DALPAY File No.: V-013-90 LOCATION: 715 Sunset Blvd. N.E. SUMMARY OF REQUEST: Approval of a variance from•Section 4-22-9 (F) of.the Renton Storm and Surface Water Drainage Ordinance to allow the reduction in the separation of the structure and a storm drainage pipe from ten'(10) feet to two (2) feet. SUMMARY OF ACTION: Planning Division Recommendation: Approval with conditions. PLANNING DIVISION REPORT: The Planning Division Report was received by the Examiner on March 13, 1990 PUBLIC HEARING: After reviewing the Planning Division Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: MINUTES The hearing was opened on March 20, 1990 at 8:30 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the,record: Exhibit #1 - Yellow File containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Drawing showing location of variance on the site. The staff report for this proposal was presented by MARY SAVELA, Assistant Planner, representing the Current Planning Division of the Community Development 1epartment. Ms. Savela advised the Comprehensive Plan designates the site as greenbelt, with steep slopes which have made it difficult to design the site. Zoning on the site is R-3, multi-family. The applicant wishes to build a four-plex on the site. In the past Mr. Dalpay applied for a non-project rezone from R-1 to R-3 in 1988 which was granted. Later he applied to the Board of Adjustment for a variance from the 10 ft. sideyard setback requirement to allow the construction of the four-plex to extend five feet into the side yard. The variance was granted. Site Plan approval for the four-plex was requested in September of 1988 and granted in March,.1989. It was at that time the storm water drainage system concern arose. In orderrto drain the site'properly the applicant had to put a storm-drain alongside the proposed structure, with said drainage pipe ending up to within 2 ft. of the structure. This was in violation of city code which called for the pipe to be 10 ft. from the structure due to problems of maintenance. She noted it is the owner's responsibility to maintain the drainage system. Planner Savela stated the Public Works Department supports this variance and requests this variance be conditioned (1) to use ductile iron pipe which will make the need for repairs unlikely arid (2) this variance should be recorded with King County so any future owners will be aware they will have the responsibility of keeping the drainage system clean. She reviewed the criteria to be considered before granting a variance noting the special conditions on the site such as its narrowness and steep slopes which limit designs for the proposed foul-plex; the need for the variance to insure the applicant will enjoy the same rights as other properties in the vicinity; and the granting of the variance does not appear to be detrimental to the public or other property in the vicinity as long as the two conditions suggested by Public Works are adhered to. With the above information, Savela recommended the Hearing Examiner approve this request, subject to the,two conditions set out by the Public Works Department. i James W. Dalpay V-013-90 , March 29, 1990 Page 2 7 Responding was the applicant, JAMES W. DALPAY, P. O. Box 2436, Renton 98056. Mr. Dalpay concurred with the recommendations of staff and said he will agree to the Public Works conditions as stated. The Examiner called for further testimony regarding this project. There was no one else wishing to • speak, and no further comments from staff. The hearing closed at 9:00 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, James W. Dalpay, filed a request for approval of a variance to allow a storm water utility line to be closer to a structure than otherwise permitted. 2. The yellow file containing the staff reportohe State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. 3. The Environmental Review Committee (ERC), the City's responsible official, determined that the proposal is exempt from an environmental assessment. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The .23 acre subject site is located at 715 Sunset Boulevard N.E. The site is located just north of N.E. 7th Street and just east of I-405. The subject site is vacant. 6. The subject site was annexed to the City with the adoption of Ordinance 1795 enacted in 1959. -The site was reclassified 'from R-1 (Single Family; Lot size - 7,200 sq. ft.) to R-3 (Medium Density Multiple Family) in 1988 with the enactment of Ordinance"4146. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of greenbelt and multiple family uses, but does not mandate such development without consideration of other policies of the Plan. 8. . The area contains a mix of uses including single family uses east of the site, single family and multiple family uses north of the site and commercial uses south of the site. Again, the slopes adjacent to I-405 are located west of the site. 9. The subject site is roughly rectangular in shape. It is approximately 50 feet wide by approximately 200 feet long. The site slopes steeply downward on its western third. The remaining two-thirds is also characterized by sloping topography. 10. The applicant proposes constructing a four-plex on the subject site. The applicant received variances from the Board of Adjustment to provide less than the required 10 foot sideyards. The,Board permitted 5 foot sideyards. 11. Section 4-22-6 requires storm drain pipes to be placed not less than 10 feet from a structure. Since the site has only 5 foot sideyards, the applicant has requested a variance from this provision to provide a 2 foot setback from the building. 12. A variance from the setback provision may be approved after review and recommendation of the Public Works Department. That department recommended the variance be approved subject to conditions assuring the storm line would need minimal maintenance. The department recommended the use of ductile iron pipe which requires less maintenance. 13. The plans show the catch basins and clean-outs are located far enough from the structure that maintenance will not be a problem. Hand digging may be required to access the line and the applicant is aware of this concern. CONCLUSIONS 1. Variances may be granted when the property generally satisfies all the conditions described in part below: a. The applicant suffers undue hardship caused by special circumstances such as: the size, shape, topography, or location where code enforcement would deprive the owner of rights and privileges enjoyed by others similarly situated; James W. Dalpay V-013-90 March 29, 1990 Page 3 b. The granting of the variance would not materially harm either the public welfare or other property in the vicinity; c. The approval will not constitute a special privilege inconsistent with the limitations on other property in the vicinity; and d. The variance is the minimum variance necessary to allow reasonable development of the subject site. The variance request is justified. 2. The combination of a narrow lot and steep slopes impose constraints on where and how a proposed'building can be located on the site. The lot is only 50 feet wide and the site slopes downward approximately 35 feet. These constraints impose an undue hardship that the granting of the proposed variance would overcome. • 3. The approval of the variance would not adversely affect other properties. The storm water line will be contained entirely underground. Since the variance will;not permit any above ground encroachment there will be no off-site impacts. 4. The unique characteristics of the site, its topography and size, suggest that approval of the variance for this property should not extend a special privilege to this site. The variance will permit reasonable development, particularly since the Board of Adjustment approved the variance permitting the less than standard sideyards. 5. The variance, which will permit the storm line within 2 feet of the structure, is the minimum which can be granted at this point and still allow access to the line in case of failure. With the already extremely narrow sideyards, it would be difficult to reduce the size of the variance. 6. In addition, in reviewing a variance from the provisions of the Storm.and Surface Water Drainage Ordinance one final issue needs addressing. The line must be capable of being maintained. Staff has suggested that the use of ductile iron pipe will insure that maintenance is required infrequently. The design and location of the catch basins will insure maintenance is possible. While hand digging may be necessary, smaller mechanical equipment may be used to access the trench. 7. In conclusion, the variance appears necessary and justified to permit reasonable development of the subject site, and therefore is approved. DECISION The Variance to permit a separation of 2 feet between the drainage pipe and the structure is approved subject to the following conditions: 1. The applicant shall, use ductile iron pp pipe or other material which shall remain subject to review and approval of the Department of Public Works. 2. All installation, construction work and subsequent maintenance shall be subject to review and approval of the Department of Public Works. 3. The variance shall be recorded with King County and such recording shall state the property owner is required to maintain the system. ORDERED THIS 29th day of March, 1990. FRED J. April 12, 1990. Any aggrieved person feeling that the decision of the Examiner is ambiguous or based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for a review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific ambiguities or errors discovered by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Chapter 8, Section 16, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning pending land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This public communication permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. Dalpay has requested a variance from Section 4-22-9 of the City of Renton Storm and Surface Water Drainage to allow a storm drain pipe to be placed two (2)' feet from the building, instead of ten (10) feet as required by the Ordinance. Public Works commented that the width of this property is only fifty (50) feet and therefore the design alternatives are very limited. 2 . The history of this site is as follows. The applicant applied for a programmatic, non-project rezone from R-1 to R-3 in 1988 . This rezone was granted and is the zoning presently on the site. Later in 1988, the applicant applied to the Board of Adjustment for a variance from the required ten (10) foot sideyard setbacks to allow construction to extend five (5) feet into the sideyards. This variance was granted on May 25, 1988. In September, 1988, the applicant requested, site plan approval to construct a four-plea multi-family residential unit. Site plan approval was granted on March 20, 1989. 3 . The Storm and Surface Water Drainage Ordinance, Section 4-22-16 of the Renton City Code, states: "A. Variance Requirements: .The Director (of the 'Department of Public Works) or his representative may recommend to the Hearing Examiner a variance from the requirements of this Ordinance when, in his opinion, undue hardship may be created as a result of strict compliance with the provisions of this Ordinance. The Examiner shall comply with the appropriate public notification, rules and time requirements of Section 4-8. The Hearing Examiner may prescribe conditions that he deems necessary to be desirable for the public interest. No variance shall be granted unless the Examiner finds: 1), That there are special physical circumstances or conditions affecting said property such that the strict application of the provisions of this Ordinance would deprive the applicant of the reasonable use or development of his land; " This property.. is quite narrow (fifty feet) and also has steep slopes on site. These circumstances limit the possible designs of the proposed . four-plex residential unit. The City of Renton Public Works. Department supports the granting of the proposed variance for these reasons. "2) .That. the variance is necessary to insure such property the rights and privileges enioyed by other properties in the, vicinity and under similar circumstances; and" There are no other properties in the vicinity which have similar circumstances. "3) That the granting of the variance will not be detrimental to the public welfare or injurious to other property in the vicinity. " . . The granting of the variance will not be detrimental to the public welfare or injurious to other property in the vicinity as long as the conditions recommended by the Public 'Works Department (use of ductile iron pipe and recording of the variance with King County to ensure that future potential owners are aware of the variance) and if adequate measures are taken to buffer the single-family neighborhood adjoining the subject site on the north side. Section 4-22-16 also states as follows: "C. Criteria: Before the Examiner grants a, variance, he shall make a determination that shall include, but is not limited to, the following criteria: . THE HEARING EXAMINER = Dalpay Variance _ PUBLIC HEARING March 20, 1990 Page 4 COMMUNITY DEVELOPMENT DEPARTMENT 1) Capacity of downstream facilities; 2) Acceptability of receiving bodies of water; 3) Possibility of adverse effects of retention; 4) Utility of regional retention facilities; and 5) Capability of maintaining. " According to Dave Christensen, Utility Engineer, items 1-4 above do not apply in this instance since the variance addresses proximity to a structure. The flow characteristics of this line meet the criterion of this Ordinance. Item 5: "The proposed location of the line requires that the owner utilize different techniques if repair is required for the line. The use of a backhoe will be prohibitive, therefore, the owner will have to utilize a small trencher and hand digging to access the line.. By installing ductile iron pipe the need for repair will be very unlikely. It will not, affect the basic maintenance of the line (flushing the line and clearing out the catches) since the catch basins are located far enough away from the building to allow access by conventional cleaning equipment. " (Memorandum dated March 12 , 199.0 from Dave Christensen, Utility Engineer to Mary Savela, Assistant Planner. ) For further information, see attached copy of the above referenced memorandum. H. The applicant is"requesting a.variance from the 10' minimum separation required between a structure and a storm pipe to a 2' separation. Section 4-2916(A) Variances allows for this variance if recommended by the Public Works Director or his/her representative. The width of this property (50') does not allow for many alternatives for design, with a building setback variance to 5', already allowed and one source for storm drainage from the parking area off of N.E. Sunset Blvd. being to the back of the property where drainage will be detained, then released into a dispersal trench to allow for flows similar to what existed prior to improvement. The Public Works Department has no objections to this variance with the condition that Ductile Iron Pipe is utilized and that the variance shall be recorded with King County so that future -potential owners will be aware of the variance.
