Attached hereto for your reference is print with water line indicated
thereon and as we Ivad disenseed at that meeting, the description would
be very simple in that it would cover a ten foot wide easement lo•atmd in
(ktvernment Lot 1, !!action 10. Township 22 North, Range 5 F. . K M..
King County, Washington, and being indicated in red on the atachW
print. I also checked out any other permitr or Unto within this area, and
Permit No. 94804 and 4S$$$ appear to be outside of the area sold to
Mr. Welts.
It will be appreciated V you would prepare an easement, in form satisfactory
to the city, being in favor of Duane Wells, Inc. . and return same to me
and I will attempt to have It executed on his behalf.

Re: Water Line on Puget Sound Power d Light Property SP-072-89
Mr. Olson:
The 12" cast iron water line which crosses the Grady Way vroperty between
Lind Avenue S.W. and Rainier Avenue S. will not be damaged by the proposed
construction operation. An investigation into the line and the stresses
induced from earthmoving equipment and overburden shows the strength of
material is not exceeded with a factor of safety. The information used
included the class of pipe, working pressure, elevation and cast iron
material (assuming weakest of common pil ) some of which was provided
by the City of Renton Engineering Department.
In addition the line will be st.-.ked in the field and the field engineer
and equipment operators will be instructed to exercise caution in the
area of the water line.

Said heretofore mentioned grantee, its successors or assigns, shall
have the right, without prior notice or proceeding at law, at such times as
may be necessary to enter upon said above described property for the purpose
of constructing, maintaining, repairing, altering or reconstructing said
utility, or making any connections therewith, without incurring any legal
obligations or li,+bility therefore, provided, that such construction, main-
taining, repairing, altering or reconstruction of such utility stall be
accomplished in such a manner that the private improvements existing in the right
right(s)-of-way shall not be disturbed or damaged, or in the event they are
disturbed or damaged, they will be replaced in as good a condition as they were
immediately before the property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the aforedescribed premises,
including the right to retain the right to use the surface of said right-of-way
if such use does not interfere with installation and maintenance of the utility
line. However, the grantor shall not erect buildings or structures over, under
or across the right-of-way during the existence of such utility.
This easement, shall be a covenant running with the land and shall be bind-
ing on the Grantor, his successors, heirs and assigns. Grantors covenant that
they are the lawful owners of the above properties and that they have a good and
lawful right to execute this agreement.
