Declaration of Covenants for Dual Side Property Tax Parcel Number:

WHEREAS, the owners of said property Parcel "A" and Parcel" B" desire to connect to the public sewer
system in the Renton sewer service area; and
WHEREAS, both property owners have been advised of all aspects of the potential for future problems
associated with dual side sewer connections; and
WHEREAS, the property owners wish to connect to a common dual side sewer and wish to impose the
following restrictive covenant running with the land as a condition placed on the title of the property;
NOW, THEREFORE, In consideration of the City's issuance of a permit to connect more than one
structure to one side sewer and in consideration of the mutual agreements made in this Agreement, it is
hereby agreed between the above -parties that:
1. Both property Owners agree to comply with the requirements of the Side Sewer Permit(s).
2. The cost of construction of said side sewer line shall be borne by the Owners of the said
properties.
3. The cost of maintenance, repairs, or reconstruction of that portion of the side sewer Line used in
common shall be borne in equal shares, except that the owners of any lower parcel shall not be
responsible for the part of the side sewer above their connection; and when necessary to repair,
clean or reconstruct the sewer line, the parties to this agreement shall have a right of entry for
that purpose.
4. Neither property owner shall take any action, without prior agreement, that negatively affects the
use of the sewer line by the other user(s
5. The parties intend and agree on behalf of themselves and on behalf of their heirs, successors and
assigns that this Agreement shall be a covenant running with the land and shall be binding upon
aLL parties and their heirs, executors, administrators, successors, assigns, lessees, sub -lessees,
tenants and sub -tenants.
6. The owners hereby agree that, at such time that the common portion of the side sewer(s) needs
to be repaired or replaced in the right-of-way, each property shall have a separated side sewer
stub at the owners cost.
7. If one or both of the properties redevelops or develops further, each property shall have a
separated side sewer stub at the owners cost.
8. The owners hereby agree to indemnify and hold harmless the City of Renton for any future
damages resulting from dual side sewer connection with the herein described parcels.
Attorneys' fees are the responsibility of the owners if enforcement of these restrictive covenants
are necessary.
