Upon arrival, I contacted the involved parties and confirmed no injuries had occurred requiring immediate medical response at the time of report. There, I collected the involved parties driving documents and their independent recollection of events leading up to the collision. The following interaction was completed through Language Line Solutions for Chinese interpretation. The driver of Unit#1 was operating a 26' box truck with "Moving" graphics on the side of the vehicle. The driver of Unit#1 said he and his adult passenger were traveling southbound in about the 3500 block of Benson Drive South just south of the intersection of SE 172nd ST. The driver of Unit#1 stated he was traveling directly behind Unit#2 and saw as Unit#2 had come to a stop for queued traffic at the upcoming intersection. The driver of Unit#1 stated that he simply was unable to stop in time and subsequently collided with the rear of Unit#2 causing no noticeable damage to the front of Unit#1. The driver of Unit#2 said she was the sole occupant of her vehicle and was also traveling southbound in about the 3500 block of Benson Drive South just south of the intersection of SE 172nd ST. While Unit#2 was stopped for queued traffic, Unit#1 collided with the rear of Unit#2 causing no noticeable damage to the rear of Unit#2. The driver of Unit#1 (Wu) was not paying attention to traffic in front of him. Wu violated Renton Municipal Code (RMC) 10-12-25 -Inattentive Driving which is defined as any person to drive a motor vehicle on any public highway, street, alley, or road in an inattentive manner in the City of Renton. "Inattentive manner" in this section means a lack of: 1) attentiveness required to safely operate the vehicle under the prevailing conditions, including, but not limited to, the nature and condition of the roadway, the weather conditions, the presence of pedestrians, the presence of other traffic, or by the driver focusing or directing the driver's attention to something other than driving the motor vehicle; or 2) attentiveness that would permit the driver of a motor vehicle to observe anything resting on, or traveling on, or entering the roadway in time to take appropriate action as circumstances require. (Ord. 4462, 7-25-94, eff. retroactive to 7-1-94; Ord. 5635, 11-14-11). Based on the above statements, I determined that the Driver of Unit#1 (Wu) is the proximate cause for the collision due to inattention causing a collision. Smith should have been paying closer attention to the movement of traffic in front of him. I also cited the driver of Unit#1 (Wu) in-person for violating RCW 46.30.020-Liability Insurance as no person may operate a motor vehicle subject to registration under chapter 46.16A RCW in this state unless the person is insured under a motor vehicle liability policy with liability limits of at least the amounts provided in RCW 46.29.090, is self-insured as provided in RCW 46.29.630, is covered by a certificate of deposit in conformance with RCW 46.29.550, or is covered by a liability bond of at least the amounts provided in RCW 46.29.090. Proof of financial responsibility for motor vehicle operation must be provided on the request of a law enforcement officer in the format specified under RCW 46.30.030. Unit#1 and Unit#2 were able to be driven away without further incident.
