FOREWORD
The documents and forms which appear herein or for which provision is
made, must be used in submitting proposals to build the Windsor Hill Pumping
Station for the City of Renton, Washington, which is covered by the plans and
specificati.me therefor:
This Part V contains:
(a) Notice to Contractors;
(b) Proposal Forms;
(c) Typical forms for Agreement and Performance Bond,
both of which are subject to change by the Attorney
for the City.

NOTICE To CONTRACTORS
For the Construction of a
WINDSOR HILL PUMPING STATION
For The
CITY OF RENTON, WASHINGTON

Sealed proposals for furnishing all materials, equipment, labor,
and services of all kindafor the construction of the Windsor Hill Pumping Sta-
tion for the City of Renton, Washington will be received by the City Clerk until
PST on the day of 1460, and immediately there-
after said proposals will be publicly opened and read. A Contract will be awarded
or bids will be rejected within thirty (30) days after their opening.
The proj-ct consists of the construction of the Windsor Hill Pump-
ing station structure, installation of certsinitems of equipment as shown on the
plans and specified herein.
Pans and specifications may be examined at the office of the Super-
intendent of Utilities, Renton, Washington, or at the office of Stevens k Thompson,
Consulting Engineers, 705 Second Avenue, Seattle 4, Waahingta:.
Copies of said plans and specifications may be obtained upon applica-
tion to the engineets accompanied by a deposit of$25. 00. The deposit for the first
set will be refunded in full to any depositor who submits a bona fide bid and returns
the plans within ten (10) days after the bid opening or who returns said plans and
specifications in good condition witlun ten (10) days after receiving them, otherwise
only one-half of the said deposit will be refunded when the docc ments are returned.
For additional sets after the first, only one-half of the original deposit of $25. 00
will be refunded when the documents are recurred provided they are returned within
ten (10) days after the bids are opened.
All proposals must be submitted on the regular forms furnished with
the specifications and each must be accompanied by cash, certified check, or bid
bond in an amount not less than five per cent (5%) of the total bid. A corporate surety
bond in the full amount of the contract will be required to guarantee its faithful per-
formance.
The City of Renton reserves the right to reject any or all bids,
waive informalities, or to accept any bid which appears to serve the best interests
of the owner, the City of Renton, Washington.

MENT FOR THE CITY OF RENTON, ALL IN ACCORDANCE. WITH PLANS AND
SPECIFICATIONS THEREFOR WHICH ARE ON FILE AT THE OFFICE OF THE
SUPERINTENDENT OF UTILITIES, RENTON, WASHINGTON.

Gentlemen:
This proposal is submitted as an offer by the undersigned to enter into
contract with the City of Renton, Washington for furnishing of all materials,
labor, tools, equipment and service, f all kinds required for the construction
of Windsor Hill Pumping Station Structure, all as s.,t forth in the piano and spec-
ifications on file at the office of the Superintendent of Utilities, Renton, Wash-
ington and which are a condition hereto with the same force and effect as though
they were hereto attached. This offer is conditioned on the following declaration
as to the acts, intentions, and understandings of the undersigned and the agree-
ment of the City of Renton to the price or prices herein submitted;
1. All u: the contract drawings and specifications have been examined
by the undersigned and their terms and conditions are hereby agreed to.
2. It is understood that the contract drawings may be supplemented by
additional drawings and specifications ir. explanation and elaboration of the con-
tract drawings and it is agreed hereby that such supplemental drawings when
not in confiict with those referred to in Paragraph 1 above, will have the same
force and effect as if comple•ed and attached hereto and that when received they
will be considerea a part of the contract documents.
3. It is understood tha, all the work will be performed under a lump
sum contract and that for said surn all services, materials, labor, equipment,
and all work necessary to complete the project in accordance with the plans
and specifications shall be furnished for the said lump sum named. If there

shall be an increase in the amount of the work covered by a lump sum price,
it shall be computed on a basis of "extra work" for which an increase in pay-
ment will have been earned and if there be a decrease in a lump sum payment
it shall be made only as a result of negotiation between the undersigned and the
owner.
4. The undersigned shall furnish the bonds required by the Specifica-
tions, and comply with all laws of the State of Washington which are pertinent
to construction contracts of this character even though such laws may not have
been quoted or referred to in the specifications.
5. The cash, certified check, or bid bond accompanying this propo-
sal shall be forfeited to the City of Renton to the extent of five (5) per cent
of the amount of the bid in case this proposal is accepted by the owner and
the undersigned shall fail or refuse to execute the contract and furnish a per-
formance bond as required by the specifications within the time limit named
therein after notification that said proposal is accepted, all in accordance with
provisions of this proposal and the plans and specifications which are a part
hereof
6. All schedule items for which forms are provided herein shall be
completed in full by the showing of a unit or lump sum price for each item
thereof.
7, The undersigned proposes to furnish labor, materials, equipment,
and services of all kinds and to construct the Windsor Hill Pumping Station
Structure and the installation of certain items of equipment, all as required by
the plans and specifications and this proposal for the

therefor, or from any claim for damages or njury to uroperty or persons
arising by reason of said work; and shall in the time and manner, and under
the terms and conditions prescribed, well and faithfully do, perform, and
furnish all matters and things as by them in said contract undertaken, and
as by law, state and national prescribed, then this obligation shall be void;
but otherwise it shall remain in full force and effect.
PROVIDED, HOWEVER, that this boni is subject to the following
further conditions:
(a) Al: material men, and all persons who shall supply such laborers,
mechanics or subcontractors with material, supplies or provisions for carry-
ing on such work, shall have a direct right of action against the Principal and
Surety on this bond, second only to the right of the Obligee under this bond,
which right of action shall be asserted in proceedings instituted in the ap-
propriate court of the State of and insofar as permitted

Thank you for your order covering the 100 HP vertical motor. tie are
having this motor deliverer to our plant here so it can be mounted
the pump. The deduction for the suction barrel is $17tv
7.
I am enclosing Drawing A-2829, on^ for your files, and one I would like
to have returned and the cdaiensions filled in for the center line of
the discharge, and also information as to the relationship of the
auction barrel flange to the floor level. The outline shows the
2L - 1/2" holes on 22" bolt circle. We want to make sure the holes
in your flange line up according to the drawing so that tue discharge
head will relate properly to the suction and discharge piping.
You will notice that our drawlnr calls for 1/2" National coarse tapping.
If there is clearance under the flange, throurh bolts and nuts could be
used. The flange on the discharge head calls for 9/16" holes for bolt
clearance.
May we have this information by return mail so that we can start, the
fabrication of the discharge head.

The language as forwarded to me is in appropriate legal
form. I somewhat anticipate that Puget will wish a reference
in the front of the document that this is an amended easement
with reference to the old recording number of the easement
document that is being modified. If they do not wish that
language then there is no problem with executing the document
as prepared.

THIS INDENTURE, made this day of 1985,
between PUGET SOUND POWER 6 LIGHT COMPANY, a Washington
corporation, herein called "Grantor", and City of Renton, a
municipal corporation, herein called "Grantee",
WITNESSETH:
That in consideration of the sum of One Dollar ($1.00) in
hand paid, receipt of which is hereby acknowledged, and the
performance by Grantee of the covenants hereinafter set forth,
Grantor hereby grants unto Grantee, with ^t warranty of any kind,
an easement hereinafter described, for tn, construction,
maintenance and operation of the Windsor Hills pumping station and
appurtenant water mains, including but not limited to a water main
running from the new pump house south-easterly to the old pump
house situated at the southeast corner of the following described
land, all as shown on the attached Site Plan prepared by Stevens 5
Thompson, dated 4/12/60, bearing File No. 116-C-301, being the
first of three sheets, and not otherwise without the prior written
consent of Grantor, within and across the following described land
situated in the County of King, State of Washington, to wit:
Located in the Northwest 1/4 of the Southeast 1/4, of
the Southeast 1/4 of Section 8, Township 23 North, Range
5 East, Willamette Meridian, described as follows:
Commencing at the centerline Point of Tangent of Primary
State Highway No. 2, station 37+65.2A, said point being
a monument in case. Thence South 73 29' 30" West, at 900
to the tangent bearing, a distance of 30.00 feet, to the
Point of Tangent of the West. rly margin, of said Primary
State Highway No. 2, the Point of Beginning of this
easement. Thence South 73 2g'30" West, a distance of
45.00 feet. Thence South 16 30'30" East, a distance of
50.00 feet. Thence North 73029'30" Fast, a distance of
40.08 feet, to said westerly margin. Thence along said
margin, through a cubve to the right, the center of
which bears South 84 44'00" West, having a radius of
256.48, through a central angle of 11 14"30", an arch
distance of 50.32 feet, to the Point of Beginning.
This easement is .ranted on the following terms and conditions:
1. Grantee agrees to install and maintain substantial
permanent markers sufficient co give notice to all persons of the
location of Grantee's buried facilities, including without
limitation mainp, electric supply line, telephone lines and
drains.
2. Grantne will use and maintain its facilities on the
premises so as to be in accordance with all lilts, rules and
regulations of the State of Washington, and with specifications
for overhead crossings of electric powerlines, is approved and
specified from time to time by the National Electrical Safety Code
and ether applicable ordinances and laws.
3. Grantee agrees to save and hold Grantor harmless from all
loss or damage which may be due to the exercise by Grantee of the
right herein, granted and from all claims for such damage by
whnmsoever made and to indemnify Grantor for all such loss, damage
and claims.
4. Grantor reserves the right to use said land its own
purposes in any way, and to grant rights in said lane' co others,
no, inconsistent with the right herein granted to Grantee, and
Grantee hereby assumes all risk of loss or damage, including
damage or injury to persons or to property, which may be suffered

by Grantee resulting from Grantor's use Of said land and any of
its euipment thereon, whether said damage or injury be due to the
negligence of Grantor, its s;rvants or agents, or otherwise.
5. If the existen:e of Grantee s facilities shall require
the relocation or modification of any of Grantor's facilities on
or near the premises, Grantee agrees to reimburse Grantor for the
cost of such relocation or modification.
6. The right hereby granted shall cease and determine
whenever Grantee shall have discontinued the use of said facility
for one year and upon such discontinuance Grantee shall remove its
facilities and restore the premises to as good a condition as they
were in prior to the construction of said fac_lities.
7. Grantee agrees to pay any and all taxes, ass:ssments and
the like assessed against its said facilities and shall reimburse
Grantor for any increase in taxes payable by Grantor which is
based upon an increase in land •raluation occasioned by the
installation and maintenance of Grantee's said facilities.
8. All of the benefits of this agreement shall inure to the
benefit of, and the burdens hereof shall be imposed upon, the
successors and assigns of the parties hereto respectively.
9. Grantee agrees to install a chain link fence provided
said fence is electric311y grounded in accordance with the
following requirements:
A. Grounding Requirements - all wire or metal fences
on the above described property shall be electrically
grounded by installing 5/8" x 6' ground rods with a
f4 copper wire attached to the dr: en ground rod and
the fence fabric at all fence corners and every 100'
along the 'ante. A /4 copper wire shall also
electrically tie the fence fabric across the gate open-
ing. If the fence leaves the above described property
at a distance greater than 50' from the nearest ground,
an additional rod shall be driven at that location.
Grantor shall have the free and unrestricted access to the abcve
described property.
10. This easement is a revision of that ce• Ent
dated June 17, 1960 between the parties herein.
