Reference: Grady Way Short Plat, i00-CO
Enclosed for final approval and recording is the final plat mylar for the
rbove noted project. According to your 'latter of February 1, 1982, we
understand that submission of the mylar at this time is acceptable.
It was brought to our attention on September 11, 1991 through a phone con-
versation between Steve Munson and Andv Padvorac that six Stems needed to
be resolved before the shot. plat could be recorded. Those six items are
listed below, each item being accompanied by an explanation of how it was
resolved.
1) "Puget Western must sign a Deferral of Off Site Improvements
Agreement."
Ilan Monaghan indiCLted that this Agreement is not necessary
because no more Improvements are planned adjacent to this
site.
2) "'he final short plat must have a storm drain easement."
A storm drainage easement that satisfies the criteria given
by Renton's Public Works Department is now shown on the
short plat drawing.
3) "Speeiflcally locate the waterline and grant an easement for
i; to the City of Renton."
?he waterline is now specifically lecatec <-, the short plat
drawing. An easement ,o the Cit•: of Renton is on the mylar
and a signed waterline easement document has been transmitted
with this letter to Renton's Public Works Depart vent for
recording.

4) "Show on the drawing the portion of Lind Avenue S.W. that the
City of Renton does not own, and dedicate that portion to the
City of Renton."
A document deeding the said portion of Lind Avenue S.W. to the
City of Renton has been acquired from Burlington Northern, the
most recent owner of said portion of Lind Avenue S.W., and has
been traosmit.ed with this letter to Renton's Public Yorks
Department for re, rding. Don Monaghan indicated the: the
portion of Lind Avs.tue S.W. being deeded to the City of Renton
by Burlington Notthern does not need to be shown on the short
Plat drawing.
5) "Renton's Traffic Engineer must accept the driveway, i.e.,
the Joint access easement."
We understand that the necessary approlals for the driveway were
finalised on December 30, 1980 by Fred Kaufma,,, the Renton Hear-
ing Examiner.
6) "The Legal Description must be run out and verified as accurate
by the City of Renton."
It is our understanding that the legal is accurate and will be
accepted as such by the City of Renton.
Dave Clements sent Puget Western a letter, dated October 26, 1981, that
stated that the property we're short platting was illegally segregated. We
understand that the transmittal of 'urlington Northern's Quitclaim Deed for
the said portion of Lind Avenue S.W. to Renton's Public Works Department
legalizes the segregation of our property, thus allowing o, property, north
of Grady Way between Lind and Rainier Avenues S.W., to be short platted.
Ron Olsen will receive, with a copy of this letter, the waterline easement
document for recording.
Don Monaghan will receive, with a copy of this letter, the Burlington Northern
document deeding a portion of Lind Avenue S.W. to the City of Renton for
recording.
Please notify Puget Western concerning the recording number of the easement
and provide our office with a copy of the recorded water line easement,

AGREEMENT FOR EASEMENT FOR WATER PIPELINE
THIS AGREEMENT made this 450 day of 1982 between
PUGET WEST-RN, INC. , a Washington corperat on, PWI1 herein) ,
and the CITY OF RENTON, a municipal corporation of the State of
Washington ('Grantee' herein).
WHEREAS, PWI is the owner of the following described
property:
See Exh'.Sit 'A• attached.
WHEREAS, Grantee desires an easement for a water pipeline
across PWI's property described above.
NOW .HEREFORE, in consideration of the performance by
3rantee of the covenants, terms and conditions hereinafter set
forth„ PWI hereby grants and conveys to Grantee the following
easement:
A. A perpetual easement across, along, in, upon and under
that portion of PWI's property described in Exhibit 'A'
attached hereto and by this reference made a part
hereof, for the purpose of installing, constructing,
operating, maintaining, removing, repairing and using a
water pipeline, with the connections and underground
appurtenances thereto (herein the 'Water Line") ,
together with the non-exclusive right of inyr. :s to and
egrrzs from said portion of PWI's property for the
foreyoine purposes;
WHEREAS, the Grantor agrees that no other utilities
shall run in and parallel is said easement for a water
Line;
The terms •easement• and 'Easement Area` in this instrument
refer to the easement on the property described in Exhibit 'A' :
This easement is granted subject to and conditioned upon the
following terms, conditions and covenants which Grantee hereby
promises to faithfully and fully observe and perform.
1. Cost of Construction and Maintenance. Grantee shell
bear and promptly pay al costs a expense, or constructing,
operating, maintaining, removing, and repairing the Water Line.
2. Com fiance With Laws and Rules. The Grantee shall
maintain an use the stir Line in accordance with the require-
ments of the National Electric Safety Code and any statute.

3. Access. "he Grantee shall maintain and use its Water
Line in such fashion as to permit reasonable and continuous
access along PMI's property in all directions, and in such

property free and clear of all obstructions and equipment.

or fails to perform or observe any of the terms and conditions
herein, and fails to cure such breach or default within ninety

within such other period of time as may be reasonable in the

Agreement in addition to and not in limitation of any other
remedy of MI, at law or in equity, and the failure of PMI �o
exercise such night at any time shall not wive PMI's right to
terminate for any future breach or default.
5. Termination for Cessation of Use. In the event Grantee
ceases to use t • stet ne for a period of five (5) successive
years, this Agreement and all Grantee's rights hereunder shall
terminate and revert to PWI.
6. Release of Water Line on T•raination. No termination
of this Agreement an a re ease rantee cram any liability or
obligation with respect to any matter occurring rrior to such
termination.
7. Release and inde�a_n�ity. Grantee does hereby release,
Indemnlfy sn pram se to defend and save harmless DWI from and
against any and all liability, loss, cost, damage, expense,
actions and claims, including costs and reasonable attorney's
fees incurred by PWI in defense thereof, asserted or arising
directly or indirectly on account of of out of (1) acts or
omissions of Grantee and Grantee's servants, agents, employees,
and contractors in the exercise of the rights granted herein, or
(2) acts and omissions of PWI in its use of the property which
will affect Grantee's employees, agents, contractors, and other
parties benefiting from said Water Liner provided, however, this
paragraph does not purport to indemnify PWI against liability for
damages arising out of damage to Water Line and/or property
caused by or resulting from an excessive amount of fill being
placed above said Water Line by PMI's agents or employees.
B. Title. The rights granted herein are subject to
permits, leases, licenses and easements, if any, heretofore
granted by PWI affecting the property subject to this agree-
ment. PWI does not warrant title to its property and shall not
be liable for defects thereto or failure thereof..
9. Notices. Unless otherwise provided herein, notices
requited to be n writing under this Agreement shall be given as
follows:

Notices shall be deemed effective, if mailed, upon the
second day following deposit thereof in the united States mail,
postage prepaid, certified or retistered mail, return receipt
requested, or upon del?very thereof if otherwise given. Either
party may change the address to which notices may be given by
giving notice as above provided.
10. Assignment. Grantee shall not assign its rights here-
under. No ass gnnent of the privileges and benefits accruing to
Grantee herein, and no assignment of the obligations or liabili-
ties of Grantee herein, whether by operatiun of law or otherwise.

11. Successors. The rights and obligations of the parties

That portion of the Burlington Northern, Inc. former 120 foot
wife right of way being a strip of land 20 feet wide lying 10
feet on each side of the following described centerline;
Commencing at the North quarter of Section 19, Township 23 North,
Range 5 East, W.H. ; thence South 01.22'570 West along the East
line of the Northwest quarter of said Section 19, a distrnce of
873.48 feet to the North line of the former Burlington rthern
Railroad right of way (Northern Pacific Railroad right ut way);
thence South 77.27'14• West along said North line, a distance of
902.48 feet to the True Point of Beginning; thence South

Dear Mr. Monaghan:
Your department has required Puget Western, in order to short
plat our property north of Grady Way between Lind Avenue and
Rainier Avenue, to grant the City of Renton an easement for
the city's existing water line that crosses our property.
Attacned is a signed and notarised Aqreement for Easement for
Water Pipeline for signature and witness by the city's represen-
tatives. Incorporated into this attached agreement are all
of the changes to the draft agreement that Ron Olsen requested
of Gus Erikson, of our office, in their discussion on November 20,
1981.
Please notify Gus Erikson if we can help expedite the recording
of this agreement. If we cannot be of assistance at this time,
please send us a copy of the agreement, after it is recorded,
for our records and to ensure the timely completion of the short
plat drawing for submittal to the city.

Mr. Olson:
The 12" cast iron water line which crosses the Grady Way pr,,perty between
Lind Avenue S.W. and Rainier Avenue S. will not be damaged by the proposed
cor.itruction operation. An investigation into the line and the stresses
induced from earthmoving equipment and overburden shows th,. strength of
material is not exceeded with A factor of satety. The information used
included the class of pipe, working pressure, elevation and cast iron
material (assuming weakest of common pipe) .ome of which van provided
by the City of Renton Engineering Department.
In additior, the line will be staked in the field and the field engineer
and equipment operators will be instructed to exercise caution in the
area of the Water line.
