Grant Avenue South Dear Mr. Benoit: This is in response to your letter dated December 22, 1987, wherein you requested permission to install two replacement water services across the City of Seattle' s Cedar River Pipeline right-of-way in the vicinity of Grant Avenue South. We have enclosed two copies of a Permit with attached exhibits. Please have them exec6ted in acceptance on behalf of the City of Renton, and return one copy to this office, along with a remittance of $420 for the permit application fee. Please be advised that we are planning to install additional cathodic protection facilities within our right-of-way to the southeast of your crossings. These facilities arm sketched on the exhibits for your information so that you may consider measures to prevr,it potential interference damage to your water services and/or your existing 6-inch watermain within our right-of-way. If you should decide to encase your 3/4-inch copper serli -es in PVC conduit, or use plastic services exclusively, we herewi Athorize ttbese alternative installations. Approximately 42 feet northwesterly of the intersection of the centerline of Grant Avenue South and the centerline of said pipeline R/W, as measured along said pipeline R/W centerline. P. Approximately 22 feet southeasterly of the above intersection, as measured along said pipeline R/W centerline. All situate in the S.W. 1/4 of Section 17-23-5 in King County, WA (Book Map page 328) and as depicted on exhibit by Renton for W-410, Renton Hill Water System Improvement, sheet 9/9, as revised 10-6-87. Minimum vertical clearance of 12 inches to be maintained between services and three pipelines. SUBJECT to City of Seattle ordinances and regulations and to the following terms and stipulations: 1. The Permittee agrees that the City of Seattle shall not be responsible for any injury, loss or damage of any kind or description which may accrue to or be sustained by any person, firm, corporation or other entity by reason of the construction, maintenance, operation or use of said installation, or the use and occupancy of the property referenced above by the Permittee, its successors or assigns. In the event any suit or action he bro^:ght against the City by reason thereof, the Permittee, its successors or assigns, shall indemnify and save the City harmless therefrom, and shall upon rotice to it of the commencement thereof, defend such suit or action at its sole cost and expense and will fully satisfy the final judgement rendered in any such suit or action except for that portion, if any, of such injury, loss or aamage that results in such ,judgement, which is attributable to and proximately results from negligence of the City, its agents, employees or officers. 2. The Seattle Water Dept. shall be notified (625-4184) two days before work is begun, 3. Permittee's use of the right of way shall i- no way interfere with the present or future use of said right of way by the City for any purpose. Work to be prosecuted with diligence, and with due -espect to all property, contracts, persons, rights and the interests and convenience of the public. Permittee agrees to restore the premises to the condition found, or better. 4. If at any time the City shall install, repair or replace a pipeline or pipelines at said water service crossings, Permittee upon written notice from the City shall ter:porarily remove its water services at its own expense during City's installation, repair 0. replacement an s— -d— hell-r-epTace same at its own expense under the supervision of the City, 5. Permittee agrees upon being billed therefor to pay for any increase in the City's cost of installing, replacing or repairing the City's pipelines or other City improvements resulting from the existence of Permittee's installations 6. Permittee agrees to pay to the City the reasonable cost of repair of any of the City's facilities damaged by the installation, operation or maintenance of Permittee's 7. ermittee agrees that the City shall not be liable for any damage to said water services by reason of any construction, alteration or improvement by the City, its agents or representatives, except where such damage :s caused by the sole or comparative negligence of the City, its agents or employees. 7A. The Permittee shall notify the City prior to installing cathodic pi .3tection to facilities approved b'y this Permit. Permittee will provide, at its own expense, appro- priate corrosion control measures to protect the City's facilities from stray electrical current caused by Permittee's facilities. The City will notify the Permittee of any future cathodic protection facilities installed by the City, and Permittee shall be responsible for installing and maintaining stray current mitigation measures to its facilities. The Permittee shall join with the City in cooperative testing for stray current interference. The City shall not be responsible for any corrosive damage to Permittee's facilities caused by the City's existing or future cathodic protection installations, except where such damage is caused by the sole or comparative negligence of the City, its agents or employees. 8. The City reserves the right to institute an annual fee for this permit. 9. This permit is revocable upon thirty days notice by the Superintendent of Water. 10. This permit is not transferrable. 11. One copy of this permit must be on-site during installation by Permittee or Permittee's agent, All work shall be completed by February 28,_ 1989 12.
