According _o your letter of February 1, 1982, we understand that submission of the mylar at this time is acceptable. It was brought to our attention on September 11, 1981 through a phone con- versation between Steve Munson and Andy Padvorsc that six items needed to be resolved before the short plat could be recorded. Those six items are listed below, each item being accompanied by an explanation of how it vas resolved. 1) "Puget Western must sign a Deferral of Off Site Improvements Agreement." Don Monaghan indicated that this Agreement is not necessary because no more improvements are planned adjacent to this site. 2) "The final short plat must have a storm drain easement." A storm drainage easement that satisfies the criteria given by Renton's Public Works Department is now shown on the short plat drawing. 3) "Specifically locate the waterline and grant an easement for it to the City cf Renton.' 11"e va teriine is now specifically locates on the short plat drawing. An easement to the City of Renton is on the mylar and a signed waterline casement document has been trar.smitted with this letter to Renton's Public Works Department for recording. Page 2 of 3 March 29, 1982 GFAD-1/82-CACS 4) "Show on the drawing the portion of Lind Avenue S.W. that the City of Renton does not own, and dedicate that portion to the City of Renton." A document deeding the said portion of Lind Avenue S.W. to the City of Renton has been acquired from Burlington Northern, the moat recent owner of said portion of Lind Avenue S.W., and has been traasmttted with this letter to Renton's Public Works Department for recording. Don Monaghan indicated that the portion of Lind Avenue S.W. being deeded to the City of Renton by Burlington Northern does not need to be shown. on the short Plat drawing. 5) "Renton's Traffic Engineer must accept the driveway, i.e., the joint access easement." We understand that the necessary approvals for the drivewav were finalised on December 30. 1980 oy Fred Kaufman, the Renton Hear- ing Examiner. 6, "The Legal Description must be run, out and verified as accurate by the City of Renton." It is our underatanding that the legal Is accurece and will be accepted as such by the City of Renton. Dave Clements sent Puget Western a letter, dated October 26, 1981 that stated that the property we're abort platting was illegally segtegated. We understand that the transmittal of Burlington Northern's Quitclaim Deed for the said portion. of Lind Avenue S.W. to Renton's Public Wcrks Department legs Uses the segregation of our property, thus allowing our property, north of Grady Way between Liud and Rainier Avenues S.W., to be short platted. Ron Olsen will receive, with a copy of this letter, the waterline eaasmnnt document for recording. Don Monaghan will receive, with a copy of this letter, the Burlington Northern document deeding a portion of Lind Avenue S.W. to the City of Renton for recording. Please notify Puget Western concerning the recording number of the easement and provide our office with a copy of the recorded water line easement, dedication of Lind and Grady Way Short Plat aLM-80. WHEREAS, PWI is the owner of the following described property: See Exhibit "A" attached. WHEREAS, Grantee desires an easement for a water pipeline across PWI's property described above. NOW THEREFORE, in consideration of the performance by Grantee of the covenants, terms and conditions hereinafter set forth, PWI hereby grants and conveys to Grantee tee following easement: A. A perpetual casement across, along, in, upon and under that portion of PWI's property described i,. Exhibit "A" attached hereto and by this reference made a part hereof, for the purpose of installing, constructing, operating, maintaining, removing, repairing and using a water pipeline, with the connections and underground appurtenances thereto (herein the "Water Line") , teaether with the non-exclusive right of ingress to and egress from said portion of PWI's proper•v for the foregoing prrposes; WHEREAS, the Grantor agrees that no other utilities shall run in and parallel to said easement for a Water Line; The terms "Easement" and "Easement Area" in this instrument refer to the easement on the property described in Exhibit "A" : This easement is granted subject to and conditioned upon the following terms, conditions and covenants which Grantee hereby promises to faithfully and fully observe and perform. 1. Cost of Construction and Maintenance. Grantee shall bear and promptly pay all costs and expenses for constructing, operating, maintaining, removing, and repairing the Water Line. 2. Compliance With Laws and Rules. The Grantee shall maintain and use the Water Line to accordance with the require- ments of the National Electric Safety Code and any statute, order, rule or regulation of any public authority having jurisdiction. 3. Access. The Grantee shall maintain and use its Water Line in such fashion as to permit reasonable and continuous access along PWI's property in all directions, and in such fashion as to accommodate and support vehicular travel over and across the Water Line. Grantee shall at all times keep PWI's property free and clear of all obstructions and equipment. 4. Termination for Breach. In the event Grantee breaches or fails to perform or observe any of the terms and conditions herein, and fails to cure such breach or default within ninety (90) days of PWI's giving Grantee written r.otice thereof, or within such other period of time as may be reasonable in the circumstances, PWI may terminate Grantee's rights under this 0 Agreeme . in addition to and not in limitation of any other remedy of PWI, at law or in equity, and the failure of PWI to exercise such right at any time shall not waive PWI's right to terminate far any future breach or default. 5. Termination for Cessation of Use. In the event Grantee ceases to use the Water ne for a per�.od of five (5) successive years, tNis Agreement and all Grantee's rights hereunder shall terminate and revert to PWI. 6. Release of Water Line on Termination. No termination of this Agreement shall release Grantee from any liability or obligation with respect to any matter occurring prior to such termination. 7. Release and Inde�mniity. Grantee does hereby release, indemnify and promise to defend and save harmless PWI from and against any and all liability, loss, cosy, damage, expense, actions and claims, including costs and reasonable attorney's fees incurred by PWI in defense thereof, asserted or arising directly or indirectly on account of or out of (1) acts or omissions of Grantee and Grantee's servants, agents, employees, and contractors in the exercise of the rights granted herein, cr (2) acts and omissions of PW1 in its use of the property which will affect Grantee's employees, agents, contractors, and other parties benefiting from said Water Line; provided, however, this paragraph does not purport to indemnify PWI against liability for damages arising out of damage to water Line and/or property caused by or resulting from an excessive amount of fill being placed above said Water Line by PWI's agents or employees, 8. Title. The rights granted herein are subject to permits, leases, licenses and easements, if any, heretofore granted by PWI affecting the property subject to this agree- ment. PWI does not warrant title to its property and shall not be liable for defects thereto or failure thereof. 9. Notices. Unless otherwise provided herein, notices required to 6e 7n- writing under this Agreement shall be given as followse If to PWI: Puget Western, Inc. Either party may change the address to which notices may be given by giving notice as above provided. 10. Assignment. Grantee shall not assign its rights here- under. No assignment of the privileges and benefits accruing to Grantee herein, and no assignment of the obligations or liabili- ties of Grantee herein, whether by operation of law or otherwise, shall be valid without the prior written consent of PWI. 11. Successors. The rights and obligations .r the parties shall inure to the henefit of and be binding upon their respec- tive successors and assigns. 12. Liability. Attached is a signed a--d notarized Agreement for Easement for Water Pipeline for signature and witness by the city's represen- tatives. lncorporated into this attached agreement are all of the changes to the draft agreement that Ron Olsen requested of Gus "Irikson, of our office, in their discussion on November 20, 1981. An investigation into the line and the stresses induced from esrthmoving equipment and overburden shows the strength of material is not exceeded with a factor of safety. The information used included the class of pipe, working pressure, elevation and cast iron material (assuming weakest of common pipe) some of which was provided by the City of Renton Engineering Department. In addition the line will he staked in the Field and the field engineer and equipment operators will be instructed to exercise caution in the area of the water line.
