Lear Mrs. Crippen:
I discussed the above referenced matter with Mr. Gonnison after talking
with you about it last week. As acknowledged meeting with you previous-
Iv and stated he felt that there was a general agreement that the instatla-
tion of the water main was a definite benefit to vour property. In fact,
he indir*ated your husband arrived home Lust before he left and gave him the
impression you were going to pav as previously agreed.
In checking with our Utilities Enginoering Division, I found the other two
r.uopertins were originally being served through the one service line which
was tapped to the main to serve your property. When thn new main was
installed the existing service line was tapped to the new main to serve
your property. New tap: were necessary for the other two so that each
would be served separateP, and independent of the other. Also, a hydrant
was installed at the and of the new main which provides all the properties
with better fire protection.
As I ,inderstand, there was an oral agreement with the three property owners
involved to pay one-half the Trost of materials necessary for the water mai.i
installation. You have since sold your property, however, your cost of the
water main installation was not paid prior to sale.
The fact that you have subsequently sold the property does not relieve you
from your obligation. Both parties entered into an agreement in good faith
and the City upheld its part of the agreement by installing the improvement.
Therefore, we are auxin requesting that, you pay the 5111�.25 as per our agree-
ment.

SUBJECT: Loy Water Pressure, Aberdeen Ave. N.E. - North of
N.E. 27th
on September 4 and 5, we carried out an inspection and water testing at the
above referenced vicinity. We checked the main valves to be sure they were
open and flowed the hydrant. Everything is in 000a order.
We have a static pressure of 60 lbs. at the hydrant. We then checked and
removed all meters at the 3 homes involved and had 60 pal at the meters.
At 2733 Aberdeen N.E. we were showing 60 lbs. pressure at the meter but only
7 lbs. at the faucet on the back-aide of the house. We were still maintain-
ing 60 psi at all the meters at this time.
This indicates that in at least the one home, and we expect that all of the
hones are Lhe same, that the line from the meter to the house is not large
enough or constricted in some manner.

and are experiencing difficulty in obtainiml definite prices for more
than a 2GGday period. The same applies to the slight increacu in the
cost of concrete. There is a possibility that the cost could conceiv-
ably increase as much as 100%.

In view of Jerry Shallan's latest memo of Dtcember le, 1973 perhaps we should
ask the people to pay the cost of the water main in cash since it is a very
small amount.
on sanitary sewers - since all properties that are assessed must be benefitted
by State law than it would appear that the method we talked about for the
sewers is illegal and it might be better to have a separate yob for Mr. Samples
to extend the line the 150' where he would connect then in order to get It
out of the street improvement the utilities would extend it on to N.B. 29th
and we could leave the road L.I.D. serving all five pieces of property and
it would not be any problem.

Gentlemen:
Thank you for your Memo of December 13, 1373 in answer to our
letter of December 5 regarding the questions raised by our
office about the method of assessment for the abovecaptioned
L. I.D.
We stil' believe that serious problems exist based on the
language of the Petition which appears to be somewhat of a
"negotiated deal" with the property owners involved regarding
the am. unts of assessments to be paid by each.
We hereby call your attention to RCd 35.43.220 and RCW 35.44.010,
in particular. These statutory provisions specify that the cost
and expense of any such improvements shall be distributed and
assessed against all the property included in such LID in
accordance with t :e special benefits conferred. Furthermore,
all property included within the LID shall be considered the
property specially benefitted by the LID and shall be the
property to be assessed. It would therefore Ge ircumbent
upon you to determine whether all the properties are benefitted
by the proposed LID and if so, they must be assessed according
to the statutory method. If there is no enefi.t, and thus no
assessment, the property should not he included within the
boundaries of the LID.
Please also keep In mind that the assessment can in no way }
exceed the enhancement value of the property involved. i

For example, if the Samples property has ample water supply,
then undoubtedly you could not assess for the full amount of
the new water main but only for the benefit derived by the
owner by reason of this new installation which means that
some adjustment may have to be made for the existing water
facility that services this property. Likewise if the other
property owners do not have a sanitary sewer system now and
they are included in the District, they have to be assessed.
Possibly this is a situation in which all the proposed improve-
ments should not be included in one LID and possibly some
improvements could be made on a cash payment basis if that is
feasible.
We are bringing these matters to y attention so that a
satisfactory solution nan be foun t or�priorto t ing

Again, the question arises how you are going to finance
this type of a project. Did you have in mind that there
would be some form of "latecomer agreement" between
Samples and Spencer and McKean? Is Samples willing, on
a voluntary basic:, to as.,ume the full cost of the sewer
assessment? And if this is the case, there fould be a
voluntary commitment for them to do so; othe^wise you
will not be able to adhere to the method and procedure
for assessment outlined in the statute.
I have some serious doubt whether this Petition standing by
itself would be legally sufficient or enforcable. I think
the matter should be clarified and above all some determination
is to be made as to the total cost of the project and how it is
to be financed. There may be some question of enforcing any
assessments against all the propaties as required by statute
unless the City is assuming certain specific costs which should
be spelled out.
If we can be of any further help to you in this matter please
advise.

We would suggest that you complete same as to Items

However, in reading over the City Clerk's file on the 4(
natter we have certain questions regarding the Petition
and method of payment that is outlined therein. They

are as follows: R?`
1. We notioethat there are two petitions in the file ,,..
and we presume that the undated petition that was received ;
by the City Clerk November =73 is a valid one.
2. If so, there seems some discrepancy in paragraph (2)
therecf sin,•e no provision is made for the cost of "street
paving". The question naturally would arise who is going
to bear said cost.
3. The Petition sets the rate of $3.50 per front foot
for the installation of curbs, gutters and street paving
and we presume that this uniform rate would apply to all
the affected and benefited properties.
As to the water main installation a front foot
assessment of $1. 50 is stated apparent. / only as to two
parcels of property and that the Samples are to be
assessed only at that rate if and when connection is made
to the water main. Some question, of course , would arise
immediately as to how this project is to be financed if
you do not have any means of collecting or assessing unless there
is a connection. We presume that in the Samples case they
could not be required to hook up contrary to the provision
of our Ordinance.
4. We have some difficulty interpreting paragraph (3)
of the Petition since it seems to imply that the sewer
assessment shall only apply to the Samples property and

Gentlemen:
Thank you for your Memo of December 13 , 1973 in answer to our
letter of December 5 regarding the questions raised by our
office about the method of assessment for the abovecaptioned
L.I.D.
We still believe that serious problems exist based on the
language of the Fetition which appears to be somewhat of a
"negotiated deal" with the property owners involved regarding
the amounts of assessments to be paid by each.
We hereby call your attention to RCW 35.43.220 and RCW 35.44.010,
in particular. These statutory provisions specify that the cost
_. and expense of any such improvements shall be distributed and
assessed agiinst all the property included in such LID in
accordance with the special benefits conferred. Furthermore,
all property included within the LID shall bs considered the
property specially benefitted by the LID and shall be the
property to be assessed. It would therefore a incum ent
upon you to determine whether all the properties are benefitted
by the proposed LID and if so, they must be assessed according
to the statutory method. If there is no enefit, and thus no
assessment, the pro ty should not be included within the
boundaries of the LTD.
Please also keep in mind that the assessment can in no way
exceed the enhancement value of the property involved.
For example, if the Samples property has ample water supply,
then undoubtedly you could not assess for the full amount of
the new water main but only for the benefit derived by the
owner by 'reason of this new installation which means that
some adjustment may have to be made for the existing water
facility that services thin. property. Likewise if the other
property owners do not have a sanitary sewer system now and
they are included in tie District, they have to be assessed.
Possibly this is a situation in which all the proposed improve-
ments should not be included in one LID and possibly some
improvements could be made on a c-as payment basis if that is
feasible.

G ntlemen:
On Tannery 29, 1974 we hand-carried a letter to the S -roperty Owners
^oncerned with L.I.D. 282.
Realizing that no information regarding the actual amount of increases
was given in the context of the letter a subsequent letter dated
{ January 30, 1974 was hand-carried to the said owners. Copies of both
letters are attached.
So far we have heard from only two of the owners and they have iodic>te
that they are not interested. It is possible that the other Owners will
attend the continued public hearing.
we have also made contact wit1, our asphalt supplier regarding material
costs and the quoted the following: $11.50 per ton for Clac4 B asphalt
mix, picked up at plant si' or $19.50 per ton in place. we have also
contacted FeB Cement and secured a price of $2.00 per l.f. for curbs and
gutters in place on a prepared base.

water main which spelled out specific amounts, namely $3.50 per lineal

However, we have had an increase in material costs in pipe and acphalt
n,d are experiencing difficulty in obtaining definite prices for more
than a 20-day period. The same applies to the slight increase in the
cost of concrete. There is a possibility that the cost could conceiv-
ably increase as much as 100%.
The City Council has asked that you be contacted and made aware f _

N.E. 27th came up again and the public Works committee requested
that the public works Department notif•; the property owners
involved that there would be a meeting within the next three
weeks. The time and date will be set later and they will be so
notified.

prepared with the ownurs. I believe that you talked once before

RE: Aberdeen Avenue Northeast Proposed LID
Gentlemen:
The petition requesting creation of a Local Improvement District adjr'ning
Aberdeen Avenue Northeast between Northeast 27th and Northeast 28th street
is signed by owners representing 49.41 of the front footage and 5U.15% of
area abutting the proposed improvements.
1 The petition requests the construction of curbs, gutters, street paving,
and a water main in the above noted portion of Aberdeen Avenue Northeast.
The front footage charge of $5.00 per front foot would pay the cost of
installing curb and gutters, which would be built by a private contractor,
and the material cost of preparing the street for the installation of curbs,
gutters, and an asphalt overlay. The material cost of the watermain woulo also
be paid within the $5.00 assessment.
The City would prepare the street for the installation of the curbs, gutters
and paving. The paving and watermain would be installed by the City.
The $5.00 assessment - ipproximately one-half the cost of providing these
improvements.
