It is to be noted that a barn and shed in Lot 3 have bean removed and although it does not bsve any bearing upon this objection sines Mr. Levin is not tho owner of Lot S, the house and abed shown on Lot S have also Wan removed. The only encroachment left upon the City of Seattle right-of-way is the pumphouse which encroaches thereon and is located partially on Lot 1 and Lot 2, In accordance with a letter which was directed to Mr. Lavin :order date cf May 230 1957, by the City of Seattle Department of Lighting, this small pisphouse would be allowed to exist as an encroachment for the life of the existing building only. It is, therefore, quite apparent that no improvements will be al- Iow d on these lots in question, and no benefit will be derived by re ,son of the suDjoc- water line and resultant assessments as to the subject Into. Mr. Lavin further wishes to point out that only one water sbrvicx for Lots 1 and 2 will be ordered and no water service far tots 3 and a. We respectfully submit that the amount of the assessments made as to Lots 2 , 3 and M is excessive and that no benefit is derived therefrom since no practical use of the lots in question can be no" and no improvements a:e possiole , and we request the runcil to redistribute the amount of said assessments over the remaining assessable lots which are bensfitir.g from the improvement, there- by eliminating the assessments as to Lots 2 , 3 and is. Mr. Lavin's chief objection is directed tc assessment 1e%ied against Lots 2 , 3 and 4 of Cedar River Summsr I:ome aitss in the fol- lowing amounts, respectively: $121.08, 3332.Yy and 11344.51. The Chief season for his objection to these amounts is the fact that Lots i and 4 are entirely within the City of Seattle right-of-way for the be&ttlo Diablo transmission line , and rise line itself passes directly over Lot 3 and a *sell portion of Lots 2 and 4. However, it is impossible to improve these lots by reason of the right-of-way and, in fact, these lots are unimproved at this time and not subject to improvement. I be.lieve the basic principle bahand assessments of this type is that there can be no A&e*&ement on property unless there is a ero tanto benefit from the improvement. boa btate of kashin ton ex "T.Treaa v, xcFinand Fark, $4 dn. It is to be noted that a barn and shed on Lot 3 have been removed, and although it is does not havc any bearing upon this objection since Mr. Lavin is not the owner of iot 5, the house and shed shown on Lot 5 have also been removed. The only encroachment left upon the City of Seattle right-of-way is the pumphouse which encroaches thereon and in located partially on Lot 1 and Lot 2. 'n accordance with a letter which was directed to Mr. Lavin under .date of May 230 1957, by the City of Seattle Department of Lighting, this mall pumphouse would be allowed to exist as an encroachment far the life of the existing building only. It is, therefore, quite apparent that no improvements will be al- lowed on these lots in question, and no benefit will be derived ljy reason of the subject water line and resultant assessments as to the subject lots. Mr. Lavin further wishes to point out that only one water service for Iota 1 and 2 will ba ordered and no rater service for Lots 3 and 4. We rsepectFully submit that the amount of the assessments made as to Lots 2, 3 and 4 is excessive and that no benefit is derived therefrom since no practical use of the lots in question can be made and no improvem. s are possible, and we request the Council to redistribute the amount of said assessments over the remaining assessable lots which are benefiting from the improvement, there- by eliminating the assesm ents as to Lots 2, 3 and 4. John Lavin of 12e01 S. E. 142nd Place, Renton, Washington, has instructed me to file his objections herewith to the assessments mad* on the assessment roll for the improvement of Ceder River Summer Howe Sites water system as set forth in Revolution No. 1324 comprising Local Improvement District NO . 264 under Ordinance No. 2190 of the Rentor. C(ty Council. thy. 1,avin's chief objection is directe -1 to the assessment levied against lots 2. 3 and 4 of Cedar Rive Summer Home .Sites in the fol- lonita amount*, respectively' $321.08, $332.99 and $344, 66 . The chit ' reason for his objection to these amounts is the fact that Lots 3 and 4 are entirely within the City of Seattle right-of-way for the Seattle Diablo transmission line, and the line itself pasess directly over Lot 3 and a small portion of Lots 2 and 4. 4*wevor, it is impossible to improve these lots by reason of the r'.rht-of-way and, in fact, these lots are unimproved at this time and not vubj*ct to improvement. I believe the basic principle tahind assessments Qf this type is that theta can be ro aoseeoent on property unless there is a Era tanto benefit from the improvement. Sea State of Waehin ion *x rZr-Press v. Normandy park, 64 an. (2d) 4our court Ws also hold that pirp i; y—m specially benefited by lcr-al improvement way not be rssessed to pay the cost thereof. See Appeal of Jones, 52 WrL. (2d) I43. According to Mr. :.avin, he understood that the Council Meeting of October 1*, 1966, had indicated that the assessment would not be made agaicst the subject lots, as there wai no benefit to be d*- rived and that the cost would be born by the division, of the amounts involved among the Sots ;*enefited.
