W IT NESS ET H: 1. CITY hereby agrees to employ ENGINEFR and ENGINEEP agrees to perform professional services, as hereinafter more particularly described, relating to the establishment, improvement and construction of additional water system improvements located within the Renton Highlands area and the Southeast area of the CITY OF RENTON, all as more particularly described hereinbelow. Z. The services of ENGINEER shall include the following, to-wit: ENGINEER agrees to review projected water demands for said two areas (Highlands area of Renton and Southeast area of Renton as hereinafter more particularly described) and prepare preliminary designs and cost estimates for pump stations, equipment, appur- tenances and controls relating thereto. ENGINEER would consult from time to time with CITY and upon approval of preliminary design, ENGINEER then to proceed with the final design. Thereafter ENGINEER will prepare and furnish plans and specificatio,s in detail, complete, for the public facilities and furnish servicm< pertaining to construction phase as prescribed in Paragra�,h 5 hereof (but excluding work in connection with the proposed trunk mains). For purposes of simplification tht., Agreement shall cover and relate to two (2) separate projects hereafter described as follows: A. Highlands Area - Mt. Olivet Booster Pump Station -I- B. Southeast Area - Talbot Reservoir Booster Pump Statio.., including Talbot Hill Area and new development east of Springbrook Road; new development north of Puget Drive, including Rolling Hills and Tiffany Park; Renton Hill Area as indicated by study of up-to-date information and immediate facilities to be constructed thereat, 3. For each such project. A and B above, the engineering services, in addition to the aforementioned, shall include the following: A. Consultations from time to time with City officials and governmental agencies relating to and having jurisdiction over said sites and works, B. Planning for any necessary field information for design except that detailed field survey work for plans and profiles would be furnished by City forces. C. All technical assistance to CITY in design of the pipeline from Talbot Reservoir to Benton Highway. D. Final design of pumping and related facilities in preparation of detailed contract drawings, specifications, contract documents and separate contracts, together with cost estimates, preparation and delivery unto CITY of a sufficient number of copies of drawings and specifications for final review, securing bids, and awarding contracts. 4. In consideration of such services as hereinabove outlined CITY will pay unto ENGINEER the following amounts, to-wit: A. The sum of $3, 200.00 for all j:the aforesaid work in connection with the "Highlands Area project". (Project A) B. The suer. of $4,450.00 for all of the aforesaid work in connection with 'he 'Southeast Area project', as above defined. (Project B) S. After completion of the services specified in Paragraph 3, ENGINEER shall further perform the following services pertaining to the construction phase of the aforesaid two projects, which services shall include the following: A. Assistance in securing bids; tabulation and analysis of bid results; recommendation of contract award; preparation of formal contract documents for award of contracts; resolution of contract drawings to fit actual field conditions encountered; consultations from time to -Z. time and advice to City officials during construction; checking detailed construction, shop, erection and equipment drawings and specifications; review of laboratory. shop and mill test reports of materials and equipment and reports therefor to the City officials from time to :tme. B. Periodic inspection of work in progress and consultation with City officials a A contractor and prompt advice to CITY of any defects, irregularities or unnecessary delays. C Preparat. ,n of pay estimates during construction. D. Observation of initial operation of the project and of performance tests required by the specifications and prompt reports thereof unto City officials, E. Final inspection and report to the Council on the completed project and acceptance thereof by CITY. F. Preparation of as-built drawings with sufficient copies to be furnished unto CITY. In consideration of all of the aforesaid work during construction phase. CITY will pay unto ENGINEER the following amounts: A. The $urn of $900.00 for the Highlands Area Project. B. The sum of $1, L00.00 for the Southeast Area Project. In the event that CITY wishes ENGINEER to provide additional services, including resident engineering services, all such work shall be performed on the basis of payroll costs plus seventy-five percent (75%a) of payroll for resident services and one hundred percent (100%) of payroll costs for all other additional services plus expenses at cost. The scope ui the additional services shall receive prior approval of CITY 6. Either party hereto shall have the right, at any time, to terminate this Agreement, or either project specified therein, upon not less than five (5) days' written notice, unto the other party; in the event of such termination, .3- ENGINEER is to receive and accept as full payment for services performed prior to the notice of such termination the amount then due ENGINEER under this Agreement at the time of such notice, duly prorated to date of termination. 7. All plans, drawings, specifications and designs prepared by ENGINEER for CITY, and after payment therefor by CITY, shall be and remain the property of CITY. g. It is further agreed and understood that ENGINEER will commence work within ten (10) days from execution of this Agreement and complete all services specified in Paragraph 3 within three (3) months from the date hereof for Project A and five (5) months for Project N. ENGINEER will complete all services specified in Paragraph 5 within two (2) months after final acceptance by ENGINEER of construction of each project. Time is of the essence. 9. Neither ENGINEER nor CITY shall assign or transfer its interest or obligation under this Agreement without the written consent of the other. This Agreement shall be binding upon the parties, their partners, legal representatives and/or assigns. Any questions becoming in dispute under this Agreement, if the parties are unable to resolve same between themselves, shall he submitted to arbitration at the choice of either party, in accordance with the arbitration rules and procedures applicable hereto under tare laws of the State of Washington. 10. Olivet Pump Station As you dre aware, on 0 September 1966 Mr. A. B. Barnes and I met at the Renton watershop to review the City's water tacilities'supervisory control system with the supplier. Mr. R. Teeson of the Service Controls Company. Our purpose was to determine the advisability of expanding the present Control system to include the new control requirements. not only for the Mi. Olivet pump station, but also for the other projected water system improvements. As a result, we found: 1. The present supervisory control system is in reasonable working order. 4. The City is apparently self-sufficient in the day-to-day operation and maintenance of the system. 3. The present system can accommodate the controls for the Mt. Olivet pump station and probably for other projected system improvements. 4. Expanding the pret.ent system would appear to be less expensive than installing a separate system to control the new pump station. We therefore recommend that the supervisory control system for the Mt. Olivet pump station be deleted from the forthcoming pump station construction contract and that a price be negotiated directly with the Service Control Company. This company's proposal should provide for the following control functions, utilizing existing equipment where possible: Mr. Jack Wilson 29 September 1966 Page -2- 1. Transmission of four (4) water level points from the Highlands ground level reservoir to the City's watershop. Transmission of signals from the watershop to the pump station to stop and start four (4) pumps. 3. Transmission of signals from the pump station to the watershop to visually indicate that a pump is operating and totalizt the operating time for each pump. 4. Transmission of signals from the pump station to the watershup to totalize the water flow from the pump station. 5. Transmission of various alarms to the watershop tc indicate power failure at the pump station, failure of any pump to start, and any telephone line failure. It would be desirable for us to review their proposal to ensure that the required functions will be performed. We would also compare the bid price with the cost of equipment of other manufacturers. As our electrical design for the pump station depends on how this control system will be provided. we will await your approval of our recommendation. Please contact us if you have any questions. Olivet Booster Pump Station We enclose a tabulation of the bids received by the City Council on 21 Novembmr 19ob which have been corrected for error& in entering the bids or computing State Sales Tax. Pump submittal data was received iron- 9 manufacturers, all of which essentially met the specifications and were acceptable. The bids have been analyzed in accordance with the Contract Documents. Evaluation includes consideration of the lump sum base bid for construction, excluding furnishing and installing pumping equipment; price f>r furnishing and installing two pumps of the same manufacturer with dri•dng motors; and power costs of operating the pumps for 50,000 hours at 5 nuts per kilowatt hour. Prices based on each of these criteria are separately discussed below before adding State Sales Tax. The low base bid for construction was submitted by Venture Construction, Loc. , of Auburn, Washington, in the amount of $41, 192.00. The second low was that of Crown General Construction, lnc, of Seattle at $42,716. 00. This latter bid was qualified with regard to butterfly valves. The total cost of construction, equipment and power costs does not change the low And second low bidders, and these two bids only have been examined in detail. Venture Construction's proposal for U.S. Pump No. 2 included a discrepancy between the written amount "Four 'Thousand Seventy-Six Dollars and No Cents" and the amount stated in figures "$4,976.00." Under Item 5 of the Information for Bidders, the written amount shall govern and this aniuunt has therefore been used in analyzing the bids. On this basis, their proposal for Worthington Pumps and General Electric motors is their lowest equipment bid for a total of $8, 101.00. Crown General's lowest equipment cost is $8,900.00. A strict comparison of equipment costs should include interest on the extra capital cost of the Worthington equipment proposed by Venture which is $910 higher than the U.S. equipment Taken over a 10-year period at 4 percent compounded, the interest would amount to $437. The total cost of the Worthington equipment and power would then be $58,024, and of the U.S , $57,838 (using written amount) making the U.S. equipment the cheaper. If the Contractor were allowed the error iu his bid, th, Worthington equipment would be cheaper. Venture Construction Co. , Inc. has verbally requested consideration of two errors in their bid. It has been requested that the written figure of $4,976.00 for U.S. Pump No. . and motor be taken in lieu of the written amount of Four Thousand Seventy-Six Dollars. Strict interpretation of the Documents is that the written amount shall govern. The second error relates to the lump sum base bid submitted of $41, 192.00. Detailed estimating and summary sheets were reviewed by yourself and the Artier on 23 November to substantiate a request that the lump sum base bid be, $42,412.00. Estimating data was also reviewed to substantiate the claim that the bid on Pump No. 2 was intended to be $4,976.00. It is our opinion, in both instane:es, that honest mistakes were made by the Contractor in entering his bid. The bid analysis may be sunmiari<ed as follows: 1. By a strict interpretation of the Contract Documents and application of the three et ivating criteria, Venture Construction, Inc_ a the low bidder. 2, if Vanturr Construction were permitted an error of $900.00 in their proposal for Pomp No. 2 and motor. their bid would still be low. 3. A Vvnt-irc Construction were peo;ntted an error of $1, 220.00, thereby im rearing the lump sure base bid to $4Z,412.00, their bid would still be low. We have experience of this Contractor's work and are of the opinion that the work would be satisfactorily performed. There appears, therefore, no doubt that the Contract should be awarded to Venture Construction Co. , Inc. The most economical approach to the transformer situation is to rent 3 - 75 kva transformers from Puget Sound Power 81 Light for the initial period while only the first two pumps are in operation. At such time (approximately 5 years) as the next pump is installed, an interim rental agreement should be made for 3 - 100 kva transformers. When the final pump is installed the City should purchase 3 - 167 kva transformers, L, The above sequence is predicated upon such factors as Puget Sound Power & Light rate schedule #40 - initial purchase price of equipment, a 6% investment factor, transformer losses, and replacement costs. 3. Transportation Gorenission: Demand Charge - $1 .67 per month per kilowatt, or major portion thereof, of maximum demand. Energy Charge - 0.66C per kilowatt hour for the first 25,000 kiiowatt hours used per month, 0.56C per kilowatt hour for the next 25,000 kilowatt hours used per month, 0,46C per kilowatt hour for the next 50,000 kilowatt hours used per month. 0.410 per kilowatt hour for all over 100,000 kilowatt hours used per month. Said rates are subject to change in accordance with the laws of the State of Washington and whenever a new schedule of rates for the same service is made ef- fective the City shall thereafter pey the new rates; provided, if the new rates are higher than those herein fixed, the City shall be entitled to Cancel this contract. It appears that the contractor will require a time extension beyond the completion date of 6 June 1967. We are given to undertand that the delay in delivery of the Renssaeler check valves was due to priority of government orders. We can confirm that Venture tried to expedite delivery. It is undertood that the Allen Bradley strike lasted about twentv-four days, but have no written confirmation of this. The check valves and electrical equipment have now been delivered. and in our opinion it would be reasonable to grant Venture Construction a time extension to 3 July 1967 without requiring payment of liquidated daruaces. It is probable that the City will have completed the 16-inch discharge line by that time and the pump station can be tested under normal operating con&tions. If you wish us to obtain more specific data on the equipment delays, ptease call upon us. Our letter of 16 August 1967 to the general contractor, Venture Construction Inc, of Auburn, a copy of which was mailed to you, summarizes the deficiencies. We have been in constant contact with Venture and the equipment suppliers, Worthington Corporation and General Electric Co. and have at last received copies of letters sated 24 October 1567 from the former and 9 October from the latter. Copies of the letters are enclosed. In our opinion the letters serve no constructive purpose, The contract oucuments require that the general contractor shall demonstrate that the equipment performs as proposed when the Contract was awarded, Neither the general contractor nor the equipment suppliers have nade this demonstration and they have failed to bring the matter to a satisfactory conclusion. We therefore feel we are obliged to make a recommendation to the City to enable the contract to be closed out. Our field tests indicate that No. I Notor (100 h.p.) is slightly overloaded at the specified guarantee point whereas the documents specify no overload. The power factor also appears to fall below the submitted value. We are prepared to accept General Electric's written statement of 9 October regardinn the life of the Motor. Determination of power factor in the field is difficult and we do not feel this is a serious Issue. Our field data also Indicates that No. 2 pump (i,500 9pm) is not meeting the performance specified in the contract. further, Its motor (150 h.p.) would be. overloaded if the pump did perform as required. The overall efficiency of both pumping units is also below submitted efficiencies by approaima teiy five (5) percent and seven (7) percent respectively, Mr. Jack Wilson 30 October 1967 Page -2- The overload of Motor No. 1 and the reduced efficiencies of the pumping units will involve higher operating costs over the life of the equipment. We feel the City Is entitled to a monetary adjustment to acknowledge the deficiency in the pumping units. This is perticularly justified because the ,ntract was awarded on the basis of combined capital and operating costs. Our letter of 25 November 1966 recommending award of the contract to Venture Construction with Worthington pumps and General Electric motors indicated on page 2 that the Worthington alternate was $251.00 less expensive that the U. S. Pump alternate. We have computed that the extra cost of operating the installed Worthington pumps a^,I General Electric motors compared with operating equipment performing as submitted would be somewhat in excess of this amount. In our opinion the station is performing the duty for whi.h it was designed and the construction is as specified. We recommend that the contract be accepted and that final payment be made to the contractor after deducting $251.00 to compensate for th± reduced efficiencies of the pumping units. Although the installed pum•oing equipment does not meet all the requirements Of the contract the City had beneficial use of the station In time to meet the exceptionally high water use In the Highlands area this summer. For this reason we feel it would be difficult to substantiate that the City has suffered damages and liquidated damages are not called for. We therefore recommend that final payment be made to Venture Construction Inc. in the amount of Two Thousand Eight Hundred Fifty-six Dollars and Forty- three Cents ($2,856.43) as computed in Pay Estimate No. 7. (Final) enclosed. This final payment is subject to the requirements of Articles D-16 and F-4 of the General Conditions of the contract. We recommend that the 12-month guarantee period called for in the contract be computed from 30 October 1967, the date of this letter to obtain additional operational experience of the equipment. Olivet City Engineer _ Bo ster Pump Station Gentlemen: As a result of complaints received from the Monterey 'errace area regarding water hammer, we have investigated the pressure waves set by the operation of the Mt. Olivet booster pumps assisted in the field by Matt Kohl. In the design of the pump station lowance was made for high pressure surge and water hammer caused by a sudd failure of the electric power supply when the pumps were operating. For thi .urpose a surge relief valve was provided to bleed off high pressure sun_ , to the suction side of the pumps. It was anticipated that such a condition could exist due to the characteristics of the discharge vine which is essenti-lly a long transmission line before there are connections nff to the distributi. . system enroute to the Highlands Reservoirs except those to Monterey Terrace. O!-r computations indicated that this surge relief valve would mect most of the anticipated conditions. It was appreciated that there would be momentary low pressure wave experienced at the pump station which could have been eV-Anated by provision of a slow operating pump control va.ve on each pump. We wished to avoid the expense of these valves if at all possible. The pump station has now been operating for a. t 12 months, and it is under- stood that there have been complaints of water hammer from some residents located on the higher ground at Monterey Terrace. Pressure readings were therefore taken in that area in conjunctinn with stopping an, startinq the larger pump at Mt. Olivet and it was determined that. a low pressure wave was causing the problem rather than excessively high pressures. Experiments have been conducted to examine :he feasibility of adapting the pr, -- surge relief valve to avoid the low pressure wave. These have only beef, ydrtially successful, in that a low pressure of approximately 50 psi was always experienced at the pump station. On account of the difference in elevations between the booster pump station and the higher groi d at Monterey Terrace, this pressure is equivalent to zero r certain of the houses and a negative pressure at others. However, the low pressure wave was of momentary duration and was quickly replaced by a positive pressure. 1• , r City of Renton it September 1966 Page -2- We have considered alternate methods of maintaining a posit've presst-re in all parts of Monterey Terrace, and are of the opinion that the most reliable and practical method would be to substitute a slow operating pump control valve on each pump in place of the presently existing spring-loaded swing check valves. These pump control valves would perform the same check feature and, when wired into the pump control circuit, would cause each pump to start against a closed valve and slowly allow flow to enter the system. Each time a pump stopped, the control valve would first close sl,.wly until the pump was operating against a closed valve when it would then stop completely. Having regard to the future addition of two (2) more pumps which will probably be of larger capacity and theref,re aggravate the present problem, we recommend substitution of pump control valves for the existing swing check valves. There is very little space available to install the 10-inch control valve for the larger pump and it will be necessary to substitute a butterfly valve for the existing gate valve. The 8-inch gate valve on the discharge of the smaller pump can remain. The 10-inch and 8-inch check valves, which will be removed, can be used in the proposed pump station at 4th A, enue and "M" Street. In our opinion the proposed wo-k can be performed by City staff, including revisions to the electrical control system and on this basis the estimated cost is $3,100.00. The present day purchase price of the two swing cl.eck valves and one gate valve is estimated to be $800.00. We recommend that the pump control valves be installed It could be argued that a limited number of customers should not be subjected to annoyance just tecause of their physical location within a fully developed residential area. It is unfortunate that a situation which we had hoped would not arise has developed in practice and will require the above expenditure to correct it. Although this is a modification to the pump station, it :> now based on operati-q experience and results from a desire to avoid unnecessary expenditure in the initial construction. We suggest that the City request quotations for the necessary equipment as specified below: One 10-inch Cla-Va. Bcoster Pump Control Valve, Type 60P, globe pattern, with check valve feature, 150 psi operating pressure, drilled 125-p04nd USA. Operating pow- shall. be 115-volt, a-c, 60 cycle. One 8-inch Cla-Val, Type 60P, as above. Suppliers: Western Utilities and H. 0. Fowler, Seattle.
