WAC 197-11-560 defines the content of Final EISs. SEPA guidelines (WAC 197-11-560) allow the lead agency several options when responding to comments received on the Draft EIS. These include: • Modifying alternatives including the proposed action; • Develop and evaluate alternatives not previously given detailed consideration; • Supplement, improve, or modify the analysis; • Make factual corrections; and • Explain why the comments do not warrant further agency response (citing sources, authorities, and reasons that support response). In response to the comments received on the Draft EIS, this chapter includes a description of an Open Space Alternative, an alternative not previously evaluated in the Draft EIS, and a discussion of additional mitigation measures identified by the City. These mitigation measures identified by the City, would be used to further reduce the risk of adverse impacts to :the environment. 2.2 Supplemental Information on Project Area Based on comments received during the public hearing and from letters of comment, it was evident that clarification of the project area in relation to surrounding land not a part of the project was in order. Figure 2-1 shows the location of the,.project area (Tracts A and B) to surrounding lands, specifically the P-1 Pond, heronry, and the remaining riparian forest. Land immediately east of FCDC property is owned by RiverTech, and was developed during late 1989 and 1990 as a three-story office building. With the exception of a 1.1-acre remnant of the old Black River channel (an area to be excluded from development) and a 0.04 acre wetland located on Tract B, none of the land in the project area is by definition wetland. The P-1 Pond, Springbrook Creek, and land north of the project area (outside of the area proposed for development in this EIS) are wetlands but are not a part of this project. The City of Renton Wetlands Study (City of Renton 1981) conducted in 1981:(prior to construction of the P-1 Pond and clearing of riparian vegetation north of the heronry), identified the Black River Riparian Forest as the most significant wetland in the City. The remnant portion of the old Black River channel located on Tract B (and proposed for preservation as a part of this project) was the only part of Tracts A and B identified as wetland in that study. Figure 2-2 shows the condition of Tracts A and B in 1977, prior to the construction of the P-1 Pond. In 1977 Tracts A and B were part of the Erlington Golf Course. As can be seen in Figure 2-2,with the exception of the historic Black River channel on Tract B (an area to be maintained as open space under the proposal) both tracts were sparsely tried. 2.3 Supplemental Information on Project History Information presented by Mary Anderson (May 23, 1990 letter and presented in Chapter 4 of this document) has provided additional information associated with the construction of the P-1 Pond in 1984 by the Soil Conservation Service. According to Ms. Anderson, no herons were observed nesting adjacent to the old P-1 forebay and channel during construction of the P-1 Pond in 1984, although herons were observed flying into the riparian forest. - ADD ADDITIONAL MATERIAL RE FCDC HISTORY HERE - TO BE PROVIDED BY MARK MILLER 7/20/90 2.4 Project Need Several commenters to the Draft EIS questioned the need for additional office space in the Renton area. The City of Renton zoned Tracts A and B as Office Park (O-P) in 1986. The City of Renton is not responsible for establishing project need (i.e., market demand and economic feasibility). Additionally,the SEPA rules(WAC 197-11-448 [3])state that information that is not required to be discussed in the EIS include methods of financing the proposal and economic competition. ',vi ''i r. .,i„;•.`ri. 2.5 Description of the Proposed Action The Draft EIS presented two alternatives for Tract A(Al -Proposed Action and A2 - No Action), and three alternatives for Tract B ,(B1 - Proposed Action, B2 - Seven-Story Building with Parking Structure, and B3 - No Action). As a result of comments received on the Draft EIS, an additional alternative, the Open Space Alternative, has been proposed by the City of Renton. A description of this alternative plus the other alternatives previously identified in the Draft EIS, are presented in the Sections 2.5.1 and 2.5.2 following. 2.5.1 Tract A Alternative Al - Proposed Action The Proposed Action for Tract A is to construct three office buildings with surface parking in three phases over a four-year period. Phase 1 is scheduled to be constructed in 1990 and consists of a single-story±23,582 square foot office building and associated parking to be built in the western third of the site. Phase 2 is scheduled to be constructed in 1993 and consists of a four-story ±80,000 square foot building and associated parking to be built in the eastern third of the site. And, Phase 3 is scheduled to be constructed in 1994 and consists of a four-story, ±80,000 square foot building and associated parking to be built in #,c\i'l° the middle third of the site. The completed project will include a native riparian vegetative buffer between the development and the P-1 Channel, a biofiltration swale for stormwater, pedestrian areas adjacent to buildings, landscaped surface parking, a total of 791 parking stalls, and adherence to zoning and shoreline setback requirements and restrictions and restrictions established for the protection of the heron rookery. In response to comments received on the Draft EIS, the City has defined additional mitigation measures to further minimize the likelihood of significant adverse impacts to the great blue heron colony. Alternative A2 - No Action SEPA guidelines (WAC 197-11-440) require that the No Action Alternative be evaluated and compared to the other alternatives presented. Under the No Action Alternative, the site would not be developed. Tract A would be left as is and available for development consistent,with zoning of the site sometime in the future. The No Action Alternative would not meet the objective of the project applicant to develop the property. Under No Action, however, there would not be any of the environmental impacts associated with construction or operation. Alternative A3 - Open Space Alternative This alternative has been developed in response to comments received on the Draft EIS. The King County Office of Open Space requested that the purchase of Tracts A and B as open space (to be owned and administered by the Renton Department of Parks and ,, Recreation) be considered in the Final EIS. SA "7 Under this alternative, the purchase of FCDC property on Tracts A and B would be considered. Funding for the purchase would be sought from a variety of sources including • the King County Open Space Bond Issue Program, Urban Wildlife funds, the City of Renton,the Washington Wildlife Coalition,Interagency Committee for Outdoor Recreation (IAC), private funding groups (e.g., Bullit Foundation, The Trust for Public Lands), and funds that might be available under Initiative 547 should it pass during the November, 1990 election. Funds from those sources (or other sources that might become available), would be used to purchase the property. Under the Open Space Alternative, Tract A would become part of the City's open space program. Uses of the site would be oriented toward the maintenance of wildlife habitat and passive recreation uses. Such passive uses would include a pedestrian trail set behind an earthen berm approximately 100 feet from Springbrook Creek and the P-1 Pond 2-4 8/6/90 and 600 feet from the great blue heron colony. Trees and shrubs would be planted as a densely vegetated buffer between the berm and the creek and P-1 Pond. An observation platform would be established to allow viewing of wildlife in the pond and the rookery. The trail would join with a similar trail on Tract B and would become a part of the City's Pedestrian Master Trails Plan. Figure 2-4 presents a conceptual plan for the Open Space ternative. 2.5.2 Tract B Alternative B1 - Proposed Action The proposed Tract B project is the construction, in three phases, of three office buildings: • Phase 1 is the construction of a ±71,000 square foot, four-story office building with associated surface parking in 1990; • Phase 2 is the construction of a ±58,575 square foot, three-story office building and associated surface parking in 1991; and • Phase 3 is the construction of a ±156,625 square foot, seven-story office building and a three-story parking structure in 1992-93. Parking for the completed project will include approximately 496 surface parking stalls and 800 stalls within the parking structure. Other features of the proposed design include preservation of the old Black River channel and associated wetlands, located in the northwestern portion of the site; retention of a majority of the mature cottonwood trees; landscaping and buffering of development from natural areas; and adherence to shoreline and zoning setback requirements and restrictions established for the protection of the heron rookery. The site plan for the project is shown in Figure 2-5. The additional mitigation measures defined in Section 2.5.1 for Tract A would also apply for Tract B along with the following: • Shift of the proposed Phase 3 seven-story office building away from the edge of Springbrook Creek and toward Seventh Avenue, no closer than 750 feet from the heron colony. C Alternative B2 Seven-Story Building with Parking Structure Alternative B2 includes one seven-story office building, a four-story parking structure and surface parking. The development is designed to be consistent with the zoning requirements and"environmental constraints of the site. The proposed office building is expected to provide ±285,000 square feet of office space. Parking will consist of ±551 surface and ±800 within the proposed parking structure. The trail would also cross a bridge over the old Black River channel located on the south side of the property and joining with existing sidewalks along Seventh Avenue. In addition, a parking lot, restrooms, and a small picnic area could be developed between Oakesdale Avenue and a row of existing cottonwood trees located on the south side of the property.
