The Committee, on August 8, 1990, decided that your project may be issued a Determination of Non-Significance-Mitigated with the following conditions: 1) This project is located within the Aquifer Protection Area. Therefore, no pesticides, herbicides or other hazardous materials shall be stored on the premises without resubmittal with a hazardous material handling plan including provisions for secondary containment, handling, and spill mitigation. This is to help ensure that this development does not adversely impact the aquifer. 2) The applicant shall provide the new landscaping as detailed on the landscape plan. 3) Additional landscaping or shields will be provided, as necessary, to ensure that glare from the park does not impact adjacent land uses. Notes to Applicant 1) The applicant shall provide plans showing the new drainage system with slopes, catch basins, oil/water separator and piping on the south/east sides of the proposed building. These plans shall also demonstrate the connection between the existing system and the new system. 2) The applicant shall conduct the necessary survey at the time of construction to ensure that the proposed shed does not encroach into the easement for the 42" Metro trunk line. Because the Environmental Review Committee imposed specific mitigation measures rather than issue a Determination of Significance, there is a required 15 day comment period during which comments are solicited from various agencies, jurisdictions or Individuals (including the applicant) who may have an interest in the Committee's decision. The comment period will end August 28, 1990. Following the end of the comment period, the City will finalize its Determination unless comments received require a reevaluation. Following the finalization of the Determination, there is a required 14 day appeal period. The Committee review was conducted after receiving written comment from all divisions of the Public Works Department,all sections of the Planning Division,and the Fire, Police, and Parks Departments. FINDINGS, CONCLUSIONS,AND DECISION Having reviewed the written record in the matter, the Site Plan Review Committee now makes and enters the following: Findings: 1. The applicant, the Parks and Recreation Department, has requested site plan approval to allow creation of a functional park maintenance building from the 1,700 square foot old Taco Time building which was abandoned when Taco Time constructed new facilities, construction of a new shed (approximately 140' x 80') to park the Community Services vehicles in, construction of an outdoor day care area which will include play equipment for young children, and enlargement of the parking area to provide overflow parking for the Carco Theatre and other park facilities. 2. The applicant's file containing the application, the State Environmental Policy Act (SEPA) documentation,the comments from various City departments,the public notices requesting citizen comment, and other pertinent documents was entered as Exhibit No. 1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971 as amended),a Determination of Non-Significance- Mitigated was issued for the subject proposal on August 8, 1990,with the following conditions: a. This project is located within the City's Aquifer Protection Area. Therefore, no pesticides, herbicides or other hazardous materials shall be stored on the premises without resubmittal with a hazardous material handling plan including provisions for secondary containment, handling, and spill mitigation. This is to help ensure that this development does not adversely impact the aquifer. b. The applicant shall provide the new landscaping as detailed on the landscape plan. c. Although there have been no complaints of glare from the park at this time. Additional landscaping or shields will be provided by the Recreation Department, as necessary, to ensure that glare from the park does not impact adjacent land uses. - Administrative Site Plan Review Report and Decision November 15, 1990 Page 2 Notes to Applicant a. in compliance with the Municipal Code the applicant shall provide plans showing the new drainage system with slopes, catch basins, oil/water separator and piping on the south/east sides of the proposed building. These plans shall also demonstrate the connection between the existing system and the new system. b. The applicant shall conduct the necessary survey at the time of construction to ensure that the proposed shed does not encroach into the easement for the 42" Metro trunk line. A copy of the survey shall be submitted to Metro. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. • 5. The subject proposal is consistent with the Comprehensive Plan designation for Recreation uses. 6. The site plan as presented, provides sufficient parking to comply with the Parking and Loading Ordinance of the City of Renton. 7. The subject site was annexed into the City in 1959 by the Adoption of Ordinance No. 1965, amended by Ordinances No. 1787 and 1789(1959). The site was zoned Public Use. 8. Land use surrounding the subject site is Public Use (P-1) which includes the portions of the Cedar River Park which are not included in this development proposal and Heavy Industrial (H-1) to the east which includes the concrete plat. 9. The applicant's site plan complies with the criteria for site plan review,as discussed below: SITE PLAN APPROVAL CRITERIA Section 4-31-33(D) lists ten criteria that the City is asked to consider along with all other relevant information in making a decision on a Site Plan Approval application. These include the following: General Criteria 1. Conformance with the Comprehensive Plan, its elements and policies. The proposed use on the subject site conforms with the Comprehensive Plan designation for Recreation. 2. Conformance with existing land use regulations. The proposed site plan conforms with the development standards for the underlying Public Zone (P-1). The location of the structures and parking lot meet all setback and landscaping requirements. 3. Mitigation of impact to surrounding properties and uses. The impacts of the proposed use to surrounding properties and uses include increased traffic both on and off-site,and aesthetics. These are discussed below: Aesthetics The aesthetic impacts from the new parking area and shed will be mitigated by the proposed and existing landscaping of the park should not be reduced by the proposed construction. No negative impacts are anticipated from the new children's' play area as this is located within the interior of the park and the wall around the area will match the existing Renton Community Recreation Center to which the wall will be attached. The perimeter fencing and landscaping will not be affected by the construction of the children's play area or the shed. The existing landscaping, which consist of Deodar,Cedar, Norway Maple, Douglas Fir and groundcover,will buffer the adjacent land uses from the proposed development. stpinrpt -' ' Administrative Site Plan Review Report and Decision November 15, 1990 Page 3 In order to protect the Cedar River from development the applicant has indicated that the new children's play area will be located a minimum of 200' from the Cedar River and that all other development is located is located more than 200'from the river. Aquifer Protection Area As noted previously, the project site is located within the Aquifer Protection Zone. The applicant has stated that the proposed shed will be used for the parking of small trucks while not in use for park maintenance activities. The plans as submitted indicate that this area will be covered with crushed rock. Staff is concerned that oil or gas leaks from the truck engines and employee cars could impact the aquifer and nearby City wells. Staff has recommended that the area be paved with asphaltic concrete or concrete and provided with a tight lined storm drainage system to ensure the protection of the aquifer. Staff is also concerned that if vehicle maintenance were to occur on-site that the oil and other by products could get into the soil. No maintenance of vehicles should occur at the proposed facilities. 4. Mitigation of impacts of the proposed site plan to the site. Aesthetics The applicant has indicated that a new six foot tall chain link fence with vertical slates (either wood or plastic), matching the existing fencing, will be constructed around the area in which the proposed shed is to be constructed. This fence will screen the shed and work area from the remainder of the park. As noted above, the proposed parking area will be landscaped. There will also be a 3 foot concrete wall constructed around the proposed children's play area that will match the adjacent building. Easements Metro has indicated that there is a 42" waterline and easement adjacent to the area where the applicant has proposed to construct a shed. The applicant has indicated that they are aware of this easement and will not encroach on it. 5. Conservation of area-wide property values. The proposed landscaping and additional overflow parking should make the subject site more attractive and should help to conserve area-wide property values. 6. Safety and efficiency of vehicle and pedestrian circulation. As a part of this project, the applicant will be providing an additional fifty-one paved parking stalls. This parking will be available as overflow parking for the larger events held at the Cedar River Park, such as events at the Carco Theatre. The Transportation Systems and Police Department staff have indicated that the additions to this park should not have any significant impacts on their services. The shed and children's play area are well separated from the interior roadways. The proposed overflow parking area will reduce the number of vehicles circulating through the park looking for open parking spaces during peak use events. The provision of the additional parking should reduce the number of vehicles parking along area roads during special events. The applicant has indicated that the new parking area will be lighted for the safety of vehicle and pedestrian circulation. 7. Provision of adequate light and air. The applicant has indicated on the site plan that additional lighting will be provided only in the overflow parking area. Adequate lighting already exists throughout the rest of the park. The proposed improvements should not effect light and air circulation. 8. Mitigation of noise, odors,and other harmful or unhealthy conditions. Due to the proximity of the Cedar River and the fact that the project site is within an Aquifer Protection Area, the applicant has indicated that the shed will not be used for the storage of hazardous materials (e.g., pesticides, herbicides). The proposed use is not expected to increase the noise level created within the existing park. Section D.6. of the P-1 zone states that 'Truck traffic and other noise normally associated with an operation shall be limited to the hours between 7 A.M. and 7 P.M. unless the hearing examiner shall find that due to specific circumstances of a particular application, other hours of operation stpinrpt .l Administrative Site Plan Review Report and Decision November 15,'1990 Page 4 should be established in order to protect the public health safety and welfare. The outdoor activities planned for the Cedar River Park generally do not continue on into the late evening hours. The adjacent land uses, a sand and gravel company and a restaurant, have not registered any complaints about noise generated from the park. If we limit traffic here, it would limit Carco Theatre and the other park facilities to levels below which they were designed and approved to handle. The project is located within the City's Aquifer Protection Area. There is concern that the oil from the parked cars could enter into the aquifer. In accordance with the Municipal Code, oil/water separators will be used to ensure that the oil from the parking areas does not enter into the groundwater. 9. Availability of public services and facilities to accommodate the proposed use. Police and Fire Prevention Bureau staff report adequate resources to provide anticipated services to the site during construction activities and operations with system improvements fees and with Code-required improvements(e.g.,20 foot wide fire lane,fire hydrants). The Public Works Section of the Department of Planning/Building/Public Works has indicated that, in accordance with Municipal Code requirements, plans for the new storm drainage system with oil/water separators will have to be submitted for review. 10. Prevention of neighborhood deterioration and blight. The proposed development will provide improved recreational opportunities for children and assist in the maintenance of the park. This should result in a better utilized and maintained development which, in turn, should enhance the appearance of the neighborhood. Decision: The site plan for Cedar River Park Shop Improvements, File No. ECF; SA-072-90 is approved subject to the following conditions: -1. The applicant shall ensure that no pesticides, herbicides, or other hazardous materials shall be stored on the premises without resubmittal with a hazardous material handling plan including provisions for secondary containment, handling, and spill mitigation. This condition Is established to help ensure that the proposed action does not adversely impact the City's Sole Source Aquifer. •2. The applicant shall provide the necessary survey data to Metro to ensure that the proposed shed does not encroach on the Metro easement and shall provide the City verification from METRO that the integrity of this easement is preserved. 3. The applicant shall pave and curb the area within the proposed new fence around and within the new storage shed (the area indicated on the plans as being covered with crushed rock)with asphalt or concrete. �4. The applicant shall ensure that all catch basins and storm drains serving storage or public parking areas are tight lined to their outfall. 4. The applicant shall not repair of perform maintenance work on any vehicles within the proposed shed or the adjacent area. For the purpose of these decisions, the terms "should"and "shall"are to be considered mandatory and the term"may"is considered discretionary. Maintaining habitat for natural populations of trout and salmon in urban areas of the Pacific Northwest has become challenging in recent years . Increasing rates and intensity of development, especially in the Puget Sound reg ion, have adversely affected streams to the point where only remnant populations exist in many areas . Not only has structural habitat been lost through clearing of streamside vegetation, removal of instream debris and rechanneling, but physical habitat features have been altered through improper stormwater management . Retaining habitat for these fish is not only important culturally to the northwest but: is the mandate of the Washington Department of Fisheries (WDF) . Stormwater run-off from urban areas should be metered into streams at near the pre-development rate to maintain streambank and streambed stability. Increased erosion and scouring are not • only unacceptable to adjacent landowners, who generally expect no, . change in channel boundaries, but rapidly deteriorate both spawning and rearing habitat for fish, especially trout and salmon . Additionally, inadequate metering of stormwater reduces opportunities to remove toxicants from run-off waters fahich can have an adverse effect on all aquatic life . WDF 's stormwater recommendations are attached . For purposes of analysis the peak outflow from the detention basin should occur within 30 hours from the start of the design storm. For an appropriate level' of protection from stream channel erosion detention basin outflow rate and the time for which it occurs must be analyzed . Since inflow and outflow are • independent, storage routing is required to perform this analysis . A level pool routing technique is acceptable . Therefor. no pesticides, herbicides or other hazardous materials shall be stored on the premises without resubmittal with a hazardous ' material handling plan including provisions for secondary containment, handling, and spill mitigation. This is to help ensure that this development does not adversely impact the aquifer. • :ES • • The applicant is planning to convert an existing building and to construct a 40 by 180 foot shed, an outdoor J, day-care area and to enlarge the parking area within the Cedar River Park. These changes will allow the Parks and Recreation Division to provide the level of service required at the Community Center and meet the demands placed on the Cedar River Park. • The Park is located within the Aquifer Protection Area. In order to ensure the protection of the ground water, the Parks and Recreation Division has agreed not to store pesticides, herbicides or other materials in the shed that could impact the aquifer. Aesthetics/Land Use Impacts: The proposed development consists of converting the Taco Time office building into a park maintenance building, an addition to the existing parking area, construction of a storage shed and construction of an outdoor day-care play area. • • The addition to the parking area will provide an area for 37 standard parking stalls and 14 compact parking stalls. The storage shed will be approximately 180 ft. by 40 ft. The outdoor day-care play area will be adjacent to the Recreation Center and will cover approximately 900 sq. ft. with a three-foot high concrete wall surrounding the area. The new shed will be open on all sides with the roof supported by poles. The roof will be .constructed of green sheet metal to match the existing buildings. • The Cedar River Park is already well landscaped. The only additional landscaping that will • be provided in conjunction with this project is the proposed landscape buffer around the new parking area. Mitigation Measures: The landscaping plan submitted by the applicant will adequately • buffer the proposed new parking area. The existing landscaping on site will buffer.the proposed additions to the park maintenance area and the Recreation Center. Natural Environment• Impacts: All of the proposed development and the activities associated with the proposed development are located beyond the 200 foot shoreline setback from the Cedar River. A portion of the existing park including the Carco Theatre is located within the 200 foot !„•. shoreline setback area. As the project site is fairly level only minor grading will be Necessary for the proposed development. , The project is located within the Aquifer Protection Area, Zone I. Due to the unique concerns of this area the applicant has agreed not to store pesticides, herbicides or other chemicals on the project site. The shed area will only be used to store vehicles and hand tools. • . Mitigation Measures: The proposed development will maintain the 200 foot shoreline setback from the Cedar River. The applicant will not be storing pesticides or other chemicals on the project site. Noise, Light and Glare Impacts: 1) Construction: Noise, light and glare are potential impacts in conjunction with the construction of the parking lot and shed. Due to the,nature of the surrounding uses, heavy industry and commercial, and the distance from the project site to the adjacent uses these impacts are expected to be minimal. Some mitigation of these impacts will be achieved through the limiting of construction to normal business hours and due to the existing landscaping. 2) Operations: During the operation of the park facilities some noise, light and glare will be generated from the security lighting and the general use of the facilities. These impacts should prove to be minor due to the nature of the surrounding area and its use. No new light sources will be required as part of the new development. Mitigation will be achieved through the addition landscaping proposed by the applicant and the existing landscape features. Mitigation Measures: The proposed and existing landscaping will buffer the surrounding land uses from glare produced by the park. Policy Nexus: Landscape Requirements 4-31-34, Comprehensive Plan Section III.C. d. Public Services 1) Police and Fire Impacts: Police and Fire Prevention Bureau staff report adequate resources to provide anticipated services to the site during construction activities and during operation with the Code-required improvements (e.g. 20 foot wide fire lanes, fire hydrants. Mitigation Measures: None required. Policy Nexus: Environmental Review Ordinance 4-6. 2) Storm Water Impacts: This project is within a Zone I Aquifer Recharge Area. In order to ensure the protection of the aquifer mitigation measures will be required in conjunction with the construction and operation of the project. The Parks and Recreation Department has indicated that trucks containing hazardous materials will not be stored in the shed. Mitigation Measures: The applicant will need to provide plans showing the new drainage system with slopes, catch basins, oil/water separator and piping on the south/east sides of the proposed building. These plans shall also demonstrate the connection between the existing system and the new system. Policy Nexus: Environmental Review Ordinance 4-6 • 3) Utilities Impacts: Public utility lines are generally available to serve the site. There is a concern on the part of the Utilities Division that the proposed structure encroaches over an existing 42" Metro trunk line. Parks and Recreation has indicated that they are aware of the easement and that the proposed shed will not encroach within the easement. Whether the proposed project is consistent with the Comprehensive plan zoning designation and with Goals, Policies and Objectives set forth in the Plan. • The proposed development is consistent-with the Comprehensive Plan Map, which designates the site for Recreation uses and with the Comprehensive Plan Elements for Parks and Recreation. 2. Whether the proposed project is consistent with the land use map zoning designation and applicable Zoning Ordinance components. The subject property is zoned Public Zone (P-1), which permits municipal parks and there accessory uses. The proposed development adequately addresses the development standards for park facilities. • 3. Whether the proposes project is consistent with the Zoning Ordinance and other applicable regulations/standards. The land to the west of the project site is reserved for the 1-405 freeway,the property to the north is zoned for Business District (B-1), to the east is zoned Heavy Industry District (H-1) and to the south is zoned Public Zone (P-1). The project as proposed adequately addresses the development standards regarding the adjacent zones. ENVIRONMENTAL ELEMENTS 1. Whether the applicant has adequately identified and addressed the following environmental impacts likely to occur in conjunction with the proposed development. a. Aesthetics/Land Use Impacts: The proposed development consists of converting the Taco Time office building into a park maintenance building, an addition to the existing parking area, construction of a storage shed and construction of an outdoor day-care play area. The addition to the parking area will provide an area for 37 standard parking stalls and 14 compact parking stalls. The storage shed will be approximately 180 ft. by 40 ft. The outdoor day-care play area will be adjacent to the Recreation Center and will cover approximately 900 sq. ft.with a three-foot high concrete wall surrounding the area. The Cedar River Park is already well landscaped. The only additional landscaping that will be provided in conjunction with this project is the proposed landscape buffer around the new parking area. Mitigation Measures: The landscaping plan submitted 'by the applicant will adequately buffer the proposed new parking area. The existing landscaping on site will buffer the proposed additions to the park maintenance area and the Recreation Center. Policy Nexus: Parking and Loading Ordinance 4-14, Landscape Requirements 4-32-34. b. Natural Environment • Impacts: All of the proposed development is located beyond the 200 foot shoreline setback from the Cedar River. As the project site is fairly level only minor grading will be necessary for the proposed development. The project is located within the Aquifer Protection Area, Zone I. Due to the unique concerns of this area the applicant has agreed not to store pesticides, herbicides or other chemicals on the project site. The shed area will only be used to store vehicles and hand . tools. • Mitigation Measures: The proposed development will maintain the 200 foot Shoreline setback from the Cedar River. Noise, Light and Glare Impacts: 1) Construction: Noise, light and glare are potential impacts in conjunction with the construction of the parking lot and shed. Due to the nature of the surrounding uses, heavy industry and commercial, and the distance from the project site to the adjacent uses these impacts are expected to be minimal. Some mitigation of these impacts will be achieved through the limiting of construction to normal business hours and due to the existing landscaping. 2) Operations: During the operation of the park facilities some noise, light and glare will be generated from the security lighting and the general use of the facilities. These impacts should prove to be minor due to the nature of the surrounding area and its use. Mitigation will be achieved through the addition landscaping proposed by the applicant and the existing landscape features. Policy Nexus: Landscape Requirements 4-31-34, Comprehensive Plan Section III.C. d. Public Services 1) Recreation Impact: The Parks and Recreation Division of the Community Services Department has indicated that these facilities are needed in order to meet the requirements placed on the Cedar River Park and the Recreation Center. Mitigation Measures: None required. Policy Nexus: Environmental Review Ordinance 4-6 2) Police and Fire Impacts: Police and Fire Prevention Bureau staff,report adequate resources to provide anticipated services to the site during construction activities and during operation with the Code-required improvements (e.g. 20 foot wide fire lanes, fire hydrants. Mitigation Measures: None required. Policy Nexus: Environmental Review Ordinance 4-6. 3) Storm Water Impacts: This project is within a Zone I Aquifer Recharge Area. In order to ensure the protection of the aquifer mitigation measures will be required in conjunction with the construction and operation of the project. Mitigation Measures: The applicant will need to provide plans showing the new drainage system with slopes, catch basins, oil/water separator and piping on the south/east sides of the proposed building. These plans shall also demonstrate the connection between the existing system and the new system. Policy Nexus: Environmental Review Ordinance 4-6 4) Utilities Impacts: Public utility lines are generally available to serve the site. There is a concern on the part of the Utilities Division that the proposed structure encroaches over an existing over an existing 42" Metro trunk line. The acquisition of the former Taco Time property for the purpose of a Parks Maintenance Building was approved by the City Council. The Taco Time building is located at 1911 Maple Valley Highway and is the planned site for the new Shops Building. Plans for this site include; the removal of the existing fence around the building, expanding the Maintenance yard and enclosing it with a new screening fence. Also, the addition of crushed rock and asphalt surface areas and a proposed shed building (approximate size 180 ft. x 40 ft. ) , planned for the site. Adjacent to the planned Parks Maintenance Building site is a proposed over- flow parking lot. The lot will be an asphalt pavement with a 6" concrete curb. This lot will accommodate Carco Theatre events as well as over-flow parking from other recreational activities that take place in the park. The lot will provide approximately 50 additional parking stalls. Planned landscaping for both of the above mentioned projects will coincide with the landscape materials already being used in the park. Also planned for the site is a new outdoor daycare area for the Community Center. This area will be approximately 900 sq. ft. of a cushioned surface for recreational use. A 3 ft. concrete surround will enclose the area. Suggested play equipment is tot oriented and would not exceed 6 ft. in height.
