(2) The readjustment of utilities by a contractor procured by the utility at our expense will be classified as "Public Roads Construction", Yule 171, and will not be taxable, (3) The readjustment of utilities by our contractor at our expense will be e18531fied as "Public Roads Conctruction11, Rule 111, and will not be taxable. (4) The readjustment of utilities by our contractor at the utilities expense will be taxable. D. The Business and Occupation lax rate applicable to "Public Roads Construction" is .0044. 3. The applicable changes in "Building Construction" are: A. The clraring of land or the moving of earth, Rule 170, are now taxable to the state. The contractor will be expected to collect the Retail Sales Tax from the Department on the full contract price. Paragraph Two, Section 7.01B of the Standard Specifications will be amended to delete the last sentence thereof at some future date. Also included ass recent charges in rulings by the Tax Commission. 1. The tetail Sales Tax is increased from 3 1/3 to 4% effective April 1, 1959. 2. The applicable changes in public road construction arc: A. This means there will be no Retail Sales Tax to this Department if a pit is offered. B. Public ioada contractors, i.e. persona who fall within the definition in Rule 171, will be liable for payment of the Compensating (Use) Tax on the value of sand, gravel and rock produced by them for use ir. connection with a contrtet to build, repair or toprove a publicly owned street, place, road, etc. The tax will be applicable to materials producec from pits or quarries granted by the Public authority, ae well as to natar'.als prxluc�d from a private pit or quarry whether or riot a public pit or quarry has been offered by the public body which lets the contract. COETRACTS AWARDED BY UTILITIES k Agreements involving work to '>e performed under a contract awarded by the Utility for F which reimbursement will be made from State and Federal `undo requi.­ special atten- tion in order to insure approval and participation by the Bureau .,' Public Roads. The agreement between the State and the Utility setting forth the cost obligation of the parties involved should be handled in the normal manner. However, the following procedure must be followed in the awarding of the contract by the Utility: 1. A list of prequ:;.ified contractors shall be submitted to the Plans and Contracts Engineer 1n advance of the solici utfon of bids. 2. Prior to the call for ', ids, two arts of the contract plans and specifications sha'l be forwarded to the Plans and Contracts Engineer for his review. 3. Upon authorization of the Engineer of Plans and Contracts to proceed, a date will Ni set by the Utility for the advertising or solicitation of Lids. 4. Upon opening of bids by the Utility, the District Engineer shall forward two sets of the bid tabulations to the Plans and Contracts Engineer for review. The District Engineer will state in the letter of transmittal his recommendations for the award or rejection of the bids. 5. The Engineer of Plans and Contracts will inform the District Engineer of his +� I acceptance of the bile, and the District Engineer will authorize the Utility to .. award and execute the contract. 6. Upon execution of the contract between the Utility and the contractor, two (2) sets of the fully executed contract plans shall he forwarded to the Plans and Contracts Division for permanent records of the Department of Highways and the Bureau of Public R,.ads. XI. CONCLUSION It is imperative that advance approval and itbcrizat,on be secured prior to the start of the relocation work siece established procedure act up by the B :reau of Public Roads prevents their participation of Federal funds for costs i.nc,rred fcr relocation work done prior to the authorization to proceed. PRCGMt1ING 1 Funds for the payment of costs to be incurred in connection with Utility agree- ` ments are to be Included in the district's construction budgets and programs. Billings from Utilities in connection with agrt.,ments are to be approved by the District Engineer and csarged to ,jobs in the same manner as other distrirt char;es. { 2. It Is the district's responslbility to inform the Work Control Engineer at the time Federal Aid data is transmitted to him of the existence of executed agree- ments, or agreements pending, which cover Unlit; adjustments to be accomplished at the department's expense. It is necessary that the nature of the proposed adjustments, the limits within which they lie and the total estimated cost of the adjustments be included in the Federal Aid data so that the work can be described fully in the Federal Aid program item covering the project. 3• If Utility adjustments are to be accomplished in advance a approval of the ME for the construction contract, either by the Utility £orcf� or by a separate contract, the Work Control Engineer Is to be supplied with the necessary data for the preparation of a separate program item and a request for authorization of funds. 4. It must be empivisized that participation in the cost of Utility relocation is con- i tingent upon the prior approve.' of the agreement and authorization to proceed with the work. Approval of the agreement alone does not constitute authority to proceed with the work. It will be the reapinsibility of the Director of High- ways to transmit such approval and authorization to the District Engineer of the District in which the work 1s located. The District Engineer shall see that no work is undertaken until this authorization has been received by him. 5. Authority to proceed with relocation and construction will be authorized by the Director of Highways after consummation of such of the following documents as may be required: (a) programming of necessary funds. (b) Execution of the required agreements. - . (c) Set-up of funds by the Forks Control Engineer. x (d) Approval of PSxZ by the Bureau of Public Roads and the Plans and Contracts Division. (a) Granting of necessary franchises or permits when required by Highway Commis- aion policy. } -lo- A. E. LETTER OF TRAIISM1TIAL >, All agreement documents are to be submitted ':o the Headquarters Engineer of Plans and Contracts with a letter of t:rensmietal in duplicate. This letter is to request the Plans and Contracts Enginear's action in preparing and processing the required agreement and stmzrld cover all special, conditions at which should be called to the attention of the Headquarters office and the Bureau of Public Roads with respect to the conditions of the agreement and any other facts which may be pertinent to the preparation ur handling of the Yr • agreement or the fund authorization. In addition, the letter of transmittal must cover: - 1. A statement setting forth the State's obligation to pay for all or part of the cost of the relocation Involved. This statement should cover the points made in paragraphs 3a(l), (I 2. A statement with respect to the status of ti.e fund authorizations which could be one of the following: (a) "to be included in contract coat estimate." (b) "funds act up on Job No. (c) "request for C Job authorization of funds attached." It is expected that the majority of Utility adjustments will be included with contract construction and "a" above will apply. PIII. PRCCEDURE AND PROCESSING OF VTIL": ACREEE 13 Plans and Contracts Division will hale furnishes the district with a reprnducible Utility map as provided in paragraph PII B-1 above and the Plans and Contracts Divisiur will upon receipt of the data from the district review the material and prepare the necessary number of copies of the sgreement and exhibits. The processing is to include the following clearance and routing: -8- 1, Work under continuing contracts generally forms only a part of the estimate of cost. The name and address of the contractor performing •-�._✓ �! the work and the estimated cost of the work should be shown separately { an the estimate. (d) Work Performed by State's Contractor The work accomplished under this type of agreement consists generally of relocation of storm seve. s and appurtenances, conduits for water -,•,k;` pipes, crossings for irrigation systems, and drainage systems, construe- tion of road approaches which encroach on private lands or railroad ,'.;•, right of way, etc. The estimate of cost for this type of agreement should contain the estimated quantities, estimated unit bid price and estimated costs for each of the various bid items covered under the agreement. To this should be added a percentage for engineering and contingencies. (e) Estimate of Cost Combining Methods cf Payment In agreements aovering work to be accomplished under two or more of the aforementioned methods of payments, the estimate of cost should show separate cost estimates ^overirg the work to be done under each method of payment. 3. Estimates on Iz.terstate Projects ' .r.r Until the legality of Chapter 330, Session 1Aws of 1959, can be determined and 'because of the provisions of this law, it will be necessary in many cases to provide two separate estimates of cost. (a) Estimate of cost for facilities to be relocated, the cost ooligations �? of which would be dependent upon the legality of Chapter 330, Session Laws of 1959• (b) Estimate of cost for relocation of facilities which would be the obli- gation of the State under existing laws. (c) Each estimate of cost submitted must be broken dawn consistent with the item: of work involved in the agreement. A` D. SPECIFICATIONS AND SPECIAL COK'IDERATIONS 1. The district shall prepare and forward two copies of proposed specifications. The specifications must include all special considerations and conditions as they may apply in connection with each project. 2. The s^^ -ifications should begin wish a detailed description of the work to E be a• inplished under the agreement. They should also include data as to how the rk proposed is to be accomplished; i.e., by Utility forces, by contract let .y the Utility or by the State, either through a State contractor or State day labor. 3. Also specifications, and special considerations are to contain a statement as to the time established for completion of the work under the agreement. They -7- 1 lj .vi. (e) A combination of two or more of above methods. (a) Work Performed by Utility Forces This is the usual) metho or aajustment of power, telephone and tele- graph lines, and because of the highly specialized nature of the work, is best accomplished by the Utility's own personnel and the use of the Utility's equipment and material. (2) Material items should be itemized to show the major components of cost. (2) Labor items will be se6regated by major labor classifications show- ing estimated total hours and rates for each classification. j (3) Equipment rental shall show the methoe ,f calculation. Show a list = of major units of equipment anticipated to be used in the work with the number of hours and rate for each type. (4) Overhead Stems should be llnt,d separately showing anticipated costs for construction engineering, supervision, general office expense and salaries, industrial insurance, social security, pen- sion, etc. (5) Salvage credits should be separate items on each estimate. Salvage value is the amount received for Utility property removed, if sold, or if retained for re-use. (o) Betterment of the Utility's system must Le deducted from the cost estimate. Betterment credit should be detailed to show analysis for determination of allowable credits. (7) Contract work (it' any should be shown separate and itemized to show the contract bid items and estimated prices of the bid items. The estimate of cost must be broken down to show the unit bid items and the anticipated unit bid prices. This type of agreement requires special procedure before the award of j contract by the Utility and will be discussed hereinafter under Section X, "Contracts A1+ardmd by Utiliti-s.' (c) Work Performed by utility under a Continuing Contract Certain Utilities maintain continuing contracts for performing specialized phases of their work. This type of agreement is permitted under P.2M 30-4, suaject to approval :ry the state and the BPR Division Engineer, with the understanding that the contract represents the lowest cost for the per- formance of the work involved. -6- 1 r M { 31 W 3 } A s ynP }. In connection with the relocation of underground facilities, it will be necessary for the district to furnish e. profile of the proposed relocated facility showing the depth of the pipe or conduit in relation to profile grade, rcadway shoulder and roadway ditch along with other pp.rtinproent data such as locatiDr. of shut-ofi valves, vent pipes, etc. This information must also be submitted with the Utility's application for a permit or franchise, eves though it fa included as a par: of the exhibit to the agreement. 4. The district shall slso show the prrper project designation (Job 'Title) on the exhibit map and the name of the Utility covered by the agreenent. 5. in connection with agreements whey= the cost obligation for relocation of facilities is divided between the Utility and the Jtate, the details of the divided obligation shall oe shown un the exhibit by appropriate symbol to ; provide an analys.z and check of the cost estimate. y 6. In cases wtere it is impra^ticable to use the State Utility maps to ade- quately show adjustment of the Utility facilities, the maps, prepared by tee Utility me.y be used as the base exhibit map providing the necessary ground control for highway stationing, right of way, frontage roads and access control is shown. 7• The district shall submit with the agreement a reproducible and two prints of all maps which are to be us<d me exhibit maps for the proposed agreement. C. ESTIMATE OF COST J 1. The method employed for the accomplishement of the work will determine the type of estimate that will be required. The purpose end value of an estimate of cost in the agreement is: (a) To provide increment cost data. (b) To lndicatp the approximate cum for funding purpose. (c) To provide a check against billiruis at time of audit. To provide this check, it 1.3 obvious that the estimate of cost shculd be prepared in a y form reasonably consistent with the accumulation of separate costs Sucurred. This form is a mandatory requirement for audit at the time for reimburaement. 2. Method for Accompli;sniRIL Work Estimates 01' cost may be made up of any of the following methods for accom- plishing the work covered by the agreement: (a) Work performed by Utility forces. (b) Work performed by Utility's contractor. (c) Work performed by Utility under continuing contract with private contractor. (d) Work pe"formed by State's contractor. -5- of this law be established; however, until this has been determined, the clause relating to this law, as shown in specimen agreement No. 1, will be } required in certain Utility agreements in connection with the Interstate System. 3• jdht cf_Occ ncY In cases involving relocation of public �r privately owned Utilities occupy- 4 ing their own right of wiy or located on private property by right of ease- ment or franchise, it will be necessary for the district to check the court house records to ascertain whether there is a recorded deed, franchise or easement covering the Utility location. 4 The court house volume reference, page and date of recording small be shown on the Utility exhibit map submitted with the agreement. In those cases where no deed cr franchise exists, covering the Utility's location rights, a letter from the Utility setting forth the basis for their right of occupancy sha`.1 be obtained by the District Engineer and submitted with the agreement. B. EXHIBIT MAPS 1. The Plans and Contracts Division will transmit to the district a set of reproducibles entitled "Utility Map". A complete set of reproducibles, excluding profiles, will be furnished to the district for each Utility listed on H.F. 22.71, unless advised otherwise by the district. In the event right of way zaps are not produced in connection with the project, the district may request the Plans and Contracts Engineer to furnish rep;+- ducibles of previous right of way maps or other pertinent maps for their use in preparing Utility maps. 2. The 'Utility Map" is to be used In connection with notifying each Utility of the required relocations and in preparing necessary agreement data covering any relocation or adjustment of an existing Utility. It is to be used as a base map on which all Utility adjustments are to be ai:nvr. :.y appropriate standard symbols and legends. All existing locations and prcposed relc ,tions are to appear. All other pertinent data which can be adequately detailed on '« the map and which to pertinent to the proposed improvement, such as pole size and height, pipe size and kind, and any temporary or permanent change to be made therein and, if Pert!neat, the stages by which the changes are to be accomplished should also be shown. All pertinent information for a complete and clear showing of all relocation details shall include: (a) Temporary Lines (b) Types, dimensions anc. diameters of existing and proposed pipe and conduit f lines (c) Type and size of existing and relocated overhead facilities (d) Type and capacity of conductors for telephone lines (e) Power line: should distinguish between service lines, distribution lines, transmission linen, etc. -4- ,t X a The district shall notify all such Utility Companies of the proposed work and shall obtain a cownitment in uritiag from each Utility, in which the Utility is to express its acceptance of the proyosed relocation at its expense, or In the event such commit- ment cannot ee secured, asetrtair. under what conditiune the desired move will be made. STANDARD AGREEMENT FJRN, T The proposed Utility agreement submitted by the District Engineer shall be made up to include the following documents: (A) Agree:,ent (t+ody or text of agreement) (8) Exhibit Maps C (C) Estimate of Cost (D) Specific:ati.onc and Special Considerations (E) Letter of Transa?ttal A. At:P.EEMM' 1. The distr.ct shall prepare and forward two copies of a draft of tte pro- posed agreement. The draft shall. include all of the provisions which are considered necessary in the particular situation. It uhculd be recognized that varying cond14jon4i make it necessary to modify any standard form in order that the aGreement adequately covers the work to be done. The specimen agreements included herein shall be used as a guide for the drafting of the agreement. The specimen agreements contain specific refer- ence to and are deaigned for use in connection with AFM 30-4. 2. Particular attention is called to the requirement regarding Chapter 330, Laws of 1959, invol<ring relocation of Utility facilities in connection with the Interstate System of Highways. V. DETERMINATICiI CF NLED FOR UTILITY AGREEMENT The need for an agreemen` can generally be determined ..ecore the right of way plans �. for the project nave been completed. Agreement Report Form H.F. 22.71 shall list all Utilities which are encountered within the scope of the proposed highway improvement. This form shall be sent to Headqur-rters at the time right, of way plans are submitted and shall be complete, as it affords a check list for the district and Heado,,L-te-e office. A report of the status of each anticipated Utility relocation mall afro be included in the Project Report H.F. 22,52 submitted by the district. In cases where the Utility will be required to relocate at their own expense, they shall be so informed by letter from tine District Engineer. A letter of concurrence acknowledging the Utility's root obligation should be secured from the Utility and forwarded, along with copies of all other correspondence between the District Engineer and the Utility, to Headquarters, Plans and Contracts Engineer, questions which arise regarding legal obligators of the Utility for relocation costs should be referred to the Plans and Cortracte Engineer who will, when necessary, 6 request an opinion from the Attorney Central and inform the District 6nginetr of the legal decision. That portion of Section 10.007 of the Manual for Engineers entitled "Work Performed by Public and Private Utilities," and amended by instructions dated June 61 1958, and August 27, 1958, entitled Reference ME 10.007(8) are hereby canceled and superseded by the follow- Ing instructions and procedure. The provisions contained in Bureau of Public Roads Policy and Procedure Memorandum (P&PN,) 30-4 are adopted as the department's standards for agreement and payment for the cost of adjusting the tarilities of all privately, publicly or cooperatively owned communication lines and facilities, any systems, lines and facilities for the distribution and transmission of electrical energy, oil, gas and water, including sewer, steam and other pipe lines. II. The provisions contained in Bureau of Public Reeds P&PM 30-3 are adopted as th, department's standards for agreement and payment for adjustments of railroad and similar iranspurtation facilities and for Utilities which ,}ointly own or use facili- ties with a rellroad company. III. The Right of Way Division will negotiate all transactions which involve tLe title to reel property wLich usually include the taking of a Deed or 'Waiver of raters at. However, the Right of Way Division will ait negotiate or arrange for any reloratioas or payment of costs involved in rearrangement of facilities as a right of way matter. In situatlona where the payment of moving costs is all or a Fart of the cc.'mideration for the land rigLLs, the district and the Right of Way Division are to cooperate in the negotiations with the Utility to the end that the agreement for relocation (the district's responsibility) and the transfer of land rights (Right of Way's resporal- bilit,7) are properly coordinated. However, I called your office and notified them of the emergency nature of this station and received an oral indication that we could proceed. As this station is the sole means or &8 ing water tc the Higniands reser voir and with summer months close upon Us, We could wait no longer for Olympia to give us approval and gave orders to proce,J with construction. We contend, that due to the emergency facing the department, we were justified in going ahead and as this is a part of toe Highway relocation we feel that the Highway Departmer : should re- considtr our prior proposal and reimburse the City of Renton for this construction.
