RELEASE OF CLAIMS
THIS RELEASE ("AGREEMENT") is entered

TIMOTHY W. K�cCL/NCy ("McClincy) the sole ~'~ , 2018 ("Effective Date") between' property owner in fee of a duplex located at 806
Harrington Ave NE, Renton WA 98056 - Parcel Number 245720'0193 ("Property"); and the CITY RENTON, a Washington municipal corporation, ("City"). The City and McClincy are
collectively to as the "Parties."
Whereas, the City performed Construction work related to the Harrington Ave NE Green
Connections Stormwater Retrofit Project Phase II /''PrcUect~) onand near the Property located
a< 8U6HamngtonAve NE; and �
Whereas, the Parties agree that the City will pay McClincy in lieu of performing the
restoration work on the Property due to the construction work related to the City Project and
McClincy will in exchange for said payment grant release of claims to the City,
Now Therefore:
I, 'TIMOTHY W. Mc[UN[Y' being of lawful age, for the sole consideration of SIX THOUSAND
FIVE HUNDRED AND EIGHTY-THREE Dollars ($6,583.00) paid to me, as indicated herein and
receipt of which is hereby acknowledged:
1. In consideration of this Agreement, and settlement of all disputes between the
parties, I hereby release and forever discharge the City and its elected and appointed
officials, agents, officers, directors, employees, attorneys, and any and all other persons
or entities who have acted on its behalf from any and all claims, demands, warranties,
causes of action, obligations, damages, and any liabilities of any nature whatsoever
whether or not now known, anticipated, suspected or claimed, whicharoe out of, ar`
based upon, orare /nany vvayconnected tothe P �Project and '
nqrcs(orahonufnnyproperty.
2, In consideration of payment of the above sum, I agree to release, indemnify,defrnd' and hold harmless City and its elected and appointed offii /c' agents, officers,employees, attorneys, and any and all other persons or entities who haveacted on its behalf from any and all claims, demands, actions, suits, causes of action,
arbitrations mediations proceedings, judgments, awards, injuries, damages, liabilities,losses, fines, fees, penalties, expenses, attorney's or attorneys' fees, costs, and/orlitigation expenses to by any and
all persons or entities, arising from, resulting

3. I represent and warrant that I have the sole right and exclusive authority to
execute this Agreement.
4. I agree to provide the City of Renton with the necessary paperwork including a
signed VV'9' pursuant to City policy prior to receiving the settlement funds, to facilitate
McClincy 806 Harrington Ave NE Release Page 1 of 2
execution of the payment due. The payment will be made upon execution of this
agreement and completion of the necessary paperwork including a W-9.
