sidewalk on the West. Field Avenue terminates with an asphaltic cul-de- sac. Underground drainage is fully constructed in Field Avenue N.E., collecting surface runoffs from the street and directing the flow into a drainage swale along the undeveloped N.E. 10th Street. An 8-inch water line exists in Field Avenue N.E. and a fire hydrant is located on the northwest corner of the property providing adequate flow. Street luminaries recently were placed by Puget Power on wooden poles. Further, N.E. 10th Street is undeveloped. The topography and terrain of N.E. 10th Street is such that it would be difficult to improve that portion;of N.E. 10th Street adjacent to the subject property without considering the entire street from Duvall Ave. N.E. (138th Avenue S.E'.) to 142nd Avenue N.E. • I Discussion: " Staff recommended denial because of the area being close to schools (Hazen High School) based on the need for sidewalks and pedestrian movement. Discussion ensued about the development of N.E. 10th liStreet, the lack of resources in 1990 to develop a profile, and the possibility of accepting a covenant on behalf of the applicant to participate in a future !L.I.D. for roadway development. Motion: Moved by SPRINGER, seconded by NELSON, to defer the curb, gutter, and sidewalk as well as one lane of asphalt and street lighting on N.E. 10th Street subject to a bond being posted for 150% of the estimated value of the improvements; and, that a requirement be imposed that the three lots be covenanted for a future local improvement district in case the City does not require that improvements be installed in the immediate future. FETTERLY File No.: SHPL-008-90 ' LOCATION: 956 Field Avenue N.E. SUMMARY—OF REQUEST: Applicant wishes to subdivide a .93 acre parcel into three lots for the future development of a single family home. SUMMARY OF ACTION: Planning Division Recommendation: Approval. PLANNING DIVISION REPORT: The Planning Division Report was received by the ' Examiner on March 20, 1990 PUBLIC HEARING: After reviewing the Planning Division Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: MINUTES The hearing was opened on March 27, 1990 at 9:30 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing,to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow File containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Short Plat Map. The hearing opened with a presentation of the staff report by MARY SAVELA, ASSISTANT PLANNER. It was noted that NE 10th Street is not a developed street. Field Avenue NE is a street new to the city via a recent annexation, and is a county street with no street improvements; the applicant wishes to subdivide a .93 acre parcel into three lots for future single family development; the property is designated for R-1 development and is directly south of Hazen High School. She pointed out undeveloped property to the east of the property, and adjacent homes which would be compatible on the other sides of the property which are under King County jurisdiction; the subject parcel was recently annexed into the city. The plat meets requirements for a residential plat, has required street frontage, each lot meets the width-to-depth ratio, and the size and shape of the lots meet the " requirements for the area. The Fire and Police Departments do not anticipate any undue hardships will be placed on the infra- structure or services of the city by this proposal. Mr. Fetterly has been advised as a part of the short plat he will have to put in street improvements before the plat is developed. He may apply for a waiver of the improvements until such time as the lots are developed, but as of this time that action has not beenLinitiated. The improvements must be in place before the plat is filed with King County. This property is not located within the sewer moratorium zone. Ms. Savela said staff is recommending approval of this short plat request. Responding on behalf of the'applicant was TOM TOUMA, 15668 West Valley HIGHWAY, Seattle, 98188 who commented on the report as presented saying Field Avenue is a fully developed street with sidewalks on the west side and curbs and gutters on the east side, and meets King County requirements. ' He said NE 10th Street is undeveloped with portions which look like a dirt alley, and the western portion of NE 10th Street is considered to be lindevelopable. ` The Hearing Examiner noted the maps submitted do not show city designated streets or names. , Addressing)the water system, Mr. Touma said staff refers to installation of a system but does not state where it needs to be installed. There is an 8" water line down Field Avenue; to N.E. 10th and east to 142nd; noted the requirement for a'fire hydrant but stated on the NW corner of proposed lot 3 there is an existing fire hydrant which ties into the 8" main on Field Avenue. -` Robert F. Fetterly SHPL-008-90 April 5, 1990 Page 2 r Continuing,-referring to storm drainage, Mr. Touma said staff indicated the system runs different than it really does - Field Avenue slopes to the north toward NE 10th and at the end there is a cul-de-sac where the storm water is picked up and directed west on NE 10th to the system located on 138th Street. He said Mr. Fetterly thought he had all of the improvements, he needed and was not aware he would have to apply for a waiver for whatever is further required by staff. The applicant would have to take up the improvements currently on the site and install new ones if he is to comply with recommendations of staff. The Examiner said the property is no longer under King County jurisdiction and must now be brought up to City of Renton standards for short plat development. He advised the waiver must be applied for and storm drainage and water flow will also have to meet city standards, or, current water lines will have to be upgraded. Mr. Touma advised the Examiner lot #1 now contains a studio-type house and lot #2 currently contains a house. The subdivision of this property will actually only create one more lot on which Mr. Fetterly's son wishes to build a home. The Examiner again noted the plat will have to be re-drawn with City of Renton street designations. The applicant, ROBERT FETTERLY stated his concern about the improvements which he states are beyond his means to accomplish at this time as he is retired. The Examiner advised Mr. Fetterly that he could apply for a deferral or a waiver, and economic hardship is`not necessarily considered to be criteria for approval of either request. He said the city would have to determine if the King County standards would be sufficient or if the development would have to be further upgraded to be sure additional burdens are not placed on the city's infra-structure. • Concluding comments from staff, Planner Savela reiterated that Mr. Fetterly does have the option of applying for a waiver or deferral and it would be up to him to decide if he wished to proceed, but, the plat cannot be recorded until either a waiver is granted or improvements are made to bring the property up to city standards. Mr. Touma commented on the timeliness of the staff reports and their receipt by applicants. He did not feel there was sufficient time for review before the hearing date. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 10:10 A.M. FINDINGS, CONCLUSIONS & DECISION: - Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: • 1. The applicant, Robert F. Fetterly, filed a request for approval of a three-lot Short Plat. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered\into the record as Exhibit #1. 3. The Environmental Review Committee (ERC), the City's responsible official, determined that the proposal is exempt from an environmental assessment. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located 956 Field Avenue N.E. which is designated 140th Avenue S.E. in i King County. The site is located south of N.E. 10th Street as extended. N.E. 10th in this location is little more than an unpaved alley - it is designated S.E. 116th Street in King County. 6. The subject site is located at the eastern border of the city, immediately south of Hazen High School. 7. The subject site was annexed to the city with the adoption of Ordinance 4215 enacted in May, 1989: The site was reclassified in the same month to R-1 (Single Family; Lot size - 7,200 sq ft) by the adoption of Ordinance 4217. 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family uses, but does not mandate such development without consideration of other policies of the Plan. 9. The applicant proposes dividing the approximately .93 acre parcel into three lots. The subject site is approximately 299.42 feet long (north/south) by approximately 135 feet wide. Robert F. Fetterly SHPL-008-90 April 5, 1990 Page 3 10. The proposed lots are numbered 1 through 3 from south to north. Proposed Lot 1 will be approximately 10,071 square feet. The parcel will be approximately 74.65 feet wide along Field Avenue and 135 feet deep. 11. Proposed Lot 2, the center lot, will be approximately 15,102.45 square feet. Its frontage along Field will be approximately 111.87 feet long. The parcel is proposed to be 135 feet deep. 12. The northernmost parcel, Proposed Lot 3, will be a corner lot with frontage along both Field and N.E. 10th Street. The frontage along Field will be approximately, 112 feet long, while its northern frontage along 10th will be approximately 135 feet. The corner of the parcel at the intersection will be curved, altering these dimensions somewhat. The parcel.will be approximately 13,314 square feet. 13. A single family home is located on Proposed Lot 2 with a smaller home the applicant called a "studio" located on Proposed Lot 1. The staff report indicated the property was vacant. The Exhibits provided by the applicant do not show these improvements and therefore it is impossible to determine if appropriate setbacks are provided. 14. Staff reports a closure error on the proposed Plat Map. The street names do not show the appropriate city names as required. While some improvements have teen installed under King County standards, these improvements do not necessarily meet city standards. 15. The site is provided with water by Water District 90, which needs a franchise to operate within the city. Fire flow and fire hydrant location must meet city standards. 16. Storm water drains to the north and west, first along Field, then along N.E. 10th and then along Duvall or 138th. 17. In addition to Hazen High School located immediately north of the si-e, the subject site is served by Highlands Elementary School and McKnight Middle School', both within the Renton School District. 18. Kiwanis Park is located three-quarters of a mile west of the site. 19. The area contains a mixture of single family uses, vacant land, and Hazen High School. The zoning reflects the single family character of the area with a combination of R-1 and G-1 districts, both single family designations. Property in King County is similarly zoned for single family uses in this location. CONCLUSIONS 1. While a number of small details need to be clarified, the general proposal to subdivide the subject site appears to satisfy the public use and interest. A subdivision to permit single family development is compatible with the designation found in the Comprehensive Plan and on the zoning map. 2. The three-lot division will apparently only increase the number of dwelling units by one (1) since homes exist on both Proposed Lots 1 and 2. The size of the proposed lots varying from just over 10,000 square feet to over 15,000 square feet all exceed the minimum required 7,200 square feet. The narrowest lot, Proposed Lot 1 (at 74 ft.), exceeds the minimum width of 60 feet required by the Subdivision Ordinance. 3. All the lots proposed are regular rectangles providing what' would normally be reasonable building envelopes with sufficient front and side yard setbacks. In the current case, with pre- existing development not shown on the proposed plat, it is impossible to determine if these minimum setbacks have been satisfied by the proposed property lines. The applicant will have to demonstrate that the proposed lines meet the requirements, or, apply for and satisfy variance requirements. • 4. Any errors of closure must be corrected prior to final approval of the mylar. Similarly, the plat will have to reflect the appropriate city designations for street names. 5. The applicant has not applied for any waiver from the requirement to install improvements satisfying city standards and will have to comply with city requirements including curbs, gutters, street lighting and sidewalks. 6. The applicant will have to demonstrate the plat is served by franchised water and has sufficient fire flow and hydrant access. Robert F. Fetterly SHPL-008-90 April 5, 1990 Page 4 DECISION The.3-lot Short Plat is approved subject to the following conditions: 1. The applicant will have to submit a plat map showing all of the correct information required below within thirty (30) days of this decision or this decision will automatically become null and void, and a denial will be automatically substituted. 2. The applicant will have to show all required setbacks on the plat map using standard techniques. 3. The existing structures will have to be shown on the map and the existing setbacks demonstrated. These setbacks shall meet minimum city standards or the plat will have to be revised and the hearing reopened. Staff shall verify in writing the information provided. 4. Any errors of closure must be corrected and approved by the Public Works Department. 5. The plat will have to reflect the appropriate city designations for street names. 6. The applicant shall be required to install improvements satisfying city standards, and the applicant will have to comply with city requirements including curbs, gutters, street lighting and sidewalks. This condition is applicable unless the applicant receives either a waiver or deferral. 7. Fetterly SHPL-008-90 April 5, 1990 Page 5 The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning pending land use decisions. This means that parties to, a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This public communication permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The applicant, Robert Fetterly, is seeking toI subdivide a . 93 acre parcel into three lots for future development with single- family residences: The property is zoned fori single-family residential use (R-1) and is undeveloped. All proposed lots comply with development standards established for R-1 properties. 2 . Various City departments and divisions have reviewed and commented on the proposal. Discussion of their comments is incorporated into the body of the report. / PRELIMINARY REPORT TO Tr HEARING EXAMINER SHORT PLAT 3 . Approval of a short plat is based on several factors. The following criteria have been established in Section 9-12-5 of the City of Renton Code to assist the decision-maker in reviewing the plat: a. Compliance with the Comprehensive Plan: The Comprehensive Plan Map designates thelsubject property as Single-Family Residential. The proposal therefore is in keeping with the Comprehensive Plan. b. Compliance with the Underlying Zoning Designation: The subject property is zoned R-1, Single,.Family Residential which requires a minimum of 7, 200 square 'feet per lot. The proposed short plat will comply with the requirements of the R-1 zone. Proposed Lot 1 will be approximately 10, 071 . square feet, Lot 2 will be approximately 15, 102 . 45 square feet, and Lot 3 will be approximately 13 , 314 square feet. The configuration of the proposed lots also conforms to the requirements of the R-1 zone and the Subdivision Ordinance. Each of the lots is of sufficient size and configuration to allow full compliance with the required setbacks. When the subject property is developed, the area population will be increased by three families, or approximately nine to twelve persons. c. Compliance with Subdivision Regulations: The plat as designed meets the requirements for residential plats as follows: 1) Each lot will have the required street frontage. 2) Each lot will meet the width to depth ratio. 3) The size and shape of each lot meets the minimum requirements for area and width as established in the R-1 zoning designation. 4) The side lot lines are at right angles to the existing street. d. Level of Burden Short Plat Will Create on Public Services: When the standard improvements (see attached staff comments) are accomplished, the Public Works Department, Police Department, and Fire Prevention Bureau dol notanticipate any undue burden to infrastructure or services from the proposed subdivision or subsequent development of the property.
