Gentlemen:
In answer to your request for sewer and water easements on our Renton
Branch of the P. S. E. Right of Way, in the Southwest 1/4 of the North-
east 1/4 of Section 24, Township 23 North, Range 4 East, W.K., to serve
the M. B. Investment Company warehouse, we are sorry but due to the
narrowness of the right of way and the number of transmission lines that '0
we are proposing to construct on it, the only space on which we can allow
an encroachment is the south five feet.
A copy of the prop,)sed water main easement is enclosed for your approval.
This easement will be granted to M. B. Investment Company and may then be
assigned to the City when the City acquires the water main.
As explained to you over the phone, we plan to construct a 115 Kv line
along the north side of the right of way to serve Metro's sewer disposal
plant, which eliminates the possibility of an easement for water or sewer
on that side.

Letter from City Attorney ShoIlan called attention to meetings and dis-
cussions during the last year or so regarding advisability of adopting
the Optional Municipal Code as provided by 1967 Session Laws, and to
studies by organizations in the City of various aspects of adoDtino one
of the alternates, their recommendationo submitted to the City heretofore.
Diligent study by an 15 member Municipal Governn.ont Advisory COm0ItC**
was acknowledged,which has the advantage of various experts on background
Information and reasons for various provisions of the Code. In order that
the Council mad fully evaluate the recommendations from the Advisory Com-
m ute• and other organizations Involved, it was suygooeod that eh* Council
or at least a committee of Council members, simultaneously study the prob-
lem,to fully acquaint Itself with highly technical subject matter, and to
benefit by having outside speakers knowledgeable in this field.
Several cities have already adopted the Resolution of Intent which
will not be effective until expiration of 90 days , allowing ciao for a
referendum, thereafter to be effected by an Ordinance adopting the classi-
fication of Non-Chaiter Cod* City. The Resolution could contain a
declaration of intention to ro-organise the municipal government on an*
of the Ilans authorised by the Act, decision having to be mad* whether
the City should have 4 Mayor-Council or Menagor-Council form of government .
Such Resolution does not have to spell out details of the reorganisation
whitn matter would be deferred until after the 90 day period.
It is believed that the study and adoption of classification of Mon-
Charter Code City would be advisable and would improve officionoy of local
government, and early action was urgod to gain necessary background to
act promptly and decisively. Speakers will be suggested if desired. <

Dear Mr. Wilson:
Our firm is presently engaged in the design of a v,.rehouse for Mr. Mike Lotto just
north o' the Loagacres Race Track. We have been to contact with Mr. Ron Olson
of your Department in regard to extending the wal.er line to this property site
from the existing 12" Metro water line directly to the east of us. At present, the
owner is In the process of obtaining the required easements, through his attorney,
Mr. Gerald Shellan, from the Puget Sound Pcver and Light Company to bring this
water line down to his site. In bringing this dove, It would be our understanding
that the City could have some sort of a latecomers agreement with the property
owner, who moy sometime in the future requeat to hook up to this line to also help
defray some of the expenses.
At the present time, we are investigating the possibility of sprinklering the build-
ing for fire insurance purpooes. In discussing this with the Fire Chief, Mr. M. C.
Walls, he verbally approved the installation of only one fire hydrant if the building
is sprinklered. If we do not sprinkle the building, it appears that we will have
to locate 2 fire hydrants on the site. It has also been verbally stated that there
is no problem in Mr. Lotto's hook up to the Metro water line, and it has been told to
ve that the connection charge will be somewhere in the neighborhood of $100.:. Before
we proceed with final design of this building, Mr. Lotto has asked us to request from
you in writing assurance that he can do the following:
1) Connect into the existing 12" mete waterlin and know exactly what this charge will
be.
2) If he desires ix sprinkle the building, which we will not know definitely until
the bids come in on the sprinkler system, it will be all right to place rnly ono
fire hydrant on the site.
3) If he decides not to sprinkle the building, it will be satisfactory to locate
2 fire hydrants on the site in the location$ as indicated by your Engineering
Department in n drawing, given to us by Ron Olson.
We would appreciate an &never to this i.etter as soon as possible, as we are already
committed to the design stage and would like to know immediately if you act any serious
problems in obtaining water to the site.

We respectfully request that the Cit• of Renton execute an agreement ).ith ;he
owner of a warehouse at 1520 S.W. Grady Way along the following lines:
1) Construction cf a water line on public righ.-ofway (S.W. Grady Way,
vicinit- of Sc. 147th Street) of a size sufficient to provide water
supply ..rd fire protection for adjacent properties. said line to
be approved as to material , size and location by City Fire and
Engineering Departments.
2) This line Is already approved, installed and tested and we understand
that it Is ready to be turned over to the City of Renton and that the
details of the latecomer's agreement are the only matters remaining.
31 We believe that the computation of the latecomer's charges could be
determined on a mutually agreeable basis; area, front footage, or a
combination. Fees collected for connection to this line prior to
January 1 , 1985 would be immediately remitted to M. B. Investment Co.
4) Cost of the water line -luld be considered as:
(a) the actual cost of constriction plus sales tax charged to the
owner by the subcontractor, plus
(b) the cost of administration and contract supervision charged to
the owner - y R. W. Lotto Construction Company, plus
(c) the actuar cost of engineering and survcy;ng associated with
the design and construction of this water line.

their policy to charge all engineering time and expense against the particular

Enclosed please find vie letter from Lotto Construction Company dated
March 25, 1970, setting forth the costs of the water line extension to
serve this facility.
You will note that the cost of the water line to the owner include.; the
necessary contractual and supervisory work provided by the general contractor,
R. W. Lotto Construction Company.
The city of Renton evidently does not accept any design engineering as a
necessary part of water line construction, or considers this a "free
se mice". The city should realize, however, that the construction super-
vision, overhead and profit added by the general contractor to the cost of
the subcont.ictor is the cost to the owner. Although you may not be familiar
with this procedure, in building construction work, this is the normal method
of doing business. (This cost covers the soliciting of bids , review, awarding,
scheduling, progress payments, etc. , provided by the general_ contractor) .
Your city attorney or Renton School District N403 could assist you in back-
ground information on this point.
