b) AB - 3941 Community & Economic Development Department recommends approval of
an ordinance granting ExteNet Systems, Inc., a five-year extension of their franchise
agreement to install small cell wireless facilities within city right-of-way. The anticipated
revenue from these small cell lease agreements is approximately $99,000 over the five-
year term of the franchise.

c) AB - 3953 Community & Economic Development Department submits a request for a 20-
year latecomer's agreement for water extension located at 117 Wells Ave S, by Satara,
LLC, and pursuant to RMC 9-5-5 recommends directing the City Clerk to send impacted
owners an approximate preliminary assessment and right to appeal notice for their
properties' inclusion in the assessment area.

CDBG Background
•CDBG funds are federal funds from the U.S. Dept. of Housing and Urban
Development (HUD) that must serve low -moderate income persons.
•City of Renton is a Joint Agreement City, a special designation for direct
entitlement metro cities that partner with their County for grant administration.
•Renton is part of the King County CDBG Consortium.
•These federal funds come with many regulations and restrictions, including
extensive planning documents, environmental review, Davis Bacon wage
monitoring, etc.

Join the Renton Police Department Thursday, October 16 from 4:30-6 p.m. for Cops & Barbers
at Good Vibes Only Barbershop (3700 NE 4th Street). Police officers will be onsite for open and
honest conversations that build trust and understanding. Ask questions, share your thoughts,
and maybe even a trim!
WSDOT will begin tolls on SR 167 starting Monday, October 20. For more information about the
new toll lanes please visit the tolling website at GoodToGo167.com.

events around your community.
Information about preventative street maintenance, traffic impact projects, and road closures
happening this week can be found at http://rentonwa.gov/traffic. All projects are weather
permitting and unless otherwise noted, streets will always remain open.

PROCLAMATION
Domestic Violence Awareness Month - October 2025: A proclamation by Mayor
Pavone was read declaring October 2025 as Domestic Violence Awareness Month in the
City of Renton and encouraging everyone in the community to take an active role in
supporting all victims so they can lead healthy lives safe from violent and abusive
behavior. The proclamation accepted with appreciation by Domestic Violence Victim
Advocate Tina Harris and DAWN Executive Director Gina Finley.

ADMINISTRATIVE REPORT
CAO Ed VanValey reviewed a written administrative report summarizing the City’s recent
progress towards goals and work programs adopted as part of its business plan for 2025 and
beyond. Items noted were:
x Plan to join us Friday, October 24 at the Renton Community Center for the Annual
Truck-or-Treat night. Encounter masterful Halloween displays while walking thru the
exhibits. This year’s event features two time slots – a sensory-friendly stroll from 5-
5:45 p.m. and a Walk-Thru Spooktacular from 6:15-7:30 p.m. For each participant
collecting treats, pre-registration is required and may be done by visiting
rentonwa.gov/register.
x Be sure to visit our website at rentonwa.gov/events for more upcoming holiday-
themed events around your community.
x Preventative street maintenance will continue to impact traffic and result in
occasional street closures.
AUDIENCE COMMENTS
x Ron Kunzler, Sedro-Woolley, expressed appreciation for being able to comment at
Council meetings virtually, noting that all government agencies should provide this
option to residents. He also expressed support for the Airport Traffic Control Tower
siting study.

6.b) AB - 3936 Mayor Pavone recommended confirmation of his appointment of Mr. Dorsol Plants
to the Planning Commission to fill a vacancy with a term expiring June 30, 2027. Refer to
Planning & Development Committee.

6.c) AB - 3935 Community & Economic Development Department submitted a petition for a
latecomer's agreement (LA-25-001), with Joseph Luta, for a sewer main extension on High Ave
NE, and authorize staff to forward the preliminary assessment roll to the City Clerk for
notification of affected property owners. Preliminary cost estimate is $408,183. Refer to
Utilities Committee.
6.d) AB - 3945 Community & Economic Development Department reported bid opening on
September 23, 2025 for the Legacy Square Phase 2 project, and recommended awarding the
contract to the lowest responsive and responsible bidder, Andersen Construction, in the
amount of $1,248,000 plus sales tax; additionally approve budget appropriations in the
amount of $1,498,650 from a Department of Commerce grant to be included in the 3rd
Quarter Budget Adjustment. Refer to Finance Committee.
6.e) AB - 3943 Human Resources / Risk Management Department recommended approval of the
2026 HMA (Healthcare Management Administrators) Fee Schedule; and authorization to
execute the implementing documents when they are ready, subject to legal approval as to
form. Refer to Finance Committee.
6.f) AB - 3944 Human Resources / Risk Management Department recommended approval of the
2026 renewal of the Kaiser Permanente healthcare premium rates for active employees and
LEOFF I retirees; and authorize execution of the implementing documents when ready,
subject to legal approval as to form. Refer to Finance Committee.
6.g) AB - 3931 Parks & Recreation Department recommended approval and acceptance of the
2026 Community Development Block Grant (CDBG) funds and contingency plan as follows:
Planning/Administration $65,363, Capital $313,743; and approval to execute the grant
agreements subject to approval as to legal form. Refer to Finance Committee.
6.h) AB - 3946 Public Works Transportation Systems Division recommended execution of Change
Order No. 2 to CAG-24-083, 2024 Slurry Seal project, contractor Doolittle Construction, in the
amount of $280,400 to add an additional four lane-miles of work. Refer to Transportation
(Aviation) Committee.
6.i) AB - 3947 Public Works Transportation Systems Division recommended execution of Change
Order No. 48 to CAG-22-163, Rainier Ave S Corridor Improvements - Phase 4 project,
contractor Pivetta Brother's Construction, Inc., in the amount of $111,794.25, for additional
work related to a storm drainage system redesign. Refer to Transportation (Aviation)
Committee.
6.j) AB - 3948 Public Works Transportation Systems Division recommended execution of a
professional services agreement with KBA, Inc., in the amount of $276,116, for construction
management services for the Oakesdale Ave SW Pavement Preservation project. Refer to
Transportation (Aviation) Committee.
6.k) AB - 3949 Public Works Transportation Systems Division recommended execution of a Stride
Access Allowance Fund agreement with Sound Transit, to accept up to an amount not to
exceed $790,000 to accomplish the Lake Washington Blvd HAWK Signal project. Refer to
Transportation (Aviation) Committee.

7.a) Transportation Committee: Chair McIrvin presented a report recommending concurrence in
the staff recommendation to authorize the Mayor and City Clerk to execute an A&E
Professional Services Agreement with Kimley-Horn and Associates, Inc. not to exceed
$342,298.58 for the ATCT Siting Study services.
MOVED BY MCIRVIN, SECONDED BY PÉREZ, COUNCIL CONCUR IN THE
COMMITTEE RECOMMENDATION. CARRIED.
7.b) Transportation Committee: Chair McIrvin presented a report recommending concurrence in
the staff recommendation to authorize the Mayor and City Clerk to execute Amendment No. 3
to CAG-23-128, A&E Professional Services with Century West Engineering not to exceed
$1,948,253.14 for construction management services associated with Taxiway Alpha
Rehabilitation.
MOVED BY MCIRVIN, SECONDED BY PÉREZ, COUNCIL CONCUR IN THE
COMMITTEE RECOMMENDATION. CARRIED.
LEGISLATION
Ordinances for second and final reading:
8.a) Ordinance No. 6167: An Ordinance of the City of Renton, Washington, amending Sections 5-
10-1 and 5-10-2 of the Renton Municipal Code to authorize an additional one tenth of one
percent Sales and Use Tax for Criminal Justice Purposes in accordance with Section 201,
Chapter 350, Laws of 2025, providing for severability, and establishing an effective date.
MOVED BY PÉREZ, SECONDED BY PRINCE, COUNCIL ADOPT THE ORDINANCE AS
READ.
Discussion ensued regarding the proposed elimination of the Electronic Home
Detention program in the upcoming mid-biennium budget adjustment. Responding
to Council inquiries, Police Chief Schuldt noted that the program is costly and will
be contracted out in the future. Finance Administrator Kari Roller noted the
program has lost over two million dollars over the past seven years. She also noted
that a longer discussion on this issue and other budget priorities will be done at
next week’s Committee of the Whole meeting.

b) Ordinance No. 6168: An Ordinance of the City of Renton, Washington, amending Section 4-1-

FISCAL IMPACT SUMMARY:
The current franchise has been in effect for a period of nearly 5 years. In the 5-year period a total of 49 lease
agreements were issued resulting in a revenue of $72,676.45. The anticipated revenue for the 49 lease
agreements over the next 5 years is $99,000. Revenue may increase if additional leases are applied for or as
existing lease sites are activated, however, it may decrease if existing leases are terminated.
SUMMARY OF ACTION:
Ordinance 5978 (Franchise) was signed September 23, 2020, granting ExteNet Systems Inc. (Franchisee) a
Franchise to install small cell wireless facilities within City Right-of-Way, and changed their entity structure
(from Inc., to LLC). The Franchise has a 5-year term with a requirement to extend an additional 5 years
provided the Franchisee makes a written request no less than sixty days before expiration and that the
Franchisee is not, nor has been in default with the Franchise terms. The Franchisee has complied with these
requirements; providing a written request more than sixty days prior to the expiration and is not, nor has
been, in default of the Franchise. Council shall determine if the extension of the Franchise should be
authorized.

days before the expiration of the current Franchise term, Franchisee may make a written request
for an additional Franchise term of five (5) years. City shall grant such request to Franchisee, in
accordance with then-applicable laws, unless Franchisee is or has been in default of the terms of
this Franchise beyond applicable notice and cure periods.”; and
WHEREAS, Renton Municipal Code 5-19-5 allows the Franchisee to renew its term unless
certain ability, capacity, compliance or other conditions exist; and
WHEREAS, RCW 35A.47.040 does not restrict extension or renewal of this Franchise; and
WHEREAS, the federal Telecommunications Act of 1996 (47 U.S.C. 151 et seq.) does not
restrict an extension of the Franchise; and

WHEREAS, on July 2, 2025, the Franchisee submitted a written request to the City of
Renton requesting an additional Franchise term of five years commencing on September 23,
2025, and terminating on September 23, 2030; and
WHEREAS, the City has reviewed the Franchise record and confirmed that the Franchisee
is not in violation of conditions of RMC 5-19-5, and is not, nor has been, in default of the terms
of the Franchise beyond applicable notice and cure periods;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION I. The Franchise granted by Ordinance No. 5978 is extended, under the current
name of ExteNet Systems, LLC, for five (5) years, subject to the Franchisee’s acceptance by its
authorized representative signing the Statement of Acceptance attached hereto as Exhibit A, and
commencing on the effective date of this ordinance, set forth in Section III herein.
SECTION II. Upon approval of the City Attorney, the City Clerk is authorized to direct the
codifier to make necessary corrections to this ordinance, including the corrections of scriveners
or clerical errors; references to other local, state, or federal laws, codes, rules, or regulations; or
ordinance numbering and section/subsection numbering and references.
SECTION III. If any section, subsection, sentence, clause, phrase, or word of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality thereof shall not affect the constitutionality of any other section,
subsection, sentence, clause, phrase, or word of this ordinance.

On August 13, 2024, Satara, LLC submitted a request for a latecomer’s agreement for a water extension benefiting other parties, located at 117 Wells Ave S. City staff reviewed the application and verified sufficiency of the request, the property ownership, the total cost figures, legal descriptions, and maps. A latecomer’s agreement application fee of $2,250 has been received. The total cost estimate is $317,925.
The first approval by Council initiates an appeal process in which impacted owners can appeal inclusion in the latecomer area. After an initial appeal period has passed and construction has been completed, a final proposed assessment and agreement will be presented to Council pursuant to RMC 9-5-7 and that agreement will be executed if impacted owners do not then successfully appeal the amount assessed.

Bassano Multi-family Water Extension (LA-24-001)
A request for a latecomer agreement has been received from the Satara, LLC for the
installation of approximately 270 linear feet of 12-inch water main in Wells Avenue S,
related to the development of a multifamily housing development at 117 Wells Avenue S
(King County Tax Parcel: 0007200168), known as Bassano Multifamily.
BACKGROUND SUMMARY
On August 13, 2024, the Satara, LLC submitted an application for a Latecomer Agreement
(File No. LA-24-001) for the extension of a 12-inch water main in Wells Avenue S to serve the
Bassano Multifamily development at 117 Wells Avenue S1. City Code and development
regulations require the installation of a new 12-inch water main to provide the required fire
flow of 2,500 gallons per minute for the new development. The existing 6-inch water main
on Wells Avenue S does not meet this requirement.
The proposed extension includes approximately 270 linear feet of 12-inch water main, 1 –
12-inch valves, 3 – 6-inch valves, related fittings and appurtenances, and final restoration
of the roadway pavement according to City standards.
The applicant has submitted a total construction cost of $317,925.00, which includes sales
tax at a rate of 10.3%. City staff has reviewed the submitted invoice receipts and
documentation and verified that the cost paid for construction of the water main was

$317,925.00, or $1,177.50 per lineal foot. This figure is higher than a comparable City
capital project within the downtown area, which was approximately $660 per lineal foot.
City Code (Section 9-5) allows private developers and property owners to apply for a
latecomer agreement for reimbursement of a portion of their original utility construction
costs if the improvements benefit adjacent properties. The costs, or “assessments,” are
equitably distributed on a pro rata basis to the benefiting properties.
The recommended method for distributing costs of this latecomer agreement is based on
the property frontage abutting each side of the street where the new water main will be
installed. It is recommended that the assessment be triggered when properties within the
latecomer boundary are developed or redeveloped, and such development or
redevelopment requires a fire flow demand exceeding 1,500 gallons per minute, which is
the capacity of the existing water system in Wells Avenue S.
The benefiting parcels from this water main extension include King County Parcels:
0007200168 (Applicant’s property - 117 Wells Avenue S), 7231502020 (121 and 123 Wells
Avenue S), 7231502005 (Not Addressed), 7231501979 (858 S 2nd Street), 0007200091 (118
Wells Avenue S), 0007200085 (122 Wells Avenue S), 7231501090 (126 Wells Avenue S), and
7231501095 (902 S 2nd Street). The legal descriptions of these parcels, as submitted with
the latecomer application, are correct. The total assessable frontage is 540 feet, resulting
in a pro rata share of the assessment at $588.75 per linear foot of frontage.
The application also includes a vicinity map showing the applicant’s property and
benefiting properties, as well as engineering plans for the proposed water main.
RECOMMENDATION
Staff recommends the acceptance of the latecomer agreement and its placement on the
Council’s agenda, with referral to the Utilities Committee. Additionally, staff recommends
that the cost distribution method for the water main extension be based on the fo otage of
property frontage abutting each side of the street where the new water main will be
installed. It is further recommended that the assessment be triggered when properties
within the latecomer boundary are developed or redeveloped and require a fire flow
demand exceeding 1,500 gallons per minute. After construction acceptance and the
determination of final costs, staff will present the latecomer agreement for final approval by
the Council.

PRELIMINARY ASSESSMENT: <frontage-footage of property x unit cost>
According to State Law (RCW 35.91.020, et seq. and RCW 35.72.010, et seq) “Municipal Water and
Sewer Facilities Act” and street latecomer’s legislation, respectively, the City may hold a Latecomer’s
against the construction of water facilities, sewer facilities and storm water facilities, for the
reimbursement by any owner of real estate who did not contribute to the original cost of such
facility(ies) who subsequently tap onto or use said facility(ies). Future users are subject to a fair pro -rata
share of the cost of the construction of said facility(ies). Costs will become payable by the future user(s)
upon issuance of a City permit authorizing the future user(s) to construct improvements that would
allow the users property to derive direct benefit from these facilities.
It is the intent of this notice to inform you the owner of the above-mentioned property, that under the
above referenced law, Satara, LLC, as a developer, has filed a request with the City of Renton to recover
a portion of its costs associated with the following project and that the cost recovery may likely affect
your property. A notice of potential assessment for latecomer recovery could be recorded against your
property within six (6) months of the date of this notice.
Contract: Latecomer’s Agreement No. 27-0055 – LA-24-001
Developer: Satara, LLC – Bassano Multifamily Project
Scope of Work: Installation of approximately 270 lineal feet of 12-inch water main and 1 fire
hydrant to increase fire flow capacity to properties adjacent to the following
street: Wells Ave S from 50 lineal feet north of S 2nd St to 270 additional lineal
feet north.
The proposed water main improvements will provide water capacity to meet fire flow demands from
future development and redevelopment of propert ies fronting the above-described streets.
A copy of the proposed assessment area is attached as the latecomer boundary map.
The preliminary estimated cost of project associated with entire assessment area is: $317,925.00.
The estimated project construction schedule is:
Water Main installation began in November 2024 and concluded in February 2025. Project completion
at 117 Wells Avenue S is anticipated at the end of 2025.

Criteria for Triggering the Latecomer Charges:
The Assessment from the Latecomer Agreement will be triggered only when a property within the
latecomer boundary area is developed and/or redeveloped, such that the development or
redevelopment of the property requires a fire flow demand over 1,500 gallons per minutes (gpm), which
is the existing water system capacity. The water main improvements that will be installed by the
developer under this latecomer agreement will provide fire flow capacity over 1,500 gallons per minute
(gpm). Therefore, any property that is developing or redeveloping and benefits from the additional fire
flow capacity created by Satara’s water main improvements shall be subject to this Latecomer Charge
whether or not a physical connection is made to the improvements.
Upon completion of construction of the facilities, when the City receives the actual (final) costs, a second
and final notice will be mailed to you verifying your inclusion in the latecomer (recovery area) boundary.
A statement of the final assessment dollar amount, as it applies to your property, will be provided on
this second notice. A notice of potential assessment will be recorded against your property. This will not
be a lien. The property can be sold or in any way change hands without the City triggering the
assessment. The assessment will only be due at the time your property receive benefit from additional
fire flow capacity created by the facilities.
Per City Ordinance No. 4443 you may appeal in writing to the Renton City Council, c/o City Clerk, 1055 S.
Grady Way, Renton, WA 98055, within twenty (20) days of this mailing by _______________, 2025.
Appeals must adhere to the criteria established under Sections 9-5-3 and 9-5-5.C and D of Ordinance No.
4443. During this preliminary stage, appeals will be limited to the issue of whether or not a specific
property should be included in the latecomer area. The enclosed Citizen handout explains the grounds
for protest and the process for filing on appeal.
If you do not receive a second and final notice, please be informed, your property was not included in
the final latecomer boundary and this first notice no longer applies.
