In response to your latter of 22 January f97o, we have again reviews
your request for a change In scope of the Contract and a corresponding
change in tha Contract price. The following reflects our consideration
Of each of the Items In your letter doted 2 January 1910.
i. We received the Shop drawings for the footings for the above-referonced
tank on 16 July 1*9 and returned them to you on 24 July 1969 with
changes as noted on "a drawings. The footings were checked based on
tha tank structural configuration submitted with your proposal Mat
showed a 12% earthquake load, when the supporting tovwr drawings
arrived on 4 August 1969, they more considerably different from the
aboW-rofsrenced configureflon. we rroceaded to review them and could
rmt rstloaailae the structure with our design check. Therefore on 6
August, 1969 we requested calculations for the sel smic design of the
supporting tower which we received on 11 August 1069. The calculations
showed a 12.0% earthquake factor which was based On pinned connections
et the ends of all members which Is ref whet the shop drawings showed
and does not meet the Intent of the I.HC Code. It should W pointed out
that the tower seismic Caiculetlons carry s data of to June with a
revision data of 8 August 1969 which is offer Ma footing drawings were
submitted.
On 19 August Messrs King, Hamilton, and Erickson nlscussed the design
analysis considerations with Mr. Conyers of your of}Ica. we related
our Interpretation of the IIBC Code requirement that the tank Should De
designed to reflect the actUSI field conflqureilon and loads as nearly
as possible. Also at that time, we Indicated that fabrication of "a bowl
assembly could Wgln ea we tied no disagreement with Its design but we did
disagree with the supporting tower doslnn.

brought up the Question of footing dealgn, and we couldn't give him any

above error Occurred rOnsldeaaDly after the Job was Clow-d down, Therefore,
we still anrot Justify your Clain for the Job closure.
2. As pointed out above, we gave verbal approwsl Of the bowl feDricat!On
to Mr. Comwra on 18 August 1%q, but we were still guestlonino the
supporting tower. You had Indicated In your ;hop drawing transmittals
that fabrication was to begin on 8 August 1%9, You proceeded at your
am risk, %Inca It was kw wn that tea supporting tower design was in
gweson and verbal approval had not bean given for the tower fabrication.
Therefore, we cOnnot Justify your claim for removing work from your shop.
3. In regard to your request for compeasatlon for extra engineering, we
Cannot Justify the claim since the design of the tank was to W In con-
forwnCa with the Ufr Coda for all Seismic desl9n and your design was not.
One of the basic philosophies of the code Is leaf the aslgn shall reflect
the field conditions as nearly as possible, your original Calculations
did rot do this Dy rot uslw,, the Correct member length and assuming all

with the Contract Documents,
S. The cost of laboratory tests resulted from vow vas of ',reject pipe" for
the tour lags welch Is contrary to Ma AMWA DIM speClfleatlon, to mill
eartlficats could be produced for tha '•,,Jett pipe" so lab tests were
substituted, These were required becwse the pipe was a deviation from
the specitiCstlon and the steal did not matt any recognized specification.
As a result of the above statements, we have found nothing to altar our
position end fMrefere reject your reouest for a chafwh in scone of the Contract.

Prior to completion of the erection of U,t above tank and the start
of painting, attention needs to be given to the follca+ing itu s. Th,:
first itect is the sNcificatioc rcquireniant twat all attacha+ents to G+c
tank shell or columns be continuously w,loed. nn a recent inspection
some items were not continuously weldec, such as the tank Lalcony. These
items must ne continuously welded to prevent rustinq.

rhis merbEr is a compressive member in which alinnment is critical. Tnere-
fore correction of ttw. aligment is essential.
Toe third item concerti, the roor shoe application of the inorganic
Zinc Paint to the exterior surfaces of the tank, primarily the center riser,
columns and sway bracing. There are areas of paint which have flaked off
due to contamination, mud cracked because of excess thickness and become
powdery because of overspray. These problems appear over large areas of
the tower structurt. Therefore these areas need to Lk clashed of conta.d-
nation, loose paint and all overspray. This should be accerlplisheu through
a com,hination of sandblasting and washing with spit and Span cleaner as
reccomer,ded by the paint manufacturer. Prior to startini; exterior touch-up,
we will inspect the surface preparation to insure that cleaning procedures
have been carries out.

MEMORANDUM

At approximately 9:00 a.m. this date, while traveling west on
NE 3rd Street, 1 came upon a construction project being carried
out by the slater Department. The traffic controls set ap for
protection of men and equipment and lane closure were extremely
hazardous. Complete disregard for both the motoring public and
the men working on the project is evident. The advance warning
sign iL a non-uniform, non-standard type sign. Closer to the
construction site there were a broken barricade and approximately
ten traffic cones very sloppily placed. There were no signs of
men working at this time, and the equipment was at the side of
the roadway.
At 11:00 a.m. , I returned to the scene and joined Vic TeGantvoort,
Street Commissioner. Be both took a series of pictures, which
we have on record and available for review.
There was no need to maintain lane closure during the time tle
men were away from this job. Had an accident occurred in this
area, I am sure the City would have been held liable. As City
Traffic Engineer, one of my main responsibilities is to encourage
the highest degree of traffic safety. I certainly hope that
this problem will be given yocr immediate attention.

Rollino Hills Elevated Tank
Attention: Mr. Jack Wilson Paint Inspection
Gentlemen:
On 5 June 1970 the Rolling hills Elevated Tank paint coating was
inspected for conformance with the specifications. The interior met
the required thickness while the exterior coating was less than the
required thickness in a few places. These places are primarily on the
tower legs and are only 5 mils instead of the required 6 mils. We
have reviewed the paint thickness requirements and coating selection
to determine the effect of the 5 mils on corrosion.
The exterior paint system is composed of one coat 3 mils thick
of inorganic zinc paint which acts in a similar way to cathodic pro-
tection of buried steel pipe. The zinc becomes the anode in the
cathodic reaction and sacrifices its self to protect the steel. The
3 mils of zinc can be left in an untopcoated state on the tank exterior
and still have the corrosion inhibiting properties. Thus the top coat
is primarily a color coat for appearance and is put on 3 mils thick to
give a uniform color.
The zinc coating was put on in the shop and checked in the field.
It was 3 mils or greater when checked. Therefore, the top coat is
lacking the thickness which is not too significant since the appearance
of the tank is uniform. Therefore, we are recommending that the tank
paint system be accepted. We also recomr+end that the paint system, both
interior and exterior, be inspected prior to expiration of the year
guarantee and any flaws in the paint system by corrected by the contractor.

City Engineer Rolling Hills Elevated Tank
Gentlemen:
On 1 July 1970 the Rolling Hills Elevated Tank was partially filled
with water for testing and sterilization. The tank continued to fill on
2 July and 6 July 1970 to a height of about 13 feet below the top, at which
time the water level stopped rising. The lack of water pressure to fill the
tank -, probably due to a combination of lower than normal pressures in the
Seattie pipeline and friction loss in the Renton system during the current
spell of very hot weather. In our opinion the tank can be filled during
the night hours.
Your staff conducted additional tests to determine the night pressure
and the Possible use of the Fred Nelson School pumps to fill the tank.
The pressure proved to be satisfactory at night and the tank filling was
completed on 9 July 1970.
The tank shows no signs of leakage and is ready for use after draining
of the chlorinated water and refilling with clean water. Pittsburgh-OesMoines
Steel Company has requested final payment and we feel that the tank is
acceptable with the exception of one minor item listed below.
Install bracing on the aircraft warning light.
We recommend that the procedures for finalizing the Contract be
started. Final payment will be subject to completion of the above item.
In accordance with the Contract Documents we are recoimiending that the
elevated tank be accepted as of 9 July 197U and that the one year guarantee
period commence as of that date (General Condition Article D-19). The
Contract completion date was 17 February 197U making the Contract time over-
run approximately 1-112 months. This overrun resulted from a disagreement
over design procedures used in preparing the shop drawings. Once the tank
design was settled, Pittsburgh-DesMoines Steel Company prosecuted the work
with reasonatle diligence through completion of the painting.

Had there been an emergency during which the tank would have been of
benefit, the City could have proved actual damage. However, this did not
occur. We have reviewer' the liquidated damages section of the Contract as
it applies to the Contract time overrun, and are unable to .Justify or
recommend that liquidated damages be assessed as no financial loss was
sustained by the City.
We have prepared the final progress payment as shown below:

pump stations, Tiffany Park (Capri) booster pump station and the Fred :.elscn

The Cit) recently installed an elevated tank on the Tiffany Park
booster pump system, and could have a probler in fillinc it. It later care
to our attention that there were modifications made to one or both of the
existing pumps in the Tiffany Park booster pump station, dould you please
answer these questions for ire.
(1) Could you confirm the duty of the existing ntmps for us?
(2) Can you tell us what codifications were made. ('. think two
impellers were removed.) If they were removed, could you
tell us what steps should be taken to install themr again,
and the cost for sane.
(3) -uuld you supply us with sepia copies of the building plans,
elevation data, and pump curves before and after modifications?
(4) Could you also include copies of any and all information about
the above mentioned punKi station for a file that is badly
lacking.
I would also like to get any drawings ;sepia) and information you
might have on the Fred Nelson booster pure station, for the file is
practically non-existent.

Gentlemen:
The subject elevate,: tank is now completed and we are sure
that both you aad one City of Renton are pleased with the
tank as well as how the work progressed after f=brication and
erection were started.
In checking over the punch list, we note that e1 problems have
betn resolved to your satirfattior. There is one remaining
item which is outstar.'ing from our part and that is the
,lanuary 2, 1970, letter itemizing the aedition=l costs (copy
attached) incurred by us over the design disagreement.
Ar you know, this went on for months with one disagreement
after the other, even to the point of using expensive coot-
puler applications, and in the end, not one part of the
original design was changed. This only proves to us that a
ancy analysis is fine but our simpler approach is not only
fast and economical but provides a conservative design. If
we bid elevated tanks to Ch2M i,, the future, we would still
use out standard design methods unless your sperificntions
specifically required us to add costs for a mere elabon..e
design a�,froach.
The $3746.01) asked for is money out of our pocket and obviously
was not ;a our proposal. We both know that a contract should
not be used as a club by the engineer and in this case, an
educat:onai tool for you. Hopefully you will agree with us and
will sand us your check for the amount duo.

Subiect: Renton Rolling Hills Elevated Tank
This letter is to confirm the meeting we had with representatives
Of the City of Renton and your painting subcontractor for the
subject tank on 1 June 1971.
It was agreed at that meeting that the painting subcontractor
would repair the aria on the underside of the tank where paint
hae peeled off, inspect the rest of the underside of the tank
for loose paint, Pnd touch up areas where rust from bolts has
stained the finish coat. I understand that this would be taken
care of by about 15 June 1971. To date the repairs have not
been made nor have we heard from the painting subcontractor.
Will you please check into this and let me know when the City
can expect to have the coating repaired.
