Lyman Houk Engineering Department City Hall Renton, Washington 96055 Re: Puget Sound Power Light Company Utility Easements Dear Lyman: t This is to acknowledge receipt of your memo dated November 11, 1971 concerning three proposed easements running from Puget Sound Power and Light Company to the City. 1. Proposed Easement re: Renton Elks Club: You realize that this is an extremely tight easement from the City's standpoint by reason of paragraphs 4,5 and 7. You should make the determination whether the 60 day relocation time, as contained in paragraph 7, i is something that the City could live with and what the reasonable chances are of having to so relocate . 2. Re: 12" Sanitary Sewer, Line: There again we call your attention to paragraphs 5 and 9 in particular and as you can see the same problem will arise in regard to the sewer facility. in that case, you at least could relocate it within the proposed easement and you again dould determine what likelihood may occur that would require such relocation especially where the easement is limited to 15 feet in any event. It seems to be an extremely tight requirement that Puget is i^.posing. 3. Re: Slope Easement: You will note that paragraphs 3 and 6 may noc be acceptable. As to the latter, any relocation of Grantor's facilities would have to be done at the City's expense. I cannot tell what kind of a slope easement you have in mind and how vital It is since it seems to effect the southerly 12 feet of Puget's property. I certainly am not in a position to advise on the likelihood of such occurrence and this is a matter that the Engineering Department should decide. our function should be limited to pointing out the possible legal consequences by reason of the various clauses inserted in the easement. Para- graphs 2 and 3 are in standard form but paragraph 4 could be modified so that the City, as grantee, does not assume --11 of the risks for damages to the line as now written. Grantor shoulc be required to use some reasonable care in its use of the land in question as otherwise the City may become an insurer of All of grantor's acts.
