RL: VACATION OF WATER LINE EASEMENT
Councilman Stredicke requested an opinion from You
as to Division®ofether not PublichWorksyl)epartment,tcouldlissue
a permit for the construction of buildings on a water
line or uby th easement prior to formal vacation of
the same by the• City Council . I am attaching Council
minutes, correspondence, —.1 sketches relative to
this matter and also two easements as granted by the
Pacific Coast Railroad to the City for utility
easement purposes.
The circumstances in this particular situation and the
chain of events as they occurred are as follows:
1) The property awner applied for a building permit
fe, construction on the water line easement and over
th' top of the City's existing water line. A new line
had been constructed pursuant to the easements granted
by the railroad.
1) This application was reviewed by the Utilities
Division, and the owner was advised that he could not
construct his building on the easement bc- would be
required to relocate the waterline and grant a new easement
to cover the relocated water line. One of the conditions
stipulated by the railroad reserved the right of the
grantor to relocate a portion of the water line should it
determine that the location of the water line would interfere
with proposed building construction or other surface use.
Such relocation would be at the expense of the grantor.
3) The Building permit was then issued pursuant to the
Utilities Division's determination that the old easement
was no longer required for utility purposes in view of
the relocated water line and new easement .

a? Apparently during the owner's efforts to obtain
permanent financing, it was required that the old ease.
ment be removed and thus his request to the City for
abandonment of the vacated easement.
We feel that the procedure in this instance is proper.
Frequently we would permit construction on easements
which would no, interfere with the operation and
maintenance of utilities. To our knowledge there is no
ordinance or specific restriction prohibiting the
issuance of building permits over easements, provided
that the owner of the easement, namely the utility, is
agreeable.
The specific question here would he as to whether or not
the Public Works Department has the authority to so
issue such a building permit prior to formal action by
the City Council vacating the old easement.
