WHEREAS, the owner(s) of said property Parcel "A" desire to connect to the public sewer system in the
Renton sewer service area; and
WHEREAS, there was an existing "dry" side sewer installed for the property for future use; and
WEREAS, The existing dry side sewer was installed as a dual (with parcel 1072000090), which no longer
meets the standard that each property / building should have its own side sewer;
WHEREAS, the property owner(s) have been advised of the aspects of the potential issues and
responsibilities associated with dual side sewer connections; and
WHEREAS, the property owner(s) wish to connect to the common dual side sewer and wish to impose
the following restrictive covenant running with the land as a condition placed on the title of the
property;
NOW, THEREFORE, In consideration of the City's issuance of a permit to connect and utilize the joint
side sewer, it is hereby agreed by the above -parties that:
1. The property Owners agree to comply with the requirements of the Side Sewer Permit(s).
2. The cost of construction of said side sewer line shall be borne by the Owners of the said
properties.
3. The responsibility and cost of maintenance, repairs, or reconstruction of the side sewer line
shall be:
a. Each property owner shall be responsible for the portions of the side sewer that serve
their lot and are not in common with the other lot.
b. The responsibility for the portions of the side sewer used in common shalt be borne in
equal shares, except when only one property is connected to the side sewer, that
property owner is soley responsible for the cost and maintenance of the entire portion
of the sidesewer up to the point where the second property applies for a permit to
connect to and become a party to the dual side sewer.
4. The property owner shall not take any action, without prior agreement, that negatively affects
the use of the sewer line by the other user(s).
5. The parties intend and agree on behalf of themselves and on behalf of their heirs, successors
and assigns that this Agreement shall be a covenant running with the land and shall be binding
upon all parties and their heirs, executors, administrators, successors, assigns, lessees, sub-
lessees, tenants and sub -tenants.
6. The owners hereby agree that, at such time that the common portion of the side sewer(s)
needs to be repaired or replaced in the right-of-way, each property shall have a separated side
sewer stub at the owners cost.
7. If one or both of the properties redevelops or develops further, each property shall have a
separated side sewer stub at that owner's cost.
8. The owners hereby agree to indemnify and hold harmless the City of Renton for any future
damages resulting from dual side sewer connection with the herein described parcels.
Attorneys' fees are the responsibility of the owners if,enforcement of these restrictive
covenants are necessary.
